ASSOCIATION’S RIGHTS. A. The Association will have the right to use school buildings at reasonable times without cost of meetings. Request for the use of buildings will be made to the Principal in advance.
B. The Association will, upon request, be given an opportunity to present brief reports and announcements at building faculty meetings.
C. The Association will, upon request, be allowed to address new teachers during orientation session.
D. The Association will have the right to post notices on its activities and matters of teacher concern in teacher's rooms and shall continue to have the use of the teacher mailbox system.
E. Upon notification by an employee the District will deduct for professional Association dues and forward such deduction to the Association Treasurer. The District shall only be responsible for deduction of the sums from teacher paychecks and for forwarding of said sums in total to the Association Treasurer. The Association shall be notified of any teacher withdrawal or drop from payroll deductions.
F. The Association may, with permission from the Building Principal, use school equipment normally used by teachers for Association activities. However, expendable material will be at the expense of the Association.
G. Rights granted to the Association under this Article IV shall not, in the judgment of the Board, be contrary to the welfare of the Hinsdale Education System, its students, the faculty, or administration, nor in violation of any of the provisions of this Agreement. In making judgments under this Section, the Board shall not be arbitrary or capricious.
H. The rights and privileges as set forth in this Article shall not be granted to any other teacher organization.
I. Request under the provision of this Article shall mean permission and shall be made to the Building Principal or the Principal's designee.
J. As provided in RSA 273-A, a reasonable number of employees who act as Association representatives shall be given a reasonable opportunity to meet with the employer or the employer's representatives during working hours without loss of compensation or benefits. However, the individual representatives do not have the authority to effect any changes in or waivers of the provisions of this Agreement.
K. The Association shall be supplied with current Board policies.
L. Authorized representatives of the Association will be permitted reasonable access to the teachers in the schools.

ASSOCIATION’S RIGHTS. A. The Board will make available to the Association upon its request and within statutory limits, such bargaining unit member and financial information, related to the Alpena Public Schools and in the possession of the Board, as are necessary for the negotiation of collective bargaining agreements; as well as records in possession of the Board that may be necessary for the Association to process any grievance.
B. The teachers will be entitled to full rights of their citizenship and no religious or political activities of any teacher or the lack thereof will be grounds for discipline or discrimination with respect to the professional employment of such teacher. The religious or political activities must be conducted on the teacher's own time or on such school time as may be agreed upon between the Superintendent and the teacher.
C. In any negotiations provided for by this Agreement, neither party will have any control over the selection of the negotiating or bargaining representatives of the other party and each party may select its representatives from within or outside the school district. It is recognized that no final agreement between the parties may be executed without ratification by the majority of the Board and by a majority of the membership of the Association, but the parties mutually pledged that representatives selected by each will be clothed with all necessary power and authority to make proposals and consider proposals in the course of negotiations or bargaining, subject only to such ultimate ratification.
D. The Association agrees to comply with Act 379 of the Michigan Public Acts of 1965.
E. The Association will not engage in strike action of any type during the life of this contract.
F. The Association and its members may use and/or have access to employer facilities and equipment according to Board policy.
ASSOCIATION’S RIGHTS. A. The Employer shall not interfere with the rights of Teachers to join or participate in the Association. The Association shall not interfere with the right of Teachers to refrain from joining or participating in the Association.
B. The Employer shall deduct from wages the yearly dues or other special deductions of the National Education Association (NEA), Education Minnesota (EM), the American Federation of Teachers (AFT), and the Xxxxxxx Education Association (HEA). The deduction of such dues and the proceeds thereof shall be waived in the event the Association loses the right to dues deduction pursuant to the Public Labor Relations Act of 1971, as amended (PELRA).
1. Deductions shall be made by payroll deduction from October 30 through May 30.
2. The total amount of yearly dues, other special deductions, and the amount to be deducted shall be specified by the Teacher serving as the membership chair for the HEA.
C. Association’s dues and other special deductions, deducted in accordance with Article IV (B), shall be remitted by the Employer to the Association each pay period a deduction is taken.
D. The Association shall indemnify and hold the Employer harmless against any and all claims, judgments, or orders issued against the Employer, members of PELSB, or agents of the Employer arising from the administration of Sections (B) and (C) of this Article.
E. The Association shall have the right to appoint buildings’ representatives at buildings where Teachers, covered by this Agreement, are assigned. The Association shall notify the Assistant Superintendent, in writing, of the names of the buildings’ representatives and of successors, when so appointed.
F. Education Minnesota’s field representative for the Association shall have the right to enter the facilities of the Employer at reasonable times to administer this Agreement, provided, however, that the activities of Education Minnesota’s field representative shall not interfere with or interrupt the duties or responsibilities of the Employer or the Teachers. Upon entering the facilities, Education Minnesota’s field representative shall notify the Principal of the representative's presence.
