ARTICLE VACATIONS. An employee shall receive by May vacation pay equal to four (4%) percent of the previous year's earnings, except that an (5) years or more service as of May 1st in any year shall receive vacation pay equal to six (6%) percent of the previous year's earnings. Furthermore, an employee shall be granted up to three (3) weeks off without pay for vacation purposes in accordance with the Full-time vacation entitlement schedule. An employee with five (5) years or more of service as of May of any year shall be entitled to three (3) weeks of vacation time off without pay. The store will, by March 1st in each calendar year, post a vacation schedule form listing the employees in order of seniority. Each store will, by January in each calendar year, post a vacation schedule form listing the employees in order of seniority. An employee wishing to take vacation must submit his request for preference on vacation dates, covering his complete vacation, by April in order that the store may finalize and post vacation schedules by April 15th; however, seniority shall not apply if the employee fails to make his selection by April 1st. In scheduling such vacations the endeavour to allow employees to exercise their choice in accordance with their Employees will be scheduled upon request to have the Saturday immediately prior to their vacation as their day off for that week, but will be limited to a maximum for those who qualify, of three (3) such Saturdays in a calendar year, and such scheduling shall not result, where practicable, in a reduction of an employee's minimum hours. Prior to going on vacation, an employee will be advised of his first scheduled shift upon completion of his vacation. If a statutory holiday falls during an employee's vacation, he shall not be scheduled to work on the Monday following the vacation if so requested. Upon request, part-time employees, absent from work on May due to illness, non-work related accident, or leave of be paid vacation pay owing within two (2) weeks following their return to work after May ARTICLE BUSINESS REPRESENTATIVE As in Article of the main body of the Collective Agreement.
ARTICLE VACATIONS. Every Employee shall be entitled to vacation with pay between January and December of each year, as set forth in Schedule annexed hereto and forming part of this Agreement. Where an employee is hired after January in a calendar year, vacation entitlement shall be granted in that year on a prorated basis from the date of hire. An Employee shall not be entitled to time off for vacation until after the expiration of six (6) months from the date of the commencement of the Employee’s employment with the Employer unless otherwise authorized by the Employer. An Employee shall be entitled to increased vacation in accordance with Schedule in the year in which the anniversary of the Employee occurs on a prorated basis. Employees shall make application for vacation leave prior to the first day of March each year and such requests shall be granted on the basis of seniority subject to the operational requirements of the Police Service. Subject to the other provisions of this Article, each Employee shall be given the opportunity to have an equitable share of the vacation leave during the period May to October of each calendar year. An Employee shall be entitled to carry one year’s vacation entitlement or any portion thereof over to the following year. In the event, an Employee accumulates vacation credits in excess of one year’s vacation credits, then the Employee shall be required to reduce the accumulated vacation credits to a maximum of one year’s vacation credits by December of that year. When, in any year, for any reason other than retirement, an Employee leaves the Police Service prior to receiving annual vacation in that year, the Employee shall be given the proportionate amount of vacation or pay in lieu thereof, for that year, plus any vacation pay in lieu thereof carried over from previous before the Employee’s name is removed from the payroll or before the Employee’s resignation becomes effective, as the case may be. Where the Employee leaves the Police Service, for any reason other than retirement, having taken the complete vacation for that year or otherwise leaving a deficit in vacation entitlement, the amount of such deficit shall be deducted any monies owing to the Employee.
ARTICLE VACATIONS. In assignment of vacations, January of each year shall be considered as the qualifying date for annual vacation purposes, after which date annual credits commence for vacation purposes, Separate departmental lists based on seniority shall be prepared, completed and posted by the Company no later than April of each year. It is understood and agreed that the number of employees away on vacation from any classification may be limited to a ratio of one in four (1 except that the Company may further limit the number in order to comply with customer requirements. An employee entitled to annual vacation during the calendar year shall take such vacation as scheduled during that calendar year unless prevented by sickness or a bona fide reason. It is also understood and agreed that employees will notify the Company in writing of their choice of vacation dates, a minimum of sixty (60) days prior to such chosen vacation date. Any employee dismissed for cause or an employee who leaves the service of the Company at a time when an unused portion of vacation with pay stands to his credit, shall be paid such vacation wages as are due as follows: Where the employment of an employee ceases before the completion of a twelve (12) month period, the Company shall pay the employee an amount equivalent to four percent (4%) of the total wages of the employee, earned in the twelve (12) month period or part thereof or any other vacation pay due him as outlined in Article in respect of which no vacation pay has been given. If the employee is entitled to two (2) weeks’ vacation with pay, he shall receive four percent (4%); If the employee is entitled to receive three (3) weeks’ vacation with pay, he shall receive six percent (6%); In the event of illness, injury and/or leave of absence in excess of thirty (30) days, the above formulas will be utilized to determine holiday pay. New employees will qualify for ten 0) working days vacation with pay upon completion of twelve (12) months continuous service, with vacation pay of four percent (4%) of gross wages calculated from the date of last vacation. Vacations shall be at a time convenient to the Company, and not more than ten months from the date of qualification. Any employee having five (5) years of continuous service with the Company shall be entitled to three (3) weeks vacation with pay of six percent (6%) of gross wages calculated from the date of last vacation. ARTICLE VACATIONS. For the purpose of calculating eligibility, the vacation year shall be the period from July 1st of any year to June 30th of the following year. The periods at which employees shall take vacation shall be based on the selection by the employee according to seniority in each department, but shall be finally determined by the Administrator having due concern for the proper operation of the Nursing Home. Vacation time will be allotted between the months of May and September inclusive, if possible, unless some other time is mutually arranged between the individual employee and the Employer. Vacations are not cumulative from year to year and all vacations must be taken by May following the cut off date. Employees shall not waive vacation and draw double pay. Employees who have not completed their probationary period as of June 30th will receive four percent (4%) of their gross earnings during the vacation year. Employees who have completed their probationary period as at the vacation cut off date will be granted one (1) day's vacation leave for each month of service to a maximum of ten days. Vacation pay for such employees will be four percent (4%) of gross earnings during the vacation year. Employees with one (1) year of service on or before June 30th of the current year shall receive two (2) weeks vacation. Vacation pay for such employees will be four percent (4%) of gross earnings for the vacation year. Employees with three (3) years of service on or before June 30th of the current year shall receive three (3) weeks vacation. Vacation pay for such employees will be six percent (6%) of gross earnings for the vacation year. Employees with eight (8) years of service on or before June 30th of the current year shall receive four (4) weeks vacation. Employees with fifteen (15) years of service on or before June 30th of the current year shall receive five (5) weeks vacation. If an employee transfers from permanent part-time or part-time to full-time or vice versa, following method shall be used to calculate his vacation service date: hours worked equals one (1)year of service. The Employer shall endeavor to have the employees alternate shifts on Christmas and New Years every other year. Employees working the night shift shall alternate on Christmas Eve and News Years Eve. This may constitute working consecutive weekends during this period.
