All new jobs and vacancies are subject to seniority and shall be posted promptly for seven (7) days in a conspicuous place within the terminal, stating starting time and job description. All regular employees shall be entitled to bid on such and the Company shall designate, on the original posting, the successful bidder within three (3) working days of the date of the posting. Any regular employee absent by reason of accident, sickness or vacation, shall have the opportunity to bid on such job posting or vacancy within three (3) days after he returns to work, provided he is capable. Provided the employee is capable and is given the opportunity to demonstrate his capability, seniority shall prevail in the appointments to new jobs or vacancies and, except by mutual agreement of the Parties hereto, for the purpose of shift preferential on established shifts. Section Seniority. The Company agrees to recognize the seniority rights of all employees who are members of the Union. Seniority is designed to give Union members an equitable measure of security based on length of service with the Company. Seniority will be the determining factor in layoff and choice of annual summer vacation period; and will be a factor in promotions and job assignments when a vacancy occurs. Each employee will have seniority standing in the department in which they are employed. Except in the case of employees whose seniority rights have already been established an employee’s seniority will be established in accordance with Appendix “A” of this agreement. An employee does not have seniority rights until completes the Regular On Grid employee requirements as established by Appendix “A ” of this agreement and becomes a permanent employee. Once established, an employee’s seniority date will remain unchanged except as provided for herein, and the employee’s name will be placed on the department seniority list of the department within which is working. The Company agrees to compile and post departmental seniority lists of all Union employees within three (3) months after signing of the Agreement. Such lists shall be amended and quarterly. If, within one (1) month after the first posting, an employee submits proof that their seniority date should be altered and such proof is accepted by the Company and the Union, an amendment will be made accordingly. Section Seniority. Subject to circumstances or the specific provisions of this collective agreement provisions, only Union Pilots shall be authorized to fly Company aircraft. Seniority standing of any newly-hired Pilot shall be the date he is designated and paid as a Pilot, and this, at the beginning of the initial flight training period exclusive of ground training. If two (2) Pilots or more are designated as such at the same date, their seniority standing shall be determined according to their results obtained at the end of their initial training and their experience, as well as the results of their flight tests. The seniority of a Pilot shall be calculated as of his last hiring date as a Pilot. Pilots shall not accumulate seniority in the cases mentioned in sub-section A Pilot shall lose his seniority and his employment shall be terminated in the following cases: voluntary termination of employment; dismissal for cause: failure to confirm his to work within three (3) days following confirmation of receipt of a letter requiring his return to work, and to reintegrate his position within fourteen (14) days following said confirmation: absence from work for three (3) consecutive days or more, without and/or valid reason; lay-off exceeding two (2) years; and failure to conform to the conditions of sub-section Any Pilot who has completed his Probationary Period shall cease to accumulate seniority in the following cases:

In cases where time does not permit such consultation. the Management shall, wherever practical, take temporary. action only until the recommendations of the Standing Committee can be obtained. Vacancies in the department will be filled at the bottom of the line from the labour pool, and plant seniority will be the determining factor in progression from the labour pool. Should there be any question in respect to the order of progression or position in line of progression the matter will be settled to the mutual satisfaction of both Standing Committees. The principle of the plant seniority will be i n determining who will be laid off. Any extension of the above shall be by mutual agreement and limited to one month intervals during which all conditions above shall apply.