G. The Association shall have the right to request the use of the facilities and equipment of the Employer at reasonable times when such facilities and equipment are not in use. ASSOCIATION’S RIGHTS. The Association shall have the ----------- -------------------- right to demand by written notice delivered to Company that any employee of Company be terminated, but only if the termination is reasonably and legally supportable in the opinion of Company as a termination for cause. Otherwise, the termination of an employee at the instance of the Association shall only be completed upon the Association's agreement to indemnify Company with respect to any liability for such termination, including but not limited to, unemployment insurance taxes, and such indemnity shall be in a form and under terms satisfactory to Company.
ASSOCIATION’S RIGHTS. Section 1: The Board agrees to furnish to the Association, in response to reasonable requests from time to time, all public information and such additional information that is available and necessary for the Association to conduct collective bargaining or to process grievances.
Section 2: The Superintendent shall advise a person designated by the Association that is an employee of Xxxxxxxx Public Schools by letter of any existing vacancy and shall provide an opportunity for teachers to express their desires for changes in assignment.
Section 3: The Association shall have the right to use school building facilities for meetings provided: (1) such meetings are held at hours other than school day hours.
ASSOCIATION’S RIGHTS. This Agreement does not constitute a contract of employment between the parties, nor shall any provision of this Agreement restrict the right of the Association’s shareholders to replace the Director, or the right of the Director to terminate his services.
ASSOCIATION’S RIGHTS. Section 1: The Board agrees to make available to the Association in response to written requests all public information which is not equally available to the Association as required by law. In the event the Association requests require expenditure of time and funds to provide such information, the Association will reimburse the Board for all expenses if they are incurred in providing information other than that available as a matter of right to a citizen within the District.
Section 2: The Association will have the right to use school building facilities pursuant to and consistent with the adopted policy of the Board as of the date of this Agreement. A bulletin board for the exclusive use of the Association shall be provided as of the date of this Agreement in each of the teachers’ lounges.
Section 3: The Association will have the use of the inter-school mailing facilities for the distribution of official Association materials.
Section 4: The Board shall place on the agenda of each regular Board meeting as an item of consideration under "New Business" matters brought to its attention by the Association, so long as these matters are made known to the Superintendent's Office in writing signed by an Association officer five (5) days prior to the meeting. The Board will make a copy of the agenda available to the Association representative at the same time it is made available to the Board members and will mail a copy through the school mail to the Association president.
Section 5: Before adoption by the Board or administrative staff of any substantial change in regard to bargaining unit wages, hours or conditions of employment as defined in Section 15 of the Michigan Public Employment Relations Act Michigan Compiled Laws 423.215, the Board recognizes the right of the Association to request a conference between representatives of the Board and Association concerning the reasonableness thereof.
Section 6: At the beginning of the school year, the Association shall be afforded an opportunity during new teacher orientation to present and distribute the collective bargaining agreement to newly hired teachers.
ASSOCIATION’S RIGHTS. Prior to the resolution of a grievance at Levels I and II above, the Association shall receive a copy of the grievance and the proposed resolution and shall be given the opportunity to file a response.
ASSOCIATION’S RIGHTS. A. There will be no reprisals of any kind taken against any member by reason of membership or participation in any of the Association’s lawful activities.
B. Representatives of the Association will have access to all school buildings and to all members, provided that the exercise of this right does not interfere with the regular work day.
C. The Board will, upon reasonable request, provide the Association with any public documents and/or data which will assist it in developing intelligent, accurate, informed and constructive programs on behalf of members.
D. During the school year, the Board shall distribute the Board’s official agenda and addenda including, but not limited to, financial reports of each Board meeting, including any special meetings, via the District’s e-mail system, to the BWPSSA President and Vice President at the same time a copy is sent to Board members. During the summer, the Board shall distribute the Board’s official agenda and addenda, including but not limited to financial reports of each Board meeting, including any special meetings, to the BWPSSA President and Vice President, via e-mail, unless U.S. mail is requested, at the same time a copy is sent to Board members. Minutes of each Board meeting shall be posted on the school website.
E. The Association shall have the following rights:
1. The Association will have the right to use the school buildings without cost for meetings, provided there is not a conflict with the use of the space on the requested day and time and a custodian is on regular duty. The date, time, and section of the building to be used will be cleared on the calendar of the principal of that building.
2. The Association will have the right to use school facilities and equipment, when such use does not interfere with the regular school use. Such use shall be on school premises and any costs for expendable items shall be paid by the Association.
3. The Association will have the right to use inter-school mail, employee mailboxes, and Internet e-mail. The Association has the right to place organizational materials in all members’ mailboxes. Copies of all such material may be shown to the building principal, but approval from the principal will not be required.
4. The Association will have the right to have a letter prepared by the Association informing members new to the District that the Association is recognized as the exclusive bargaining agent for all members in the District.
