Personal Leave/Carers Leave. 6.2.1 Employees are entitled to Personal/Xxxxx’s Leave in accordance with the NES and this clause.
6.2.2 Full-time Employees will accrue 10 days Personal/Xxxxx’s Leave per year of service. Part-time Employees will accrue Personal/Carer’s Leave on a pro-rata basis of the full-time entitlement.
6.2.3 Casual Employees will also be entitled to 2 day’s unpaid carer’s leave.
6.2.4 To be entitled to Personal Leave the Employee must, if the Employer so requires, produce a medical certificate or statutory declaration in support of any absence or absences due to illness or injury. Absences of more than 2 consecutive days must be supported by a medical certificate or statutory declaration.
6.2.5 Where practicable the Employee shall notify the nominated representative of the Employer of any absence prior to the commencement of the Employee’s next period of work and the Employee shall within 24 hours of the commencement of such absence, as far as practicable, state the nature of the illness or incapacity and the estimated duration of the absence.
Personal Leave/Carers Leave. Permanent Employees are entitled to personal/careers leave in accordance with the National Employment Standards contained in the Fair Work Act.
a) Personal leave is any leave taken in the circumstances of: personal illness or injury (sick leave); or to provide care or support to a member of their immediate family or household, because of a personal illness, injury or unexpected emergency affecting the member.
b) If the employee is a full time employee, the entitlement to this leave accrues on a pro-rata basis from when the employee commenced employment. Full time employees are entitled to 10 days personal leave per year.
c) If the employee is a part time employee, the entitlement to this leave accrues on a pro-rata basis from when the employee commenced employment. The yearly leave entitlement is linked to the set ordinary hours and will be calculated on a pro-rata basis. This leave can be claimed only for the days which employees would normally work.
d) Personal leave is cumulative – i.
Personal Leave/Carers Leave. 21.2.1 Employees are entitled to 10 days Personal/Carers leave per year which accrues on a pro rata basis and is cumulative. Any accrued personal leave is not paid to the Employee on termination of the employment.
Personal Leave/Carers Leave a) The Personal/Xxxxx’s leave entitlement for all Employees is 10 days per annum. For full time employees, this will be 80 hour annual entitlement based on the employee’s ordinary hours worked. If an employee works part time, the personal Leave/carer’s entitlement will be pro rata based on the employee’s ordinary hours worked.
b) Unpaid carer's leave An employee (including a casual employee) is entitled to 2 days of unpaid carer’s leave for each occasion when a member of the employee’s immediate family or household requires care or support because of a personal illness, injury, or an unexpected emergency. An employee may take unpaid carer’s leave for each occasion as a single continuous period of up to 2 days, or any separate periods to which the employee and their employer agree. An employee can’t take unpaid carer’s leave during a particular period if the employee could instead take paid sick and carer’s leave (this does not apply to casuals who have no entitlement to paid sick and carer’s leave).
c) Cashing out of personal/xxxxx’s leave:
i. Where an employee has more than 15 days of accumulated untaken personal/carer’s leave, the employee may elect in writing that an equivalent payment will be made to the employee and the employer will pay such an employee for any accumulated untaken personal/carer’s leave exceeding 15 days, up to a maximum payment as for 76 hours. The employee must be paid at least the full amount that would have been payable to the employee had the employee taken the leave that has been foregone.
ii. In order to make an election to have an equivalent payment made an employee must have sufficient leave accrued to retain a minimum balance of 15 days’ leave after the equivalent payment is made.
iii. The period of personal/carer’s leave for which the employee has been paid will not be added to the period of untaken personal/carer’s leave accrued to the employee.
iv. The employee may only make this request once in any 12 month period.
v. Each cashing out of a particular amount of paid personal/carer’s leave must be by separate agreement in writing between the employer and the employee.
vi. The Company must authorise the employee's request provided that the Company has the right to reject any request for payment, that doesn’t meet the above criteria.
d) Further details concerning personal / xxxxx’s leave are set out in the NES.
Personal Leave/Carers Leave. (1) Personal leave entitlement may be accessed for personal illness or injury, to provide care or support to a member of the Employee’s immediate family or household who requires care or support due to an illness, injury or unexpected emergency affecting that family or household member, unanticipated matters of a compassionate or pressing nature which arise without notice or planned matters where arrangements cannot be made outside of normal working hours or be met by utilising other leave, in accordance with the provisions of this clause.
(2) Paid personal/carer’s leave does not apply to casual Employees.
(3) Personal leave is not for circumstances normally met by other forms of leave.
(4) Personal Leave will be pro-rated for Part-Time Employees according to their ordinary hours of work, and for fixed or Maximum Term Employees according to the period of their contract.
(5) Employees, excluding casuals, shall be entitled to 114 hours (15 days) personal leave per year of service, pro-rated for Part-Time Employees. Personal leave shall be credited in advance as follows:
(a) On day of initial appointment: 64.6 hours
(b) On completion of 6 months continuous service: 49.4 hours
(c) On the completion of 12 months service, and on completion of each further period of 12 months continuous service: 114 hours
(6) Personal leave will not be debited for public holidays, which the Employee would have observed.
(7) Personal leave may be taken on an hourly basis provided the Employee complies with any notice and evidence requirements.
(8) Where Employees have exhausted their accrual of paid personal leave, they are entitled to two days unpaid carer's leave on each applicable occasion in accordance with the Fair Work Act 2009 (Cth).
Personal Leave/Carers Leave. (Personal leave to care for an immediate family or household member) and PARENTAL LEAVE
Personal Leave/Carers Leave. 27.1 Personal leave is provided for in the NES. It does not apply to casual employees.
