Contractor’s Scope of Work. This project entails the full scope engineering, procurement and construction of the Project. With the exception of those Owner obligations specifically enumerated herein or in the Agreement, the Contractor’s Scope of Work for the Project includes the provision of all engineering design services, procurement, installation, testing, and commissioning for the Project. It is the Contractor’s responsibility to review all pertinent Project requirements and criteria, as contained in the entirety of the scope of work. However, the Contractor shall not rely on the physical description contained in the scope documents to identify all Project components. The Contractor shall determine the full scope of the Project through thorough examination of the supplied documents, the Site, the reference materials provided during the Request for Proposals process, and any reasonable inferences to be gathered there from.
Contractor’s Scope of Work. 6.1 Contractor shall provide all labor, supervision, materials, equipment, tools, services and expertise necessary for the completion of Services, in accordance with the specifications, terms and conditions contained in the Contract Documents. Contractor shall perform the Services in accordance with that degree of care and skill ordinarily exercised by reputable members of its profession.
6.2 Contractor represents and warrants to the City that: (i) Contractor possesses all qualifications, licenses and expertise required for the provision of Services, with personnel fully licensed by the State of Florida; (ii) Contractor is not delinquent in the payment of any sums due the City, including payment of permit fees, local business taxes, or in the performance of any obligations to the City; (iii) all personnel assigned to perform work shall be, at all times during the term hereof, fully qualified and trained to perform the tasks assigned to each; (iv) the Services will be performed in the manner and at such times and locations as described by the City for the budgeted amount; and (v) the person executing this Agreement on behalf of Contractor is duly authorized to execute same and fully bind Contractor as a party to this Agreement.
6.3 Contractor agrees and understands that: (i) any and all subcontractors used by Contractor shall be paid by Contractor and not paid directly by the City; and (ii) any and all liabilities regarding payment to, or use of subcontractors for any of the work related to this Agreement, shall be borne solely by Contractor.
6.4 Contractor warrants that any and all work, materials, services or equipment that may reasonably be inferred from the Contract Documents as being required to produce the intended result, will be supplied by the Contractor at its own cost, whether or not specifically called for.
6.5 The Services shall be completed by the Contractor to the satisfaction of the City. The City shall make decisions on all claims regarding interpretation of the Agreement and on all other matters relating to the execution, progress and quality of the Services.
6.6 Contractor hereby agrees that it will exert every reasonable and diligent effort to ensure that all labor employed by Contractor, including that of its Subcontractors for Work on the Project, shall be in accordance with the Contract Documents and shall incorporate the requirements set forth by applicable rules, regulations, codes and statutes of Permitting Authority.

Contractor’s Scope of Work. All work must be carried out and maintained per the Drawings, CQA Plan, and Addendums subject to the approval of the CQA Personnel. Any materials that are found to be outside the tolerances identified in the Drawings and CQA Plan must be reworked or removed and replaced to the approval of the CQA Personnel and at no additional cost to the OWNER. If there are any conflicts between this document and the CQA Plan, the CQA Plan will take precedence. Contractor will be responsible for any damage its operations cause to any portion of the Work, regardless of the circumstances, and will repair this damage to the approval of the CQA Personnel and at no additional cost to the OWNER. The Contractor’s Surveyor, at the Contractor’s discretion, will verify starting elevations as prepared by OWNER's surveyor and will bring any discrepancies that affect the contract documents to the attention of the OWNER immediately upon discovery of that discrepancy. The Contractor will have a sufficiently reliable survey capability to provide grade control during the construction process to minimize certification surveys completed by the OWNER. The OWNER will provide a limited number of surveys for certification purposes of the finished portions of the project including pond dimensions and subgrade and leak detection system. The CQA Firm will prepare final record Drawings of the Work based on certification surveys conducted by OWNER’s surveyor. Contractor is responsible for all dewatering and repairs required due to rain or freezing through final OWNER acceptance of all work of the contract; associated costs are to be included in unit prices. The Contractor will also be responsible for dust control and temporary stormwater drainage during construction, including during installation of the synthetic materials, to protect the work and avoid any delays in construction. OWNER holds a stormwater discharge permit and air emissions Construction Permit for landfill operations, including earthmoving activities and the Contractor shall comply with all provisions of these permits as they relate to the work. Water for soils processing and dust control will be provided by OWNER from an on-site holding pond. It should be noted that although the drawings include additional details regarding concrete offloading pads, this work will be bid separately from the activities outlined in this document.

