Responsibilities of the Facility. (a) Facility shall provide the facilities, equipment, and support personnel reasonably necessary for the conduct of the Program.
(b) Facility’s personnel shall provide direction of Students in the provision of direct patient care and other clinical activities. Facility shall remain ultimately responsible for the overall care of its patients and Facility personnel shall make all decisions regarding patient care. In the event of a difference of opinion concerning the care of a patient, the decision of Facility personnel shall control.
(c) Facility shall not substitute Students or Faculty Members for paid Facility staff for any purpose, function or task while Students or Faculty Members are participating in the
(d) Any personnel of Facility who are providing any instruction during the Program shall possess appropriate academic credentials and/or be appropriately certified, licensed or registered as required by law or regulation for their profession.
(e) Facility shall maintain the confidentiality of all Student records produced by it or furnished to it by School and shall not disclose information except as required by law or as required to perform its obligations to its residents or as School may request for its own use or as a Student may direct.
(f) Facility shall notify School promptly of any situation or problem, which threatens a Student’s successful completion of the Program, or of any inappropriate behavior or misconduct on the part of any Student or Faculty Member.
(g) Facility reserves the right to remove, in its sole discretion, any Student or Faculty Member from the Program at any time who does not meet Facility’s professional or other standards or who does not comply with any Facility policies or procedures or those of any authority directing Facility, upon notice to and consultation with School; provided, that Facility shall be entitled to remove any such Student or Faculty Member from its facilities immediately
(h) Facility shall ensure that its facilities and the operation thereof are in compliance with all applicable medical, state and local laws, rules, regulations and standards.
(i) Facility shall provide a copy of its current rules, regulations, policies or procedures pertaining to the Program to Students and Faculty Members. Facility may provide an

Responsibilities of the Facility. 5.1. The Facility shall comply with and maintain at all times during the term of this Agreement the Eligibility Standards as set out in Schedule A attached hereto and applicable sections of the Regulations at all times.
5.2. The Facility shall comply with and maintain at all times during the term of this Agreement the Assessment Standards as set out in Schedule B attached hereto.
5.3. All vehicles used by the Facility for the conduct of training and assessments under this Agreement must be mechanically safe and meet all applicable safety standards. The Facility must maintain records of inspection and repair of these vehicles in a form acceptable to ICBC.
5.4. The Facility will ensure that Class 1 and 6/8 Trainees have received written approval from ICBC prior to commencement of training.
5.5. The Facility shall maintain records as required under the terms of this Agreement.
5.6. The Facility shall submit reports on a regular basis at such times as required by ICBC, on the forms prescribed by ICBC.
5.7. The Facility shall maintain a registered office in British Columbia where all communications and notices may be served and all records required under this Agreement shall be kept.
5.8. The Facility shall notify ICBC within 10 days if the address, telephone number or fax number of the Facility or of its registered office changes.
5.9. The Facility shall not state or imply that issuance of a Driver Training Instructor’s licence is guaranteed upon completion of the Facility’s training and Assessment program or upon Certification by the Facility.
5.10. The Facility shall not advertise, state or imply that the Facility or employees are recommended or endorsed by ICBC or the government, except that the words “instructor training course approved by ICBC” may be used.
5.11. The Facility shall not advertise in any driver licensing office or other ICBC office, or office of any Service BC centre or ICBC-appointed agent.
5.12. The Facility shall not advertise or cause to issue any advertising that does not contain the name of the Facility.
5.13. The Facility shall provide written notice to each Trainee that:
5.13.1. Certification does not guarantee that ICBC will issue a Driver Training Instructor’s licence;
5.13.2. ICBC may require a Certified Trainee to be re-examined by ICBC;
5.13.3. ICBC will have access to the Trainee’s training and Assessment records.

