The Council will help people solve their problems peacefully but we will take action quickly when this fails and in cases of harassment or victimisation. 4.1 You are responsible for the behaviour of every person (including children) living in or visiting your home. Examples of harassment include , but are not limited to: • racist behaviour or language; using or threatening to use violence; using abusive or insulting words or behaviour; damaging or threatening to damage another person’s home or possessions; writing threatening, abusive or insulting graffiti; doing anything that interferes with the peace, comfort or convenience of others. 4.4 You (or anyone living with you, or visiting your home) must not threaten, abuse or in any other way distress any Member, Officer or official agent of the Council. 4.5 You (or anyone living with you, or visiting your home) must not make false or malicious complaints about the behaviour of any other person. 4.6 You (or anyone living with you, or visiting your home) must not use your home or any communal area for any illegal activity such as selling drugs. 4.7 You (or anyone living with you, or visiting your home) must not damage, deface or put graffiti on Council property. You will have to pay for any repair or replacement. The costs may be charged on top of your rent. 4.8 You (or anyone living with you, or visiting your home) must not interfere with security and safety equipment in communal blocks—doors should not be jammed open and strangers should not be let in without identification. Community Responsibilities. 1.1.1. Community shall provide licensed physician(s), physician assistant(s) and/or nurse practitioner(s) for the School Health and Wellness Center(s) (“Center(s)”) for a mutually agreed upon number of hours per week. Community shall also provide for occupational health services, health coaching services, medical assistant(s), and other support staff members for the efficient operation of the Center(s). School acknowledges and agrees that the licensed physician(s), physician assistant(s), nurse practitioner(s), medical assistant(s) and other support staff member(s) assigned by Community to provide services at the Center(s) are Community employees and are not employees of School and, therefore, Community shall provide performance standards, oversight of work performed, and application of Community policies and procedures when dealing with the employment relationships, including handling performance issues, disciplinary actions, termination of employment, and other employment related issues for employees assigned by Community to provide services at the Center(s). After a licensed physician, physician assistant, nurse practitioner, medicalassistant and other support staff member begins work at the Center(s), School shall notify Community of any performance issues related to a physician, physician assistant, nurse practitioner, medical assistant and other support staff member and shall allow Community to address such issues according to Community's policies and procedures. In the event that School objects to any staff assignment or decision by Community pertaining to the health care services, School shall inform Community in writing and the parties shall work together in good faith to address and resolve any such concerns. 1.1.2. Community shall provide suitable office location(s) for the purpose of providing certain healthcare services at the Center(s) in the location and on terms as mutually agreed upon. 1.1.3. Community shall hire and employ nursing personnel (RNs, LPNs and/or MAs, at Community’s sole discretion) to staff School’s School Nursing program (the “School Nurse(s)”) based upon assessment of schools and health needs in each school. Community will provide at least one RN or LPN personnel in each school building. Community will provide at least two (2) permanent nurse substitutes. Community shall maintain a log of the School Nurse(s) assigned to School and will update same on a periodic basis. The School Nurse(s) shall be deployed within School and be employed as a Community employee. Community Responsibilities. The Community Sports Medicine Program shall provide and include the following medical staffing and services in support of the School’s athletic programs: 3.1.1. Two (2) full time certified/licensed athletic trainers (“trainers”) dedicated to each high school and its student-athletes; two (2) full-time certified/licensed athletic trainers for sharing among the two middle schools. Community shall fully fund these six (6) full time certified/licensed athletic trainers (“trainers”). 3.1.2. An additional two (2) full time certified/licensed athletic trainers for sharing at the two middle schools. School will reimburse Community for the cost of these two additional athletic trainers to include salaries and benefits. Community shall invoice School on a quarterly basis. 3.1.3. One (1) full time Strength and Conditioning Specialist will be assigned to and present at each of the high schools. 3.1.4. Coverage of events shall include all home and away football games and practices, all home games and practices of other IHSAA sanctioned sports sponsored by School including Lacrosse and Cheerleading as able, and all home IHSAA tournaments. Notwithstanding the employer, all certified/licensed athletic trainers and other personnel (strength and conditioning coach) shall follow applicable statutes, regulations, rules, Community policies, procedures, administrative and electronic medical record (“EMR”) documentation and guidelines, including compliance with the non-dispensation of over-the-counter medications to student athletes. 3.1.5. In the event PRN athletic trainer services are desired by School, Community will endeavor to provide them based upon availability at a fair market hourly rate on a case-by-case basis as requested by School throughout the calendar year. And Community and School shall work in good faith to mutually agree upon scheduled PRN services. Community will invoice and School shall reimburse Community for the full cost of such PRN athletic trainer services as provided and billed by Community. 3.1.6. A team physician will be present at each of the two (2) high school home and away football games. Weekly injury checks will be provided during football season to those athletes and other student athletes as agreed to by the team physicians and athletic trainers. 3.1.7.
