Personal (Sick/Carer’s) Leave. 18.4.1 Permanent full‐time employees are entitled to 10 days leave per year with an additional 2 days unpaid carer’s leave if this is exhausted. 18.4.2 The application of this leave shall be in accordance with the Act and SMNCC policies. 18.4.3 SMNCC may require an Employee to attend a medical practitioner of SMNCC choice in relation to their ongoing fitness and capacity to work, sick leave or where they have made a claim for workers compensation and/or are in receipt of workers compensation benefits. The costs of such attendance will be covered by SMNCC.

Personal (Sick/Carer’s) Leave. 20.1 Entitlement to personal leave (encompassing sick and carer’s leave) will be in accordance with Division 5 Part 7 of the Workplace Relations Act 1996., For an employee who works an average of 80 hours per fortnight, their personal leave entitlement equates to 80 hours per year. For the purpose of clarification, if an employee takes a day of sick leave whilst rostered on a 12 hour shift, their sick leave entitlement will be 12 hours, providing they have accrued a sufficient amount of leave. 20.2 Employees who have not completed 1 year’s continuous service will be entitled to take personal leave on a pro‐rata basis. Personal leave accrues after each completed 4 week period. 20.3 When personal (sick) leave is taken, a medical certificate which complies with the Standard confirming the absence was due to ill health shall be provided at the request of the Operations Superintendent. 20.4 Personal (sick) leave not taken in any one year may be accrued, but unused sick leave is not paid out on termination, except as provided for in the case of redundancy as set out in sub clause 10.3 of this agreement. 20.5 Employees are entitled to use up to 10 days per annum of your paid personal (sick) leave accrual to provide care and support for a member of their immediate family or household who requires special care and support because of: (i) a personal illness or injury of the member, (ii) an unexpected emergency affecting the member 20.6 Employees may be entitled to a further 2 days unpaid carers leave on each occasion where care is required beyond the maximum paid carers leave. Unpaid carers leave does not count as service but does not break the continuity of service. 20.7 To qualify for paid personal (carer’s) leave, employees must provide: (a) For leave to care due to personal illness or injury of the member of the immediate family or household: • a medical certificate or statutory declaration (if a medical certificate is not available) stating that there is an illness or injury and the requirement for care or support: (b) For an unexpected emergency affecting the family / household member: • a statutory declaration stating the nature of the emergency and the requirement for care or support.
Personal (Sick/Carer’s) Leave. 30.1 Full-time Employees are entitled to ten (10) days of paid personal (sick/carer’s) leave per annum. 30.2 Personal (sick/carer’s) leave is paid at the Employee’s All Purpose Hourly Rate. 30.3 Personal (sick/carer’s) leave is deducted from an Employee’s accruals for the hours the Employee is absent up to a maximum of 12 hours per shift. 30.4 Personal (sick/carer’s) leave accrues progressively on the basis of the Employee’s Ordinary Hours. 30.5 Any part of an Employee’s entitlement which has not been taken in any year may be claimed in a subsequent year of continued employment. 30.6 Payment for personal (sick/carer’s) leave is conditional upon the Employee: a) Informing the Company (wherever practicable, prior to the commencement of any such absence) of the inability to attend for work, the nature of the illness or injury and the estimated duration of the absence; and b) Providing the Company with evidence that would satisfy a reasonable person of the illness or injury, if required (e.g. a certificate from a registered health practitioner (other than a pharmacist) or a statutory declaration). 30.7 The Employee is required to provide a medical certificate from a health practitioner (other than a pharmacist) or a statutory declaration for any absence due to illness or injury where the absence: a) occurs during the probationary period of employment; b) is of two (2) or more consecutive days or shifts duration; c) after the Employee has exhausted the entitlement to paid personal (sick/carer’s) leave; d) occurs on a public holiday, or on either a rostered day or shift immediately before or after a public holiday or weekend; or e) as specifically requested by the Company. 30.8 In the event that an Employee is absent from work other than on approved leave and does not produce evidence that would satisfy a reasonable person of the illness or injury as required pursuant to this clause 30, the Employee will be deemed to have been absent from work without authorisation, will not be paid and may be subject to disciplinary action. 30.9 Unused personal (sick/carer’s) leave entitlements will not be paid out on termination of employment.

