Unpaid Medical Leave. A unit member who becomes medically disabled and who has exhausted his/her sick leave or who elects not to use his/her sick leave may request and shall be granted unpaid medical leave. A unit member's application for unpaid medical leave shall be accompanied by a physician's statement describing the nature of the medical disability, its expected duration, and the period of time the unit member should be relieved of his/her duties. This leave shall not exceed two (2) consecutive school years. The unit member while on leave shall have the right to pay the total premium for group life, hospitalization, and other group insurance benefits, provided payment is acceptable to the insurance carriers. All payments shall be made on or before the date established by the Board Treasurer.
Unpaid Medical Leave. 1. Upon written notice of a bargaining unit member, the Board shall grant an unpaid medical leave of absence for a period of not more than two (2) years where illness, dependent care or other disability is the reason for the request. Such leave shall be granted by the Board in up to one (1) year increments.
2. Application for such leave shall be made at least thirty (30) days in advance, when possible.
3. Application for reinstatement must be made at least thirty (30) days prior to the expiration of the leave of absence.
Unpaid Medical Leave. A. Bargaining unit members are eligible for an unpaid leave of absence for personal medical reasons.
B. Such leave shall be for a period of not more than two (2) consecutive school years.
C. In case of illness, injury or other disability, the Board shall approve such leave.
D. Application for such leave shall be made to the Superintendent no later than two
Unpaid Medical Leave. SECTION 33.1 - The Board will utilize the provisions contained in ORC 3319.13 for authorizing an unpaid medical leave of absence for bargaining unit members, either voluntarily requested by a bargaining unit member or involuntarily initiated by the Board.
Unpaid Medical Leave. The Superintendent is authorized to grant unpaid medical leave. The leave may not extend beyond eighteen (18) months and shall be without salary or District paid health care benefits except as required under FMLA/OFLA. The employee will be entitled to purchase district health insurance coverage for the duration of the leave. The starting date of the leave shall be determined upon mutual agreement between the Superintendent and the staff member so the effective time of the leave is both in the best interest of the school system and consistent with the health and welfare of the teacher. During the leave the staff member shall retain his or her position on the salary schedule and all accumulated benefits. Should the leave be for a period greater than five (5) school months, no accumulated sick leave will be granted for that year and no increment shall be earned on the salary schedule except if the leave is for a job related injury. When returning to duty, the teacher will be assigned to his or her former position, if possible, or to a position of like nature.
Unpaid Medical Leave. 23.3.2.1. If a unit member continues to be medically unable to perform the duties of his or her position after exhausting all available sick leave, including accumulated sick leave and the five month extended period, and is not medically able to resume the duties of his or her position, the District will place the unit member on the reemployment list for 24 months, if probationary, and 39 months, if permanent. Should the unit member become medically able to resume his or her duties while on the reemployment list, he or she shall be returned to employment in a position for which he or she is credentialed and qualified. The 24-month or 39-month period shall commence at the expiration of the five-month period.
23.3.2.2. Any unit member may be granted a leave of absence without pay for reasons of health.
23.3.2.3. A statement of need by a qualified physician will be required by the Board.
23.3.2.4. Before returning to duty, a statement must be furnished from the physician indicating that the returning employee can resume full-time employment without detriment to his/her health, or to the health or welfare of the staff or children.
23.3.2.5. Probationary or tenure status of an employee requesting health leave will not be affected if the provisions for application are fulfilled.
23.3.2.6. Those unit members who go on an unpaid leave of absence during any pay period shall receive their health and welfare benefits for the balance of the pay period. Thereafter, they shall be allowed continued benefits at their own expense within District-sponsored programs at the group rate.
Unpaid Medical Leave. A. The University complies with and exercise its rights under and pursuant to the Family and Medical Leave Act and the Americans with Disabilities Act (as amended). Therefore, the initial portion of this leave all shall exhaust the employee's FMLA entitlement (i.e., FMLA leave runs concurrently with leave under this article), and all entitlement to paid leave will be used before any unpaid leave commences.
B. Employees who exhaust all accumulated paid leave balances but are unable to return to work due to their own, dependent child's, spouse's, or domestic partner's serious health condition or the employ- ee's own disability (as those terms are defined in the Family Medical Leave Act and the Americans with Disability Act as amended) may apply for and receive a period of unpaid medical leave in accordance with the schedule and terms set forth below:
1. Employees with five (5) years or less of continuous Miami service are not entitled to unpaid medical leave in excess of the leave provided under the Family Medical Leave Act.
2. Employees with more than five (5) years, but less than ten (10) years of continuous Miami service may take unpaid medical leave for a period up to 180 days. During the first 90 days of unpaid medical leave, during which time the University shall maintain the employ- ee's health insurance upon the same terms and conditions as other bargaining unit employ- ees. Upon return from unpaid medical leave, the employee shall be placed in any vacant position in their former classification, or successively lower classifications if no vacancy exists in the employee's former classification, provided the employee is qualified for the position.
3. Employees with ten or more years of continuous Miami service may take unpaid medical leave for a period up to 365 days. During the first 180-days of unpaid medical leave the University shall maintain the employee's health insurance upon the same terms and condi- tions as other bargaining unit employees. Upon return from unpaid medical leave, the employee shall be placed in any vacant position in their former classification, or suc- cessively lower classifications if no vacancy exists in the employee's former classifica- tion, provided the employee is qualified for the position. Upon return from unpaid medical leave, the employee will be returned to their former assignment.

Unpaid Medical Leave. A. Employees shall be entitled to family and medical leave in accordance with the Family and Medical Leave Act of 1993, as amended.
B. In addition to having FMLA benefits, and upon Board approval, prior to the expiration of sick leave the employee who is ill may request a leave of absence for personal illness not to exceed two (2) years that will run concurrently with any unused FMLA benefits. A doctor's statement requesting the granting of said leave must accompany each application.
C. Nothing in this section will be construed to preclude a teacher from returning to active employment from leave status with a doctor's statement of approval. However, a teacher may not return to duty prior to the end of the term or semester without the employer’s approval.
Unpaid Medical Leave. When a Teacher exhausts all full and partial paid sick leave, and he/she is unable to return to work, he/she must submit a request for medical leave, or an extension of medical leave, for a specified period of time accompanied by a statement of verification from a physician, to the District Privacy Officer. This leave can be used for the illness of a family member as previously defined. Such leave may be granted for a period not to exceed twelve
Unpaid Medical Leave. Any employee who has completed two (2) years of full-time employment may be granted up to 60 days of medical leave without pay after exhaustion of all paid leave of absence (sick, personal, vacation days) and Family Medical Leave entitlement. To be eligible for such leave, the employee must present doctor’s verification of the need for such leave and secure approval of the Board of Education. While on such leave, the employee may continue health insurance coverage at the employee’s sole expense.
