Substance Abuse Treatment. This agreement covers medically necessary services for the treatment of substance abuse in a hospital, substance abuse treatment facility, or an acute substance abuse rehabilitation/residential facility that is: reviewed and approved by us; and licensed under the laws of the State of Rhode Island or by the state in which the facility is located as a hospital, a substance abuse treatment facility, or an acute substance abuse residential/rehabilitative facility. We review network and non-network programs, hospital or inpatient facilities, acute substance abuse rehabilitation/residential facilities and the specific services provided. We decide whether a program, hospital or inpatient facility, acute substance abuse rehabilitation/residential facility, or specific services rendered meets our program requirements, content and criteria. If our program requirements, content and criteria are not met, the services are not covered under this agreement. Our program content and criteria are defined below. If you are an acute inpatient in a general or specialty hospital for behavioral health services, we cover medically necessary acute hospital services for detoxification. See Section 3.20 - Inpatient Hospital Services for additional information. Preauthorization is recommended.

This agreement covers medically necessary services at an Acute Rehabilitation or Acute Substance Abuse Residential facility when reviewed by us and we decide that, at a minimum, the following program criterion has been met: • Certified clinical staff available twenty-four (24) hours per day, seven (7) days a week to meet the member’s medical and psychological needs. o includes a registered nurse (RN) available on site a minimum of eight (8) hours day and on call twenty-four (24) hours a day; o when on call, the RN must be able to be on site within one (1) hour of a call. • Program must be supervised by a licensed independent clinician that is in charge of the program and the staff; o Licensed independent clinicians are defined as the following: ▪ M.D. , D.O., or R.N. with advanced training and prescriptive privileges (i.e. Clinical Nurse Specialist), ▪ Ph.D. LICSW, LMHC, LMFT, or an individual with an equivalent independent practicing license in the state in which the program operates. • Program must have a licensed physicians on staff who is available twenty-four (24) hours per day, seven (7) days per week to evaluate patients and adjust medication as needed and provide medical oversight o...
Substance Abuse Treatment. Section 33.1 The City may require any employee to submit to a drug test only when it has a reasonable suspicion that the employee to be tested is under the influence of or using illegal drugs or narcotics. The term "reasonable suspicion" for the purposes of this policy shall be defined as follows:
1. Aberrant or unusual on-duty behavior of an employee.
2. Behavior which is recognized and accepted symptom(s) of intoxication or impairment caused by controlled substance except those listed in schedule V of F.S. 893.03.
3. It is not reasonably explained for resulting from causes other than the use of controlled substances. Such behavior must be observed by their immediate supervisor to a higher supervisor and the Department Head or his designee. The employee will be given an opportunity to offer such explanation to the observing supervisors prior to being ordered to take the drug test.
Section 33.2 No drug testing will be conducted without written approval of the Department Head or his designee and either the City Manager or the Personnel Human Resources Director. Said approval to indicate who is to be tested and why the test was ordered, including specific objective fact constituting reasonable suspicion and the names of any source(s) of all the information. A copy of this document shall be provided to the employee.
Section 33.3 Refusal to submit to drug testing after being ordered to do so may result in disciplinary action.
Section 33.4 The following procedures shall apply to the blood and urine tests administered to the employee.
A. The City may request urine and/or blood samples. The employee, at his sole option, shall upon request, receive a blood test in addition to the urine test.
B. The test shall be performed at a reputable hospital laboratory, certified by the State of Florida as a medical laboratory which complies with the scientific and technical guidelines for federal drug testing programs and the standards for certification of laboratories engaged in urine drug testing for federal agencies issued by the alcohol, drug abuse and mental health administration of the U.S. Department of Health and Human Services.
C. Urine and/or blood specimen(s) shall be drawn or collected at the laboratory, hospital or medical facility at which the specimen is to be tested. Substance Abuse Treatment. In support of a Drug Free Workplace program, the City prohibits at all times the possession (i.e., on the person, or in a desk or locker), consumption, use or being under the influence, sale, purchase, manufacture, distribution, dispensation, solicitation, or transfer of drugs while an employee is on the job or on City premises. The City also prohibits the use of or being under the influence of alcohol or prescription drugs that interfere with an employee’s ability to perform his/her job while on duty.
