10.1 The provisions relating to on-call and recall, which are prescribed in the awards, etc. listed in clause 3.2 and which are not specifically referred to in this clause, will continue to apply.
10.2 On-Call Allowances
10.2.1 Employees bound by this Enterprise Agreement, who are rostered to be on-call of a night time, will be paid an allowance for each night as follows:
(a) $25.70 from the first pay period to commence on or after 1 October 2009;
(b) $26.30 from the first pay period to commence on or after 1 October 2010;
(c) $27.00 from the first pay period to commence on or after 1 October 2011.
10.2.2 Employees bound by this Enterprise Agreement, who are rostered to be on-call during a full Saturday, Sunday or public holiday or any day that the employee would normally be rostered off duty, will be paid an allowance per day as follows:
(a) $44.95 from the first pay period to commence on or after 1 October 2009;
(b) $46.10 from the first pay period to commence on or after 1 October 2010; and
(c) $47.20 from the first pay period to commence on or after 1 October 2011.
10.3 On-Call Conditions
10.3.1 No employee should be rostered or required to be on-call more frequently than a total of 7 days every 14 days. Any arrangement that would require an employee to be on- call more frequently than this must only be introduced where the employee concerned genuinely agrees to same.
10.3.2 The frequency, duration, etc. of being on-call is to be established through consultation with the employees affected and if requested by the employees, their representatives, having particular regard to occupational, health and safety considerations.
10.3.3 Employees who are on-call must be contactable whilst on-call but will not be restricted to their residence.
10.3.4 Employees who are on-call will be provided with any equipment required for their work (except where existing award provisions or other agreed arrangements, which require employees to provide their own equipment, are in place).

28.2 On-Call Allowances
(a) Employees bound by this Enterprise Agreement, who are rostered to be on-call of a night time, will be paid an allowance for each night as follows: On-call Allowance 1 July 2017(ffpp) 1 July 2018 (ffpp) 1 July 2019 (ffpp) Monday – Friday $32.40 $33.40 $34.40

28.3 If an employee is rostered on-call:
(a) For a continuous period that spans and includes both ‘a night time’ during Monday - Friday and an immediately following (full day) public holiday; or
(b) Of ‘a night time’ during the Monday – Friday that is a ‘part-day public holiday’, the on-call allowance in sub-clause (b) will apply to the ‘night time’ (i.e. instead of the rate in sub- clause (a). For example:
1. If a public holiday falls on a Wednesday and the employee is rostered on-call for both the Tuesday night time and the full public holiday, the employee will be entitled to a public holiday on-call rate for the Tuesday ‘night time’ period.
2. If a ‘part-day public holiday’ (refer: amended Holidays Act 1910) falls on a Monday and an employee is rostered on-call for that night time, the employee will be entitled to the public holiday rate.

ON-CALL/RECALL. 23.1 On call
(a) For the purposes of this Agreement an employee is on call when the employee is directed by the Employer to remain at such a place as will enable the Employer to readily contact the employee during the hours when the employee is not otherwise on duty. In so determining the place at which the employee will remain, the Employer may require that place to be within a specified radius from the hospital or place of employment.
(b) An employee rostered to be on call will be paid the allowance prescribed in subclause 23.1(c) for each hour or part thereof the employee is on call.
(c) An employee rostered to be on call will be paid 18.75% of 1/38th of the rate prescribed for a Level 1.2 Registered Nurse and will be adjusted in line with the operative date of wage increases prescribed in Clause 24 – Classification Structure and Wages in accordance with the following table: On and from 7 October 2016 On and from 7 October 2017 $6.36 per hour $6.46 per hour
(d) The payments referred to in subclause 23.1(c) will not be made in respect to any period for which overtime is paid when the employee is recalled to work.
(e) If the usual means of contact between the Employer and the employee is a telephone and if the employee pays or contributes towards the payment of the rental of such telephone the Employer will pay the employee an amount being a proportion of the telephone rental calculated on the basis that for each seven days on which an employee is required to be on call the Employer will pay the employee 1/52nd of the annual rental paid by the employee.
(f) Provided that where the Employer and the Union agree in writing, other arrangements may be made for compensation of on call work.
(g) Where it is determined that the means of contact is to be by pager or mobile telephone the Employer will provide the employee with the device at no charge.
(h) An employee will not be required to remain on call whilst on leave or the day before commencing leave, or whilst on accrued days off, or the day before commencing accrued days off, unless by mutual agreement between the employee and Employer.
23.2 Ten hour break for employees on call
(a) Where an employee who is on call is recalled to perform overtime duty, the employee will be provided with a continuous break of not less than ten hours from when the overtime duty was completed to immediately prior to the commencement of the next ordinary rostered shift.

