LEAVES OF ABSENCE - UNPAID. A. Leaves of absence without pay or benefits not to exceed one (1) year or the length of the employee’s seniority, whichever is less, without loss of seniority with accrual of seniority during the leave is available in accordance with Section B of this Article upon written request to the Superintendent.
B. Reasons for Leaves of Absence are as follows:
LEAVES OF ABSENCE - UNPAID. 128 Requests for leave must be made in writing no later than the due date for return of the teacher’s 129 contract for the following school year and will specify the duration of and the reason for the request. 130 The District may grant up to one full school year of unpaid leave per request to a teacher. Up to two 131 teachers per year may be granted this leave. 132 Requests for leave for less than a school year will be granted only if the District is able to locate a 133 suitable replacement for the term of the leave. Leaves for less than a school year, including requests 134 for short leaves of one or more days, are at the discretion of the Superintendent and may be requested 135 by the teacher as needed.
LEAVES OF ABSENCE - UNPAID. A. The unpaid leave provisions of this Agreement shall be construed consistently with the requirements of the federal Family and Medical Leave Act. All unpaid leaves required by that Act shall be cumulative with, and not in addition to, any other applicable leave, paid or unpaid, provided for in this Agreement.
B. Unpaid leaves of absence not to exceed one (1) year or the length of their seniority whichever is less may be granted without loss of seniority with accrual of seniority during the leave, upon written request to the Superintendent or his designees.
C. Leaves of absence without pay or benefits may be granted as specified below. Except as required by the Family and Medical Leave Act or except as otherwise stated below, no benefits will accrue to a secretary during an unpaid leave of absence.
LEAVES OF ABSENCE - UNPAID. SECTION A - Child Care
1. A leave of absence of up to four (4) months shall be granted for the purpose of child care upon the request of the employee to care for a newborn, newly adopted, or critically ill child. The dates of the leave will be determined by mutual agreement between the employee and the Board or its designee.
2. An additional leave of absence of up to eight (8) months may be granted upon the request of the employee to care for a newborn, newly adopted, or critically ill child. The actual length of the additional leave will be determined by the board or its designee at the time the leave is approved.
LEAVES OF ABSENCE - UNPAID. A. Upon application, a unit member who has completed five (5) years in the Newark City School District may be granted a leave of absence, without pay, for not less than one (1) semester (or the balance thereof when the purpose is for child care leave) nor for more than three (3) semesters, except that a leave shall be granted when requested for medical reasons, child care or long-term care of an immediate family member (as defined in Article 23). The reason for the leave of absence must be provided to the Board of Education at the time the leave is requested. A unit member on an unpaid leave of absence may return to service only at the beginning of a semester. Upon application, a unit member who has completed one (1) year, but fewer than five (5) years in the Newark City School District, may be granted a leave of absence, without pay, for not less than one (1) semester (or the balance thereof when the purpose is for child care leave) nor for more than three (3) semesters, except that a leave shall be granted when requested for medical reasons, child care or long-term care of an immediate family member (as defined in Article 23), with the additional requirement that the unit member shall reimburse the Board for its portion of the required cost of retirement in the event the unit member elects to purchase the retirement credit. A unit member on an unpaid leave of absence may return to service only at the beginning of a semester. Any unit member who is granted an unpaid leave of absence more than once in any five years, shall only accrue seniority during the first unpaid leave during the five years and must reimburse the Board for its portion of the required cost of retirement for the second unpaid leave in the event the unit member elects to purchase retirement credit regardless of the unit member’s length of service.
B. Except for leaves of absence requested for medical reasons, child care or long-term care of an immediate family member, no unit member shall be granted a leave hereunder if a qualified replacement cannot be employed.
C. No more than five percent (5%) of the members of the bargaining unit shall be on a leave of absence concurrently.
D. No unit member who previously has been granted a leave of absence shall be granted another leave while there is (1) or more eligible applicants for their first leave of absence. Exceptions shall be made for child care leave.

LEAVES OF ABSENCE - UNPAID. 22.1 A leave of absence of up to one school year may be granted a member of the Bargaining Unit for family obligations or personal reasons. Return from such leave shall coincide with the start of a school semester. Such leave may be extended for one (1) additional year.
22.2 For the first six (6) months, a Bargaining Unit Member on unpaid leave of absence shall be allowed to continue insurance coverage by paying the entire amount of the premiums on his/her group insurance in effect at the time of the leave. Payment shall be made to the Treasurer by the last day of each month. Failure to make payment will constitute automatic conversion to COBRA coverage. At the end of the six (6) months, coverage will automatically be converted to COBRA with payment being made directly to the COBRA department of the existing group insurance carrier at existing COBRA rate.