Responsibilities of the Facility. Facility is prohibited from requesting or requiring student interns participating in training experiences to enter into separate agreements of any kind with Facility. Student interns participating in paid training experiences shall be considered W2 employees of the Facility, entitled to all of the protections of the Facility’s other employees, and shall be covered under the Facility’s Workers’ Compensation and Liability Insurance, as set forth in Section C.15, below. The Facility will compensate the students for time spent performing work for the Facility at an hourly rate in compliance with applicable wage and hour laws. The Facility shall indemnify and hold the University harmless from any tax liabilities related to Facility’s payment to paid student interns. Each Party agrees that the student interns will be participating in a learning situation and that the primary purpose of the placement is for the student interns’ learning. It is further understood that the student interns shall perform duties as part of their training under the direct supervision of the Facility. As stated in B.5, above, the Facility retains the right to terminate a student intern participating in a paid internship at any time, with or without cause, consistent with applicable law. The Facility will make reasonable efforts to notify the University in advance of such removal. The Facility agrees to provide to University a current list, upon request, of the names and professional academic credentials of the staff members participating in the student interns' educational internship program at the Facility. Responsibilities of the Facility a. The Facility, when possible, will provide clinical experience situations as prescribed by the Educational Institution’s objectives. The Educational Institution at the beginning of the clinical rotation will provide these objectives to the Facility.
b. The Facility shall retain the sole discretion to remove from and deny access to its facility to any student or faculty member. Such action shall be reported to the Educational Institution’s program director.
c. The Facility shall designate a Facility employee to serve as its coordinator (the “Facility Coordinator”) for the Clinical Rotations and to work directly with the Educational Institution to plan and coordinate the Clinical Rotations.
d. The Facility shall provide the Faculty with access to copies of the Facility’s policies, rules, regulations and procedures that are applicable to Students’ and Faculty’s’ participation in the Clinical Rotations.
e. The Facility shall provide an orientation to the Faculty prior to the start of clinical that includes a tour of the Facility and addresses any facilities or procedures of a particular Facility department pertinent to the Clinical Rotations.
f. The Facility shall permit Students and Faculty to assist in the provision of direct patient care services to Facility patients, but the Facility may restrict their activities, including any patient care activities, at the Facility. The Facility retains the sole responsibility for patient treatment at all times.
g. The Facility shall permit the Educational Institution and its accreditation agencies to visit, tour and inspect the Facility’s facilities and records relating to the Clinical Rotations on reasonable notice during the Facility administration’s regular business hours, subject to requirements of patient confidentiality, legal compliance requirements of the Facility, and minimizing disruption or interference with Facility operations, including patient care activities.
h. The Facility shall make its classrooms, conference rooms and library facilities available to the Educational Institution for the Clinical Rotations, without charge, subject to availability and Facility policies regarding use of its facilities.
i. The Facility shall make available emergency care and treatment to Students and Faculty, as necessary, subject to its usual charges. Persons receiving care are responsible for payment of the care.