ON-CALL/RECALL. 6.4.1 Employees may be required to remain on-call to ensure appropriate access to staff for emergencies, not to support routine theatre lists (including routine weekend lists). Where clinically appropriate and taking into account patient and staff safety with respect to staff fatigue and WHS matters, employees on-call may request to work overtime at the end of their shift but cannot be directed to do so by the employer. However this can only occur if there are sufficient relevant specialist, experienced and competent on-call staff to ensure safe coverage for all emergencies. The employer cannot direct the employee to remain in the workplace during the period on call.
6.4.2 The employee will ensure that they are easily contactable during the hours for which they have been placed on-call and may be required to remain within an agreed access period of the workplace, as specified within a particular site or department.
6.4.3 Where an employee is required to remain on-call they will be paid an On-Call Allowance per period of 24 hours or part thereof. See Part 7.10 – Allowances.
6.4.4 Where an employee is required to remain on-call and they are not recalled to work the time spent on-call will not count as hours worked.
6.4.5 Where an employee is required to remain on-call and is recalled to work the overtime provisions will apply. Further, they will be paid for a minimum of 4 hours work at the appropriate overtime rate in addition to the On-Call Allowance. See Part 7.10 – Allowances.
6.4.6 The recall period for which the employee is paid will commence when the employee arrives at the workplace.
6.4.7 Employees will not be required to remain on-call whilst on leave (paid or unpaid) or on the day before their leave period begins.
6.4.8 The employer will endeavour not to require an employee to remain on-call on an Accrued Day Off or on the day before an Accrued Day Off. Where it is necessary to ensure continuity of service the employee shall be paid a relevant On-Call Allowance. See Part 7.10 – Allowances.
6.4.9 Where an employee is required to remain on-call during a meal break they will be paid an On-Call Allowance. See Part 7.10 – Allowances.
6.4.10 An employee recalled to work will be provided with transport to and from their home or refunded the cost of the transport.

ON-CALL/RECALL. (a) An Employee who is required by the Employer to remain On Call:
(i) Shall be paid $4.40 per hour on-call for all periods from Midnight Sunday until Midnight Friday.
(ii) Shall be paid $5.50 per hour on-call for all periods from Midnight Friday until Midnight Sunday. This rate of payment shall also apply for the 24 hour period from midnight to midnight for public holidays.
(iii) The Employer will endeavour to provide a mobile phone to facilitate on- call. All calls made from this phone other than those to the relevant hospital will be the responsibility of the holder of the phone.
(iv) If any Employee on-call is required to commence work, the Employee shall be paid double time, provided that such payment shall not be less than four (4) hours.
(v) Employees who are rostered on call are paid the on call allowance in accordance with sub-clause (a)(i) or (a)(ii) for the entire period for which they are so rostered, including any intervals in which the Employees work overtime or are recalled to work.
(vi) An Employee who is acting as the Director of Nursing for one day or more would not be paid the on call allowance as stated in sub clause (a).
ON-CALL/RECALL. 38.1 Where a clinician other than an Employee (being a Dental Therapist, Oral Health Therapist or Dental Hygienist) is rostered for duty and those duty hours are outside the ordinary hours of the Employee, then the Employer will confer with the Employee and may require the Employee to be on-call.
38.2 An Employee who is rostered to be on-call shall be paid an allowance equal to 10% of their ordinary time hourly rate in respect of each on-call period.
38.3 An on-call attendance by an Employee under this clause may be by telephone, (extending beyond 15 minutes per call), or by personal attendance to the clinician/patient.
38.4 An Employee may be recalled to duty outside their ordinary hours to attend to a serious accident or emergency at the request of the Employer.
38.5 An Employee who, pursuant to this clause, attends an on-call or who is recalled to duty shall be compensated by payment at the rate of time and a half their ordi nary time rate for the first two hours and double time thereafter or, by mutual agreement, by time off in lieu of such payment. Time off in lieu shall be taken at a mutually agreed time and shall be based on the overtime penalty rates as prescribed by Clause 25.3 of this Agreement.
ON-CALL/RECALL. This clause increases the on-call rates. It also differs in that if an employee is on-call for a specific period that spans two rates of allowance, namely both a week-night and the immediately following (full) public holiday, the public holiday rate will apply to the preceding (Monday – Friday) night period. This will also apply when an employee is rostered on-call for the ‘part-day public holiday’ that occurs on a Monday – Friday period.
ON-CALL/RECALL. 18.1 A Full Time Specialist may be required to be on-call or available to attend the campus for medical emergencies. Payment in respect of being on-call or available for recall is included in the rates set out in Schedule 1 to this Agreement.
ON-CALL/RECALL. (a) An on call allowance will be paid to an Employee who is required by an Employer to hold themselves available to be recalled to work. For each period that the Employee is required to be on call, the Employee will be paid an allowance equal to:
(i) two ordinary hours’ pay for each period of up to 24 hours which includes any part of a Saturday or Sunday; and
(ii) one ordinary hour’s pay for each other period of up to 24 hours;
(b) A School Services Officer recalled to work shall be paid for a minimum period of four hours.
(c) A School Services Officer on approved annual leave or school holidays may not be required to work or be on call during that period.