22.3 The term of the leave shall be scheduled, to the extent possible, to cause the least disruption to the educational program. The Bargaining Unit Member shall advise the Board of the commencement of the leave as far in advance as possible and shall state the date of termination of such leave in the application. No Bargaining Unit Member shall return to service prior to or after the expiration date of such leave without the approval of the Superintendent. The date of Board approval will be considered the first official day of leave.
22.4 Any Bargaining Unit Member who does not return to service at the stated termination date of such leave shall be deemed as having abandoned his/her contract, unless under a physician’s care, and all rights and privileges of employment shall thereupon be extinguished.
22.5 Upon return from a leave of absence, a Bargaining Unit Member will be reinstated to the exact same teaching position he/she held prior to the leave. In case of reduction in force in the position, seniority and Article 11 will be followed.
22.6 Upon the written request of a Bargaining Unit Member who has completed less than five
LEAVES OF ABSENCE - UNPAID. A leave of absence may be granted by the Board of Education to members of the bargaining unit pursuant to ORC 3319.
LEAVES OF ABSENCE - UNPAID. 1. Employees without sufficient sick leave to cover the period of disability, due to pregnancy, shall be entitled to unpaid leave for that portion of the period not covered by sick leave. All provisions and protections of the Family Medical Leave Act (FMLA) of 1993 shall be provided.
2. Since leave for illness will follow the expiration of sick pay, the Superintendent may require a physician’s statement from the member’s physician, indicating the extent of the illness, in order to determine the specific period of leave. If an individual desires to return before expiration of the leave, he/she must have a physician’s statement and the permission of the Superintendent.
3. The Board may grant a leave of absence for adoption, care of a dependent child or care for an ailing parent for up to one hundred eighty-four (184) employee contract days. Such leave may commence anytime during the first year after receiving custody of the child or prior to receiving custody if necessary to fulfill the requirements for adoption. The employee may take up to twelve (12) weeks of such leave under the provisions of FMLA.
4. Whenever possible, the employee will submit a written request at least thirty (30) calendar days prior to the anticipated starting date of the leave. If circumstances do not permit the employee to provide thirty days’ notice, the employee will give as much advance notice as possible. Additionally, unpaid leave may be granted up to two (2) semesters with the approval of the Superintendent. Leave may be terminated prior to expiration upon written request and approval of Superintendent. The employee must give thirty (30) calendar days’ notice of intent to terminate leave.
LEAVES OF ABSENCE - UNPAID. A leave of absence for up to one (1) year shall be granted by the Board of Education to members of the bargaining unit (ORC 3319.13) where illness or other disability is the reason for the request. A leave of absence for up to one (1) year may be granted by the Board of Education to members of the bargaining unit (ORC 3319.13) for educational, professional, or other purposes determined appropriate by the Board. An employee desiring such a leave shall present, in writing, a request stating clearly the reason and purpose of the leave to the Superintendent. The Superintendent shall report the request to the Board at the next regular meeting. Without the employee’s request, the Board may grant a leave of absence to a staff member because of physical or mental disability. If a leave of absence is granted in accordance with the terms and reasons above, it may be extended for a second year by written request presented to the Superintendent and with the approval of the Board. Any employee who is on leave of absence who wishes to return to his/her duties at the beginning of the following school year shall notify the Superintendent of such intention not later than March 31. Upon return from a leave of absence, a teacher shall resume the contract status and status within contract sequence held prior to such leave and will be returned to a position for which he/she is qualified. Teachers shall not advance in contract status or in contract sequence process during the term of unpaid leave of absence. Teachers using any Board approved unpaid leave of absence shall not lose seniority held prior to the leave, nor shall they gain additional seniority for the time on leave. Employees on unpaid leaves of absence may choose to continue participation in this group insurance by remitting the premiums to COBRA administration for the Board of Education.
LEAVES OF ABSENCE - UNPAID. A. Unpaid leaves of absence shall be placed in five categories for employees with regular runs:
1. Short-term absences of one (1) to four (4) days duration for convenience or personal reasons or emergency.
2. Short-term leave: Leave requested by the employee for personal reasons, for not less than five (5) days and not more than ninety (90) days.
3. Long-term leave: Leave requested by the employee for personal reasons, for more than ninety (90) days or through the end of the school year.