Section 33.1 The City may require any employee to submit to a drug or alcohol test when it has a reasonable suspicion that the employee to be tested is under the influence of or using illegal drugs, narcotics or alcohol. The term "reasonable suspicion" for the purposes of this policy shall be defined as follows: Direct observation of drug or alcohol use, physical symptoms or indications of being under the influence of drugs; or abnormal conduct, erratic behavior, or a report of drug or alcohol use by a credible or reliable source; employee involvement in an accident at work resulting in an injury to oneself, another person(s) or damage to property; evidence that an employee used, possessed, sold, solicited or transferred drugs or alcohol while working within city premises, vehicles, machinery, or equipment. Behavior directly observed by an immediate supervisor, the human resources director, the risk manager, a Department Head or designee or senior staff member of the City Manager’s office may result in reasonable suspicion testing. Drug testing will not be conducted for instances of minor personal injury treated with “first aid” if no medical attention is requested or needed. First aid means application of treatment for minor personal injury not sufficient to require medical attention. Examples include but are not limited to bee stings, paper cuts, poison ivy, rashes, minor scratches, sunburn, spider bites, or blisters.
Section 33.2 No drug testing will be conducted without approval of the Department Head or his/her designee, the Human Resources Director, Risk Manager or the City Manager. Substance Abuse Treatment. The State shall create or modify and implement policies, procedures, and practices to require that:
a. all youth who have a suspected history of substance abuse are provided with adequate prevention education while residing at a Facility; and
b. all youth who are known to have current problems with substance abuse or dependence are provided adequate treatment for those problems while residing at a Facility.
Substance Abuse Treatment. Winchester City has adopted the American Society of Addiction Medicine as best practices in the treatment of substance use disorders. Substance Use Services are provided to assist youth and their families with recovery from substance abuse/addiction. Treatment of the actively substance- addicted population shall incorporate a structured program that addresses the addiction and the associated developmental, family, peer and relationship issues. Treatment shall incorporate education, individual and group therapy dealing with abuse/addiction and concomitant problem areas with a strong emphasis on family therapy and the twelve step programs for the development of coping and living skills to prevent relapse. Treatment shall also incorporate the provision of continuing care or referral to appropriate facilities for continuing care services. Treatment shall be provided by an individual who holds a certification or license in substance abuse treatment or individual supervised by an approved substance abuse clinical supervisor, unless an exception is made by FAPT. Providers of Substance Abuse treatment services shall follow ASAM criteria in determining the needs of the client and level of care necessary for treatment.

Substance Abuse Treatment. A. An Employee who for the first time while employed with the Authority (1) tests positive for alcohol and/or an illegal drug(s) pursuant to Section 2, above, or (2) has his/her job performance adversely affected by substance abuse, will, in lieu of termination, be permitted to undergo an evaluation and join a recognized treatment program (if deemed appropriate by the evaluation).
B. Prior to an Employee’s treatment, the Authority and the Employee will enter into an agreement detailing the conditions of the Employee’s return to work. This agreement will be a “last chance” agreement; any further positive test will lead to termination. The Authority will cover the cost of testing and any other costs that are outlined in the agreement.
C. Periodic reports will be submitted to the Authority on the Employee’s progress. The Employee will be granted administrative leave to attend any required meetings. Failure to submit to rehabilitation testing, when required, or to complete any treatment program as prescribed may be grounds for dismissal or other disciplinary action.
D. The Authority reserves the right to require an Employee to take a leave of absence from employment, pending evaluation and treatment at any time when the Employee’s ability to perform the essential functions of his/her job appears to be affected by an illegal drug or alcohol abuse problem.
E. Nothing in this Section 3 shall relieve the Employee of disciplinary action under Article 53 if the circumstances under which the substance abuse performance deficiencies or the positive test occurred result would constitute just cause for discipline.
F. The above Subsections A through D apply only to Employees who have completed the original introductory period. Further, the provisions of Subsections A through D are expressly subject to the requirements of federal and state law, such as the Americans with Disabilities Act (ADA) and the Family and Medical Leve Act (FMLA), and shall be deemed mutually amended by the Parties to the extent necessary to comply with such laws.
Substance Abuse Treatment. PHS Medical shall assess patients during the intake examination for alcohol and drug dependency and/or symptoms of withdrawal. As appropriate, patients will be detoxified and referred to program counselors. Patients may be housed in the infirmary for close monitoring. Mental health staff shall also evaluate all inmates admitted to mental health services for the presence of substance abuse and may, as clinically appropriate, refer inmates for participation in the MICA program housed in a mental health observation unit. Appropriate patients will be considered for methadone maintenance. PHS Medical shall offer grant-funded programs to patients, including, but not limited to KEEP (methadone maintenance/opiate detoxification) and MADE (Motivating Adolescents Through Diversion and Education) .PHS Medical shall cooperate with and implement additional substance abuse programs initiated by the Department.