6.2 Contractor covenants to furnish its best skill and judgment in furthering the interests of the City. Contractor agrees to furnish efficient business administration and superintendence and use its best efforts to complete the Project in the best and soundest way and in the most expeditious and economical manner consistent with the interests of the City.
6.3 Contractor shall provide pre-installation Work which includes, but shall not be limited to, the following:
6.3.1 Maintain a list of Subcontractors, including local business and workforce participation.
6.4 Contractor shall become thoroughly familiar with the evolving architectural, civil, mechanical, plumbing, electrical, and structural plans and specifications. Contractor shall submit to the City, and Permitting Authorities such comments as may be appropriate concerning construction feasibility and practicality.
6.5 The City disclaims any warranty that the Drawings, plans and specifications for the Project are accurate, practical, consistent and/or constructible.
6.6 Contractor shall take into consideration such factors as natural and practical lines of severability, sequencing effectiveness, access and availability constraints, total time for completion, construction market conditions, availability of local labor and materials, community relations and any other factors pertinent to saving time and cost.
6.7 Contractor shall take such measures as appropriate to provide that construction requirements will be covered in the separate subcontracts performed without duplication or overlap, sequenced to maintain completion of all Work on schedule.
6.8 Work which the Contractor shall provide includes but is not limited to, the following:
6.8.1 Develop and implement procedures to monitor, record, review and approve all submittals, Drawings, Change Orders, pay requests and field orders for budget and schedule impact and compliance with the Contract Documents.
6.8.2 Provide inspection of all Work, materials and tests prior to Substantial Completion and final inspections by appropriate certified inspectors and Permitting Authorities.

6.3.2 Prepare Completion Times for each Worksite which clearly illustrates critical path elements, responsibilities of the City, Contractor, architect-engineer (if any), Permitting Authorities, and outside agencies, including periodic updates throughout the duration of the Agreement.
6.3.3 Provide Project delivery options for the timely completion of all phases for efficient scheduling, cost control, and financial resource management.
6.3.4 Utilize an information and reporting system acceptable to the City Manager to provide the Project Manager with accurate and current cost control, Work status, including but not limited to a Work narrative, Work completed and anticipated, and the Completion Time of the Project at all times.
6.3.5 Provide procedures to ensure maximum local business and workforce preference requirements are realized in the production of the Project.
6.3.6 Provide value engineering recommendations to maximize the City’s capital outlay and operations resources.
6.3.7 Review all design documents for constructability and compliance with applicable laws, rules, codes, design standards and ordinances.
6.3.8 Update cost estimates and make recommendations to keep the Project within the Project Amount.
6.3.9 Update the Project Completion Time and make recommendations for recovery of lost time and shortening the Completion Time.

6.3.4 Update the Work Schedule and make recommendations for recovery of lost time and shortening the Work Schedule.
6.3.5 Maintain a list of Subcontractors, including local business and workforce participation.
6.3.6 Ensure for bonding of Subcontractors.
6.3.7 Develop and implement procedures to monitor, record, and review all Work, Change Orders, pay requests and compliance with the Contract Documents.
6.3.8 Provide inspection of Services at all Worksites.
6.1.9 Ensure the replacement of nonconforming or substandard Work.
6.4 Contractor shall be responsible for any deficient Work and shall promptly correct or replace such deficient Work without cost to the City. The Contractor shall also be responsible for all damages resulting from any errors and/or omissions. Payment in full by the City for Services performed does not constitute a waiver of this representation.
6.5 Contractor shall supervise and direct the Work, using the highest quality established by industry standards.
6.6 Contractor shall be responsible to the City for the acts and omissions of the Contractor’s employees, Subcontractors and their agents and any employees and other persons performing portions of the Work under on behalf of the Contractor.

Contractor’s Scope of Work. CONTRACTOR shall perform the Scope of Work described in Exhibit A in a manner satisfactory to CITY and consistent with that level of care and skill ordinarily exercised by members of the profession currently practicing in the same locality under similar conditions. CITY shall have the right to order, in writing, changes in the Scope of Work. Any changes in the Scope of Work by CONTRACTOR must be made in writing and approved by both parties. The cost of any change in the Scope of Work must be agreed to by both parties in writing.
Contractor’s Scope of Work. Contractor agrees to the following scope of work:
a. To cut and bale grass/legume hay in the designated area as indicated on the attached Exhibit 2. It is anticipated that there will be at least two cuttings per year. The timing of all cuttings will be coordinated with approval from the WWTP Chief Operator.
b. Any cutting will be at least thirty (30) days after application of liquid biosolids per USEPA & MDNR Regulations.
c. All xxxxx will be removed from the property within seven to ten days of mowing and baling depending upon weather conditions.
d. Fertilize outside 50-foot parameter of field with commercial fertilizer N-P205-K20: 000- 00-000 lbs./acre annually and provide a receipt and fertilize inside 50-foot parameter with commercial fertilizer N-P205-K20: 0-0-240 lbs./acre annually and provide receipt. Contractor shall consult with and receive approval from the WWTP Chief Operator before any application of fertilizer or pesticides. Contractor is responsible for any licenses, certifications required for any such practices.
e. Contractor shall communicate with the WWTP Chief Operator on hay operations throughout each year.
f. Contractor will incorporate best management practices in the cutting, raking, baling, and removal of the hay crop.
