Voluntary and Involuntary Transfers. A voluntary transfer is a transfer initiated by the employee, by filing with his/her immediate supervisor and the District Superintendent. An involuntary transfer is one initiated by the District for disciplinary reasons or lack of work or lack of funds. A vacancy to which an employee is being involuntarily transferred shall not be advertised as a vacancy open for voluntary transfer.
Voluntary and Involuntary Transfers. Section 1 General When a vacancy in an ESP position occurs, the position/school will be posted and e- mailed to all ESP’s. A position vacant on or after April 1st may be filled for the remainder of a school year; however, the position will become a vacancy on the last day of school.
Voluntary and Involuntary Transfers. Except as provided hereafter in this section 7.2, Teacher transfers within the School District will be administered pursuant to School District Policy. The School District will take reasonable efforts to provide personal notification regarding a decision on transfer to each Teacher who applies for such transfer before the School District’s final decision is made public. In the event two or more Teachers apply for transfer for one position and two or more of the applicants are deemed to be equally qualified for the position by the School District administration, then the School District administration shall award the position to the most senior Teacher among the applicants.
Voluntary and Involuntary Transfers. Transfer is defined as a movement of bargaining unit employees from one (1) position to another within the same classification. A voluntary transfer is when a qualified employee (as per the job description) transfers from one position to another position in the same salary classification is initiated by either the employee or the District and meets with agreement from both the District and employee. The current employee must submit an application for the posted position. The employee shall be subject to testing if they have not tested in their original position. An involuntary transfer is when a transfer from one position to another position in the same salary classification is solely initiated by the District and does not meet with agreement from the employee. Reasons for any involuntary transfer shall be discussed with the employee by his/her immediate supervisor, and with the Association, if requested by the unit member. The Chapter President shall be provided written notification of such involuntary transfers.
Voluntary and Involuntary Transfers. When temporary or permanent transfers are necessary Employer will first strive to transfer Employees on a voluntary basis. Should an involuntary transfer become necessary, Employer agrees to first consult with the affected Employee and the Association before exercising its management right to placement.
Voluntary and Involuntary Transfers. 1. It is recognized that the transfer of teachers must be made in the context of the educational needs of the school system.
2. Teachers requesting transfers shall submit such requests in writing to the Superintendent by April 15 of the preceding school year.
3. Teachers with seniority in the school system will be given priority provided all other factors are equal.
4. Involuntary transfers shall not be made for punitive reasons.
5. Due to the proposed changes in the configuration of the District’s schools, the District agrees that teacher transfers to and from grade levels shall not jeopardize the unit member’s current tenure rights. The K-8 Restructuring Committee comprised of equal members chosen by the District and Union shall meet to discuss the impact of K-8 schools on staff.
6. In the event of a program modification, personnel so involved, shall be transferred to another position if (1) there is a position available; and (2) if the person is certified to assume the new position.
7. Transfers shall remain consistent with existing state law.
8. The administration shall make a request for volunteers to transfer prior to involuntarily transferring any teacher.
9. If a transfer is necessary, teachers may list three priorities of buildings and/or grade levels to which they wish to be transferred.
10. Teachers’ experience in elementary/middle/secondary education will be a “factor” considered when transferring teachers.
11. Effective July 1, 2013, should a teacher be involuntarily transferred due to a reduction in force (RIF) effective June 30th of a particular school year and the position that was eliminated which led to the involuntary transfer is restored to the building that the unit member had previously worked in (if applicable) prior to August 15, the teacher who was transferred will be given priority to return to the building first. The foregoing shall not be applicable to a reduction in force which occurs within the school year.
Voluntary and Involuntary Transfers. 1. Voluntary Transfers - Any teacher presently on tenure or eligible for continuing contractual status in the coming school term may indicate desire for a voluntary transfer to another school. Such application shall be in writing to the Superintendent prior to February 1st. of the applicable school term. It is recognized that an application for transfer does not imply a teacher’s desire to be transferred from their present assignment should the desired vacancy not be available. Should the specific transfer request be unavailable, the teacher will have the option of applying for vacancies which may still exist. Every effort will be made to notify all internal candidates of their status prior to public announcement of the individual who has been selected to fill the vacancy. Upon request, current teachers that are not approved for voluntary transfer shall be given notice as to why he/she has been declined.
2. Involuntary Transfers - Transfers between schools due to District reorganization shall be considered involuntary transfer after voluntary transfer requests have been considered. Any transfer which is not acceptable to the teacher involved shall be considered an involuntary transfer with the following provisions:
a. Notice of the proposed involuntary transfer shall be given to the teacher involved as soon as reasonably possible.
b. No teacher shall be transferred involuntarily for arbitrary or capricious reasons.
c. An involuntary transfer shall be made only after a meeting, if requested in writing by the teacher, between the teacher involved and the Superintendent or his/her designee. Representatives of the Association may be present if requested.
d. Any teacher who is transferred shall meet with his/her new building principal prior to the implementation of the transfer to create a transition plan, including but not limited to training, mentoring, and other support which will enable the teacher to successfully transfer to his/her new position.
e. Any teacher reassigned by manner of an involuntary transfer may submit a written resignation and shall be released from his/her contract
Voluntary and Involuntary Transfers. All professional staff positions shall be posted in all school buildings as they become known. Notification of position vacancy shall specify position title, duties, qualifications, and the procedure and dates for making application. A copy of each posted notification of position vacancy shall be sent to the Association.
Voluntary and Involuntary Transfers. Whenever any transfer of a bargaining unit member is necessary, the Montessori Regional Charter School Chief Executive Officer, or his/her designee, will notify the Association President. This notice will occur five (5) working days prior to talking to any staff member, except in the case of an emergency or other unforeseen circumstance. Consultation with and notification to the Bargaining Unit member(s) shall take place as soon as reasonably possible. However, consultation and notification of transfer shall be provided as soon as reasonably possible prior to the transfer, but not later than two months prior, except in case of emergencies. No Bargaining Unit member will be transferred for disciplinary or punitive reasons or for retaliation. Prior to any final decisions regarding transfers, Bargaining Unit members in the affected unit(s)/department(s) (this encompasses all Bargaining Unit positions including but not limited to Specials Teachers, Teaching Assistants, Student Services) will be notified of the need for transfers and will be given the opportunity to volunteer to transfer by notification to Human Resources. In cases where volunteers are equally qualified, in the judgment of MRCS, for the position, the employee with the most classification seniority will be granted the transfer.
Voluntary and Involuntary Transfers. Step 1 Review - The Superintendent's designee will consider survey responses before making any voluntary or involuntary transfer.
Step 2 Notification - A unit member will be notified in writing by the Superintendent's designee of a voluntary or involuntary transfer. If the transfer is involuntary, the Superintendent's designee will offer the opportunity to meet with the unit member to discuss the transfer. The meeting, if requested, will occur within ten (10) work days of the notification.
Step 3 Appeal - Within five (5) school days of the Superintendent's designee decision, if a unit member objects to the transfer, the unit member may select either of the following options:
(1) Request to meet with the Superintendent to discuss the matter. The Superintendent shall set a date for such a meeting within ten (10) school days of the request. A representative of the Association may attend this meeting if requested by the teacher involved.
(2) Submit to the Superintendent a written appeal stating the reasons why his/her preferred assignment would be in the interests of the pupils affected including specific consideration of the teacher's qualifications and seniority compared to the teacher or teachers who would be affected by granting the teacher's preference. The Superintendent will render a decision in writing within ten (10) school days following the meeting or the receipt of the written appeal.
