Vacancies and Voluntary Transfers. A vacancy shall be defined as a new position or a position not already filled by a teacher from within a building. A transfer shall be defined as a change from one building to another without change in salary. Vacancies for positions covered by this bargaining unit will be announced in District bulletins, copies of which will be mailed to the Association office as they become known, except: (a) for a leave replacement contract position and (b) for positions where a person previously on leave replacement contract is being recommended to fill the vacancy. Prior to the summer vacation period, the District shall provide information to teachers regarding the use of the certificated job line for announcement of summer vacancies. Vacancies for any positions covered by this bargaining unit which may only be filled from teachers already in the building will first be announced in building bulletins and/or in letters which will be mailed to the teachers in the building. Transfer request forms shall be available to all teachers in their buildings or District office. Use of the form shall not be prejudicial to the teacher‘s professional standing. As vacancies occur, a teacher may request consideration for transfer by completing a Certificated Transfer Request Form and submitting it to Human Resources within seven (7) days of the announcement of the vacancy. During the summer vacation period, the request for transfer form may be submitted by a teacher‘s designee. In the event the principal is unavailable at the time a teacher or designee submits a request for transfer form during the summer vacation period, the District shall waive the requirement for the principal‘s signature. Teachers will be considered for an interview according to the certification required, and the specific requirements of the position as listed in the vacancy announcement. Teachers not meeting the minimum requirements of the vacancy shall be notified in writing by Human Resources when an interview was not granted. Teachers meeting the minimum requirements will be notified of their interview time.

Whenever any vacancy in a professional position occurs during the school year (September to June) it will be adequately publicized by the Superintendent by means of a notice placed on the bulletin board in every school as far in advance of the appointment as possible. During the months of July and August, written notice of any such vacancy will be available and may be picked up. Rochester teachers shall only be required to submit current letters of reference; however, teachers may provide additional materials at their discretion. There shall not be the requirement to submit the entire employment application. Rochester Teachers will be guaranteed an interview for vacancies.

No later than two (2) weeks after the return date for contracts for each school year, and when there are known vacancies, the Superintendent shall electronically post all of the known vacancies. Any such notification shall be made at the same time as or earlier than any external postings. B. Educators who desire a change in grade and/or subject assignment or who desire to transfer to another building shall file an electronic statement with the Superintendent with a copy to the Association President. Such statement shall include the grade and/or subject to which the educator desires to be assigned and the school or schools to which they desire to be transferred, in order of preference. C. In the determination of requests for a voluntary reassignment and/or transfer, the wishes of the individual educator shall be considered in connection with whether the transfer conflicts with the instructional requirements and best interests of the school system. Any qualified educator requesting a transfer shall be afforded an interview by the school's interview team. The Superintendent's decision as to which candidate will be chosen to fill a vacancy is final.

Lists of vacancies, will be posted on the school district’s web site and sent to each employee’s school e­mail. During the school year a copy of supplementals and vacancies shall be sent to each school and shall be posted on the employeesbulletin board for no fewer than three (3) days. Major factors to be considered in filling positions shall include, but not be limited to: type of license and endorsements, favoring continuing over limited contract and greater over less seniority within the District. All employee who meet the licensure requirements will be granted an interview. If there are more than five (5) internal candidates, administrators may choose no less than five (5) to interview, unless they have interviewed with the same administrator within the past two (2) years. Employees will be given consideration over individuals not employed by the District when equally licensed and equally qualified, excluding non- bargaining unit positions. Within seven (7) days of the decision to fill a vacancy, all applicants shall be notified in writing of the decision.
Vacancies and Voluntary Transfers. A notice of vacancies and new positions which the Board intends to fill, including vacancies in promotional positions, shall be publicized to employees and applications solicited pursuant to the following procedures: A. Such vacancies shall be publicized to employees by posting a written notice in a clearly designated place in each school as they occur. B. E. If any vacancy occurs after the close of the school term and before the opening of the next school year, notices of such vacancies shall be mailed to the president of the Association. In addition, notice of any vacancies shall be mailed to the president of the Association.

Employees shall have five (5) working days to provide written contact to the District office of their desire for the position and their qualifications. The District declares its support of a policy of filling vacancies from within its own staff, all other factors being equal. B. Members who desire a change in assignment, or who desire to transfer to another building, for the next school year, may file a written statement of such desire with the Superintendent not later than April 15. Upon request, the member who is not assigned the position shall be given a written explanation of the reasons for not being selected. D. In acting on requests for voluntary transfer and in filling a vacancy, the District will apply the following criteria to select the best candidate: 1. Approval of the Superintendent or designee; 2. Individual qualifications, including highly qualified status, when relevant; 3. Staffing level needs; 4. Seniority; and 5. For TSPC licensed staff, licensure. E. Upon timely application, qualified employees shall be guaranteed an interview along with external candidates. F. Where the foregoing factors are substantially equal in the District’s judgment, the preference in assignment or transfer shall be given to the incumbent applicant with the greatest number of years of service in the District 17C school system.

FPA members are encouraged to apply online for positions of interest. Any qualified, current principal will receive an interview. Vacancies and Voluntary Transfers. When the administration intends to fill a vacant bargaining unit position during the school term, the administration shall, within three (3) days, post a vacancy notice on the Association's bulletin boards and the office of every attendance center. A copy of the notice shall also be provided to the Association President. The vacancy shall not be filled on a permanent basis until such time as the requirements of this paragraph have been complied with. Whenever such vacancy occurs other than during the school term, the administration shall, within three (3) days of its determination to fill the vacancy, send a vacancy notice to the Association President. A vacancy shall occur with the happening of any of the following: 1. death of a Teacher; 2. retirement of a Teacher; 3. resignation of a Teacher; 4. termination of a Teacher; 5. creation of a new bargaining unit position; or 6. any Board approved leave for one (1) year or more. Tenured Teachers may apply for transfers to another building, grade level or subject area, provided vacancies exist. Such applications shall be in writing and sent to the Principal where the vacancy exists. A Teacher may request a conference to discuss the transfer with the Principal in whose building the vacancy exists. If any tenured Teacher who has made application is denied the assignment, he/she may request a written reason(s) for the denial from the appropriate administrator.

During the summer, vacancies will be posted in the Principals’ offices and a copy of the postings mailed to the President of the Association and posted on the school web site not less than ten (10) days before the position is permanently filled.‌
