Transfer and Promotions. All job openings within the bargaining unit will be posted on appropriate bulletin boards for seven (7) calendar days, excluding College paid holidays. Primary consideration will be given to bargaining unit employees who wish to be considered for transfers and promotions to open, posted jobs within the bargaining unit. Employees will so indicate by completion of an employment application provided for that purpose. Applicants for the position will be considered based upon; skills, ability, training, previous relevant experience, and job requirements as described in the job posting. When candidates are otherwise equally qualified, the job will be awarded to the applicant with the greatest length of continuous service within the bargaining unit. Members of the bargaining unit as of October 25, 2002 shall have as their seniority date for bidding purposes, their date of continuous service at the College. Employees who enter the bargaining unit after October 25, 2002 shall have as their seniority date for bidding purposes their date of continuous service within the bargaining unit. No employee shall be permanently transferred from one classification to another for disciplinary reasons unless the employee consents to such permanent transfer. When the College permanently transfers an employee to another building or area of the campus, the supervisor, upon request of the employee, will give the employee an oral explanation for the transfer. When an employee is promoted within a department and desires to return to his or her prior position, the employee may do so without penalty provided the employee notifies the Department Head of the request in writing within fourteen (14) calendar days of the promotion. Likewise, an employee determined by the College to be unsuitable for the new position within fourteen (14) calendar days will be returned to his or her prior position. Nothing in this provision will be construed to restrict the College’s right to determine the employee’s suitability to remain in the job after the first fourteen (14) days. Employees who are promoted to a job with a higher job rate than the one they currently hold within their bargaining unit will be placed on the salary schedule at the rate at or above their rate of pay prior to promotion. Employees placed at the 9 Month rate will advance to the Job Rate after nine additional months of service.

Transfer and Promotions. 1. An employee being transferred shall be first notified in person within five (5) work- ing days by his/her supervisor, except in emergencies. 2. Prior to posting open positions within the District, the District will consider all requested transfers. Transfer requests must be in writing and be returned to the Department of Human Resources prior to the posting of the position. A permanent employee whose promotion results in a probationary period shall have the right to return to his/her former position, initially held prior to promotion, if he/ she does not satisfactorily complete the probationary period. 3. Non-competitive, provisional and labor class positions will be filled with the most senior qualified person as evidenced through the interview and reference checking process. 4. When a unit member is transferred within the same classification, the unit member will not suffer any loss in his/her rate of pay. 5. When a unit member is transferred or reassigned, there shall be no loss of seniority. Seniority shall be considered in all promotions and transfers.
Transfer and Promotions. Seniority as it shall be maintained and applied to promotions, transfer and promotional transfers: (a) (i) In the event a vacancy occurs on any permanent job, or should a new job be established within the scope of the bargaining unit, notification of such vacancy or establishment of such new job shall be posted on the department bulletin board for a period of three (3) days. Upon request from the Association, the Corporation will extend the job posting for two (2) additional days to provide time for the Association to contact an employee who is absent from work or laid off. A vacancy will not be deemed to exist if there is an employee either on lay-off or in a lower rated job who formerly held the job now open and who lost it by reason of a shortage of work. The notification shall contain the job title, the grading and the shift to which the job is presently assigned. Such jobs shall be filled by employees throughout the plant whenever possible. In all such cases, the length of service (seniority rank) shall be the determining factor providing the employee is qualified to perform the work. Transfers under this provision shall represent a promotional opportunity for the employee involved. Not withstanding any provision of this Section D (a)(i) to the contrary, an employee having in excess of ten (10) years' seniority shall be entitled to bid upon a vacancy that occurs in any permanent job or newly established job of equal or lower rank in the plant. Such employee shall be awarded the job if (1) the employee's seniority in the plant is greater than the other employees under consideration for the job and (2) the employee's fitness and ability are substantially equal to such other employees. If such employee is awarded the job, the employee shall not be eligible again for promotion under this Section D and shall remain in the job for twelve (12) full months before he or she may bid on another job vacancy. (ii) Eligible employees not claiming such posted jobs within the agreed upon time shall forfeit their right in such cases and wait until the next job posting occurs. (iii) In the event of disputes, the job in question shall be considered only temporarily filled until the matter is properly disposed of through the established grievance procedure. In no case shall this provision involve back pay beyond the date on which the grievance was filed. Promotions within the unit shall be based on the license registration list and qualifications within the classification. Qualifications shall include consideration of the Employee’s attendance record and disciplinary history. 1. Upon the decision to fill a position, all newly opened positions will be posted by the University. After the posting of the initial position, all subsequent vacancies shall be filled using current valid bid sheets on record as of the closing date of the bid. All bids submitted shall be acted upon by the University. All vacancies shall then be filled in accordance with sub-paragraph 4, until all vacancies are filled. All transfers shall be filled as expeditiously as possible. The University, may, upon consultation with the Union, require an Employee who has been transferred to another shift, or promoted to stay in that position for a period not to exceed nine (9) months from the date of the transfer or promotion. If an employee is required to stay in their former position, that employee receives the rate of pay for the transfer/ promotion or their former rate, whichever is greatest. Employees bidding into a new building, new position or a newly renovated building shall not bid on another position for a period of one (1) year from the date of entry into that position. Employees shall be limited to two (2) moves per twelve (12) month period.

Transfer and Promotions. A. The Board recognizes that it is desirable, in making assignments, to consider the interest and aspirations of its teachers as well as the best interest of the students and the school. B. A list of teaching vacancies and/or new teaching positions to be filled for the forthcoming school year shall be made available and posted in the mailroom and faculty room within ten (10) days of the District’s knowledge of the vacancy. If the vacancy occurs during the summer, notice shall be mailed to the staff. C. Any teacher under employment by the District who requests a transfer shall have the opportunity to be interviewed by the administration prior to the interviewing of outside applicants. D. Any teacher who is denied a transfer under this paragraph will be supplied with a reason for such denial, in writing, upon request. X.
