Such ten percent (10%) will be rounded up to the next number if there is a majority fraction (i.e. = one employee off; = two employees off). Employees shall have the opportunity to select their preferred vacation in order of seniority within their classification subject to the maximum. Once an employee is scheduledin this manner, and later request a change, must accept then available time without regard to seniority.

ARTICLE VACATIONS. For the purpose of calculating eligibility, the vacation year shall be the period from July of any year to June 30th of the following year. Requests for the summer vacation period must be submitted in writing by March and the resulting summer vacation schedule will be posted in the nursing home by May Requests received after March will be considered on a first come first serve basis. The periods at which employees shall take vacation shall be based on the selection by the employee according to seniority in each department, but shall be finally determined by the Administrator having due concern for the proper operation of the nursing home. Vacation time will be allotted between the months of May and September inclusive, if possible, unless some other time is mutually arranged between the individual employee and the Employer. Vacations are not cumulative from year to year and all vacations must be taken by May following the cut off date. Employees shall not waive vacation and draw double pay. Employees who have not completed their probationary period as of June 30th will receive four percent (4%) of their gross earnings during the vacation year. Employees who have completed their probationary period as at the vacation cut off date will be granted one (1) day’s vacation leave for each month of service to a maximum of ten (10) days. Vacation pay for such employees will be four percent (4%) of gross earnings during the vacation year. Employees with one (1) year of service on or before June 30th of the current year shall receive two (2) weeks’ vacation. Vacation pay for such employees will be at their current rate. ARTICLE VACATIONS. Every Employee shall be entitled to vacation with pay between January and December of each year, as set forth in Schedule annexed hereto and forming part of this Agreement. Where an employee is hired after January in a calendar year, vacation entitlement shall be granted in that year on a prorated basis from the date of hire. An Employee shall not be entitled to time off for vacation until after the expiration of six (6) months from the date of the commencement of the Employee’s employment with the Employer unless otherwise authorized by the Employer. An Employee shall be entitled to increased vacation in accordance with Schedule in the year in which the anniversary of the Employee occurs on a prorated basis. Employees shall make application for vacation leave prior to the first day of March each year and such requests shall be granted on the basis of seniority subject to the operational requirements of the Police Service. Subject to the other provisions of this Article, each Employee shall be given the opportunity to have an equitable share of the vacation leave during the period May to October of each calendar year. An Employee shall be entitled to carry one year’s vacation entitlement or any portion thereof over to the following year. In the event, an Employee accumulates vacation credits in excess of one year’s vacation credits, then the Employee shall be required to reduce the accumulated vacation credits to a maximum of one year’s vacation credits by December of that year. When, in any year, for any reason other than retirement, an Employee leaves the Police Service prior to receiving annual vacation in that year, the Employee shall be given the proportionate amount of vacation or pay in lieu thereof, for that year, plus any vacation pay in lieu thereof carried over from previous before the Employee’s name is removed from the payroll or before the Employee’s resignation becomes effective, as the case may be. Where the Employee leaves the Police Service, for any reason other than retirement, having taken the complete vacation for that year or otherwise leaving a deficit in vacation entitlement, the amount of such deficit shall be deducted any monies owing to the Employee.