(b) Paid or unpaid leave (xxxxx’s leave) taken by an employee to provide care or support to a member of the employee’s immediate family, or a member of the employee’s household, who requires care or support because of personal illness or injury of the member, or an unexpected emergency affecting the member. 18.5 Employees are entitled to a period of up to 2 days unpaid carer’s leave for each occasion where paid personal/carer’s leave has been exhausted. This entitlement extends to casual employees. 18.6 The Company may require the employee to provide a medical certificate. If the employee is so required and does not do so, the leave to which the request relates shall not be payable.

Personal (Sick/Carer’s) Leave. 6.2.1 You shall be entitled to sick leave/carers leave of 76 hours subject to complying with the conditions of this clause and which shall accrue at the rate of 5.846 hours per 4 week period. 6.2.2 You shall provide evidence, if required by the Company, to the satisfaction of the Company, that you were unable on account of such illness or injury to yourself or a member of your family to whom you are the primary carer (such persons are to be identified at the time of employment) to attend for work on the day or days for which you claimed to be entitled to such leave of absence. Such evidence to be provided to your supervisor upon your return to work. If you are unable to obtain a medical certificate because it is impracticable to do so, a statutory declaration may be produced subject to the following: a) It must state why it was impracticable to obtain a certificate and the nature of your illness or injury b) In each case, you shall take all reasonable steps to advise the Company of your absence from duty, as near as possible to, but no later than normal commencement time. Such advice shall, as far as practicable, state the nature of the injury or illness, and the estimated duration of the absence. As a food processor, any illness including diarrhea, stomach upsets or symptoms related to gastro-enteritis will require a doctor’s clearance prior to returning to work. 6.2.3 Provided that, if it is not practicable to inform the Company by normal commencement time, you shall inform the Company as soon as practicable thereafter. If you are unable to see a Doctor you may want to ring the company again and advise the company which may be able to arrange a medical appointment for you 6.2.4 If requested by the employer, a certificate from a duly qualified health practitioner shall be produced as required. 6.2.5 If the full period of personal leave as prescribed above is not taken in any year such portion as is not taken shall be cumulative from year to year. 6.2.6 The services of an employee shall not be terminated during the currency of any period of personal leave with the object of avoiding the Company’s obligations under this sub clause. 6.2.7 Xxxx leave may be cashed out once a year in accordance with the Workplace Relations Act 1996 if requested in writing by you and only for leave over and above 20 days accrued.
Personal (Sick/Carer’s) Leave. 36.1 Permanent full-time Employees are entitled to ten (10) days accumulative leave per year. In addition, they shall be entitled to additional two (2) days paid carer’s leave each year. Proof of leave as identified in the Act may be required in certain circumstances. Carers leave is not accumulative. 36.2 Allcare Nursing Services (ANS) may require an Employee to attend a medical practitioner of the ANS’s choice in relation to their ongoing fitness and capacity to work, sick leave or where they have made a claim for workers compensation and/or are in receipt of workers compensation benefits. The costs of such attendance will be covered by ANS. 36.3 Medical evidence may be requested for personal leave in excess of two (2) days or where the Employer has a concern about the circumstances and/or extent of such leave.
Personal (Sick/Carer’s) Leave. 16.1 Personal (sick/carer’s) leave is provided for in accordance with the NES (inclusive of unpaid carer’s leave). Employees (except casual employees) are entitled up to 10 days paid personal leave per annum (accrued pro-rata for part-time employees) leave when they cannot attend for work on account of genuine illness, injury or carers leave. 16.2 Paid personal leave is calculated on the basis of nominal hours worked by the employee in the previous completed 4-week period. An employee is entitled to accrue 1/26 of the number of nominal hours worked during that 4-week period. For example, a full-time employee engaged to work for 38 hours a week, will accrue 1/26 of the number of nominal hours worked by the employee during the previous completed 4-week period (in this case 1/26 of 152 hours). After 12 months, this employee will have accrued 76 hours of paid personal leave (which is the equivalent of 10 days). 16.3 Such leave will be approved by the Company subject to: 16.3.1 Notifying the Company as soon as reasonably practicable if they will be absent, and potential duration of the absence. 16.3.2 Personal leave advice should be left as a phone message on the designated phone line. Details of the number to call and the details to be provided shall be clearly posted on noticeboards. 16.3.3 Notification that the absence is due to illness, injury or xxxxx’s leave is required in order for the leave to be paid in accordance with this clause. 16.3.4 The Company may require a medical certificate from a registered health practitioner (or statutory declaration if it is not reasonably practicable for the employee to obtain a medical certificate) for the claimed illness, injury or carer’s leave. The documentation must be produced as soon as reasonably practicable.
