Personal (Sick)/Carer’s Leave. Full-time Employees are entitled to ten (10) days (equivalent of up to 120 hours) of paid personal (sick/carer’s) leave per annum. Personal (sick/carer’s) leave is paid at the Employee’s All Purpose Hourly Rate. Personal (sick/carer’s) leave is deducted from the Employee’s accruals for the hours the Employee is absent up to a maximum of 12 hours per shift. Personal (sick/carer’s) leave accrues progressively on the basis of the Employee’s Ordinary Hours. Any part of an Employee’s entitlement which has not been taken in any year may be claimed in a subsequent year of continued employment. Payment for personal (sick/carer’s) leave is conditional upon the Employee: Informing the Company (wherever practicable, prior to the commencement of any such absence) of the inability to attend for work, the nature of the illness or injury and the estimated duration of the absence; and Providing the Company with evidence that would satisfy a reasonable person of the illness or injury, if required (e.g. a certificate from a registered health practitioner (other than a pharmacist) or a statutory declaration). The Employee is required to provide a medical certificate from a health practitioner (other than a pharmacist) or a statutory declaration for any absence due to illness or injury where the absence: occurs during the probationary period of employment; is of two (2) or more consecutive days or shifts duration; after the Employee has exhausted the entitlement to paid personal (sick/carer’s) leave; occurs on a public holiday, or on either a rostered day or shift immediately before or after the public holiday, or weekend; or as specifically requested by the Company. In the event that an Employee is absent from work other than on approved leave and does not produce evidence that would satisfy a reasonable person of the illness or injury as required pursuant to this clause, the Employee will be deemed to have been absent from work without authorisation and will not be paid and may be subject to disciplinary action. Unused personal (sick/carer’s) leave entitlements will not be paid out on termination of employment. Casual Employees will be entitled to unpaid personal leave in accordance with the FW Act. Should an entitlement under this provision be less favourable than the NES, the NES will prevail.
Personal (Sick)/Carer’s Leave. 8.2.1 Employees other than casual employees are entitled to paid personal/carer’s leave. A full time employee is entitled to 10 days of paid personal/xxxxx’s leave in a 12- month period (only after completion of the first 3 months). Paid personal/carer’s leave accrues on a pro-rata basis. An employee must notify their relevant supervisor as soon as is practicable of an intention to take such leave for approval.