Responsibilities of the Facility. A. The Facility will have ultimate responsibility for patient care at The Facility and will comply with any state, federal governmental or administrative laws, rules, regulations and statutes governing the practice of physical therapy.
B. The Facility will provide qualified staff, patients, physical facilities, clinical equipment and materials in accordance with clinical education objectives as agreed upon by The Facility and the University.
C. The Facility will provide each assigned student with a planned, supervised program of clinical education in accordance with the clinical education objectives. (See the MSJ Physical Therapy Clinical Educator’s Handbook.)
D. The Facility will provide each assigned student with an orientation to The Facility, including a copy of pertinent rules and regulations of The Facility on the first day of the full-time clinical.
E. The Facility will designate one person to serve as center coordinator of clinical education (CCCE) for The Facility and to act as liaison with the University. CCCE:________________________________________________
F. The Facility will evaluate the performance of the assigned student(s) in writing, using forms provided or approved by the University. Evaluation materials will be forwarded or delivered to the University within one week of the conclusion of the clinical education assignment at The Facility.
G. The Facility will advise the University immediately of any changes in its operation, policies, or personnel which may affect clinical education.
H. The Facility will advise the University immediately of any serious deficiency noted in an assigned student’s performance. It will then be the mutual responsibilities of the student, The Facility and the University to devise a plan by which the student may be assisted towards achieving the stated objectives of the clinical education assignment.
I. The Facility reserves the right to request, in writing, that the University withdraw from a clinical education assignment if upon mutual agreement, the University and The Facility both believe that it is not in either party’s interest to continue the clinical education assignment.
J. The Facility will provide the University with information regarding the availability of first aid and emergency care for students while on clinical education assignment on the property of The Facility. Responsibilities of the Facility. The Facility will allow the Schools and College to place students for required clinical or fieldwork experience, with the number of students accepted during a specific timeframe being at the discretion of the Facility; The Facility will designate a representative(s) of the Facility to coordinate practicum placements with the appropriate School or College through the designated representative; The Facility will provide physical facilities and equipment; The Facility will ensure that students at all times be under the appropriate supervision of a designated preceptor and/or a staff member of the Facility on the following bases: In the event that the Facility will have more than one preceptor working with the student during the course of the placement the Facility shall appoint one of those preceptors as the responsible preceptor for the purposes of section 3.6. The Preceptor will meet the following criteria: Be registered and hold the appropriate certification and will have worked a minimum of one year in their profession. Those who supervise a X.X.Xx. student are required to be registered and hold the appropriate certification. The parties may, by way of written mutual agreement, add special terms and conditions from time to time related to preceptorship for Faculty of Health Professions students. 5.4. The Facility must view the photo driver’s licence of each Trainee on the first day of the course, to confirm their identity.
5.5. The Facility shall maintain records at such times as required by ICBC, on the forms prescribed by ICBC.

5.11. The Facility’s application for approval of each Assessment Officer or Signing Authority must include the sample signatures of each proposed Assessment Officer or Signing Authority.
5.12. The Facility shall comply with all applicable laws, statutes and regulations, including, without limiting the generality of the foregoing, those of the Government of Canada, the Province of British Columbia and by-laws of any city, municipality, town, village or regional district in which the Facility operates.

Responsibilities of the Facility. 7.1 The Facility will provide a jointly planned, supervised program of clinical education and experience for the assigned students of the College's programs.
7.2 The Facility and the Respective Department ("Facility / Department") shall designate a specific employee, by name, who meets credentialing requirements of the program, to act as a Clinical Coordinator between the Facility / Department and the College for the clinical education program. The Facility / Department shall also provide the College with the name of the Medical Director.
7.3 The Facility / Department will, notify the College of any change in Clinical Coordinator or Medical Director as appropriate.
7.4 The Facility will provide clinical conference space during clinical education periods.
7.5 The Facility will allow student and faculty use of parking and dining facilities at students and faculty's expense during clinical education periods, if such facilities exist.
7.6 The Facility will encourage cooperation between staff personnel and faculty in providing on-the-job supervision, teaching and student evaluation.
7.7 The Facility will make no adjustments in curriculum or clinical assignments based on the gender of the students. Facility will honor a patient’s refusal to participate in the clinical education program or a patient’s request for a change in caregiver assignment.
7.8 The Facility will refrain from dismissing students from assigned areas without consent of the College's program director or the responsible faculty member.
7.9 The Facility may request that the College remove any student from duty whose conduct or clinical performance may have a detrimental effect on its staff or patients.
7.10 The Facility may provide dressing room with lockers if facilities are available.
7.11 The Facility may provide uniforms that are required of its employees that are outside the context of students' uniforms. (e.g. uniforms such as surgical scrub or isolation garb.)
7.12 The Facility / Department will, on request of the College, provide an evaluation report on each student's performance to the College on forms provided by the College.
7.13 The Facility / Department will, on reasonable request, permit the inspection of the clinical facilities and services available for clinical experiences, records and such other items pertaining to the clinical education program by the College.
