Leaves of Absences Without Pay. Employees covered by this Agreement may be allowed to be absent from duty without pay for a period not exceeding a total of nine (9) months in any fourteen (14) consecutive months on the basis of applications for leave without pay approved by their respective appointing authorities.

Childbearing and Adoption Leave Unpaid childbearing or adoption leave shall be granted to an employee for a period not to exceed six (6) months exclusive of any period of disability covered in the Sick Leave Article. Employees shall have the opportunity of using accumulated compensatory time and annual leave during said period. Employees shall be allowed to retain insurance benefits during such leave. Except during any period covered by the use of compensatory time or annual leave, retention of insurance benefits shall be at the employee's expense. Employees are encouraged to consult with their agency/department Personnel Officer to determine if they are eligible for benefits available under the State or federal family and medical leave act. Employees may request up to an additional three (3) months extension for medical reasons provided they request this extension at least two (2) weeks prior to the date of return to work. Except in cases of unpaid sick leave, employees must submit in writing his/her intent to return to work from an unpaid leave of absence at least two (2) weeks in advance of the date of the employee's return to work.

Leaves of Absences Without Pay. 17.05 Leave of absence without pay may be granted to an employee at the discretion of the Employer if the employee has exhausted all of their vacation leave and banked time. Such leave of absence without pay may be granted to a maximum of two (2) months per fiscal year. Provided that there are no significant additional costs to the Employer, such requests shall not be unreasonably denied.

Leaves of Absences Without Pay. 1. A teacher may apply for a leave of absence without pay. Such leaves shall be for reasons including, but not limited to, education, family hardship and VISTA or Peace Corps. The applicant must make a request for such leave in writing to the District Superintendent, stating the purpose or objectives of his/her leave. The application shall be acted upon by the Board within sixty (60) days from the date of submission. The District Superintendent shall make recommendations to the Board. Final approval or disapproval of an applicant’s request for leave shall be made by the BOCES Board. In the event of a denial, the District Superintendent will provide the applicant with reasons for such denial in writing. A leave of absence shall extend to the end of the school year for which it is granted. The teacher shall notify the District Superintendent in writing on or before June 1st of that year of his or her intention to return. Failure to so notify the District Superintendent shall be considered a resignation.

In the case of an approved leave of absence, without pay of more than thirty (30) days duration, an employee shall: if the employee wishes to maintain coverage under the health benefits plans, she shall make prior arrangements for the direct payment of the full one hundred percent (100%) premiums for all benefit plans subject to the insurer’s requirements; cease to accrue sick leave, and vacation for the entire period; an employee shall have her pay increment date adjusted by the number of calendar days equal to her length of leave and such date shall prevail thereafter; an employee granted leave of absence without pay shall not be entitled to a Designated Paid Holiday with pay which may fall during the authorized leave of absence. request of an employee, when the Employer rejects an employee’s application for leave, the reasons for the rejection shall be provided to the employee in writing forthwith. Employees on leave of absence without pay from the Employer including but not limited to the following, maternity leave (except as provided in Articles A (3) and A parental leave (except as provided in Article layoff, suspension, and for more than thirty (30) days shall cease to accrue continuous employment, seniority, holiday, vacation, northern allowance, special leave, sick leave, medical travel assistance, salary increments, group benefit and pension (except where premium waivers are applicable) uniform allowance, professional registration fees and education allowances for the balance of the leave of absence.
Leaves of Absences Without Pay. Upon the recommendation of the Assistant Superintendent and the approval of the School Board, a leave of absence without pay may be granted to Teachers. A Teacher must request such leave in writing. A Teacher shall not be entitled to compensation or benefits established by this Agreement during the period of the Teacher’s leave of absence, nor will the Teacher be credited with teaching experience for the purpose of advancement on the Base-Compensation Chart. Teachers on unpaid leave of absence are subject to the provisions established by Article VIII, E (Return to Employment).

However, this period may be extended by the City Manager on the recommendation of the Department Director. Leave of absence without pay will not be granted until all vacation leave has been exhausted. Requests for leave of absence without pay shall be submitted in writing to the Department Director, stating reasons for the request, the date the leave shall begin and the probable date of return.