27.2 Permanent employees are entitled to paid personal leave, at the employee’s ordinary rate of pay, which includes xxxxx's leave, for the employee’s ordinary hours of work during that period.
27.3 Personal leave may be taken when employees suffer a personal injury or illness.
27.4 Xxxxx's leave may be taken to provide care or support when a member of an employee's immediate family or household suffers a personal injury or illness.
27.5 For each year of service, a Full-time employee is entitled to 10 days of paid personal leave. An employee’s entitlement to paid personal leave will accrue progressively during a year of service.
27.6 Employees may be required to provide a fitness for duty clearance prior to their return to work through their own medical practitioner or by request through a Company nominated medical practitioner.
27.7 Employees may take up to two days' unpaid as provided for in the NES.
27.8 An employee will be required to comply with the Company Polices relating to personal leave as set out in the Company’s Employee Handbook.
Personal Leave/Carers Leave. 28.1 Except as otherwise provided (below), the provisions relating to personal/ carer’s leave and how and when it is to be taken will be in accordance with the NES. Entitlements shall be allocated to employees each month at 5.833 hours per month and pro rata on a monthly basis for employees in their first year of employment.
28.2 An employee shall receive up to 35 hours personal/ carer’s leave credits for their first completed year of service on a pro rata basis calculated from commencement date to the 30 June next occurring (or a pro rata amount) depending on the starting date. As of 1 July
28.3 The pro rata credits will apply to the nearest two hours.
28.4 Where an employee terminates employment with the Company for any reason, their personal/ carer’s leave credit in respect of their final year of service shall be applied on a pro rata basis up to the date of termination.
28.5 Out of this entitlement an employee who is absent from work on account of personal illness or injury or approved carer’s leave shall have their entitlement reduced by the number of ordinary or rostered hours absent and shall be paid for such hours at the rate of ordinary time for such absence subject to the following conditions:
(a) The employee shall not be eligible for such payment for any period in respect of which there is an entitlement to Work Cover.
(b) The employee shall prove to the satisfaction of the company that they were unable on account of such illness or injury to attend for duty on the day or days for which such payment is claimed.
28.6 A doctor's certificate is preferred to verify all absences. However, it is accepted that not all single day absences require a visit to the doctor. For two or more days off through illness or injury, a doctor's certificate must be produced.
28.7 The employee shall personally advise the company, insofar as it is practicable:
(a) Prior to the commencement of their absence, of their inability to attend for duty, stating as far as practicable the nature of their illness or injury and the estimated duration of their absence;
(b) Prior to their recommencement after such absence, at least 16hrs before their normal starting time, of the employee's intention to report for duty; and
(c) If advice or notification is not received by the company in accordance with either of these requirements above, the employee shall prove to the satisfaction of the company that they were unable to advise or arrange for the company to be so advised.
28.8 Such p...
Personal Leave/Carers Leave. 43.1. Employees (other than casuals) shall be entitled to personal/carer’s leave in accordance with the FW Act. The entitlement to paid personal/carer’s leave is equivalent to 10 days paid leave for each twelve months of continuous service for working an average of 38 hours per week over a 52-week period.
43.2. Entitlement to carers leave under this clause is in respect of a member of the Employee’s family or household as defined by the FW Act. An immediate family member is a:
(a) Spouse or former spouse, de facto or former de facto partner, child, parent, grandparent, grandchild, siblings; or
(b) child, parent, grandparent, grandchild or sibling of the Employee’s spouse or de facto partner (or former spouse or defacto partner
43.3. This definition also includes step-relations (e.g. step-parents and step-children) as well as adoptive relations.
43.4. An Employee will be granted personal leave up to the limit of his/her accrued entitlement if he/she is absent from work due to personal illness or injury (other than injury covered by Worker's Compensation), or he/she is required to care for an ill or injured family member, subjectto:
(a) The Employee notifying the Company as soon as possible of the commencement of personal leave; and
(b) Providing to the Company’s satisfaction that the personal leave is/was justified; and
(c) Providing a Doctor's certificate for any multiple day absences, or single day absence in excess of two single day absences per year or a statutory declaration, where the Company accepts it as appropriate.
43.5. Personal leave is paid at the ordinary wage rate.
43.6. For the purpose of clarity an Employee’s anniversary date is the date of commencement of employment.
Personal Leave/Carers Leave. 45.1 Employees (other than casuals) shall be entitled to personal/carer’s leave in accordance with NES. The entitlement to personal/carer’s leave is equivalent to 10 days leave for each twelve months of continuous service for working an average of 38 hours per week over a 52-week period.
45.2 In the case of other Employees (excluding casuals), a pro rata amount of personal/carer’s leave will accrue in accordance with NES. Personal/xxxxx's leave includes sick leave for the Employee when ill or injured and leave for the Employee to provide care or support to a member of the Employee's immediate family who is sick or injured or who has an unexpected emergency as defined in the FW Act.
45.3 Entitlement to carers leave under this clause is in respect of a member of the Employee’s family or household as defined by the FW Act.
45.4 An Employee will be granted sick leave up to the limit of his/her accrued entitlement if he/she is absent from work due to personal illness or injury (other than injury covered by Xxxxxx's Compensation), or he/she is required to care for an ill or injured family member, subject to:
45.4.1 The Employee notifying the Company within 24 hours of the commencement of sick leave; and
45.4.2 Providing to the Company's satisfaction that the sick leave is/was justified; and
45.4.3 Providing a Doctor's certificate for any multiple day absence, or single day absences in excess of two single day absences per year or a statutory declaration, where the Company accepts it as appropriate.
45.5 Sick leave is paid at the Employee’s ordinary time Wage Rate.
