Basic Work Week and Overtime. The Employer reserves the right to schedule hours of store operation, employee hours of work, rest periods, lunch periods, and overtime work, subject to the following provisions: (a) The basic work week for employees working full-time shall consist of forty (40) hours, to be worked in five (5), eight (8) hour days, as scheduled by the Employer. (b) There shall be a daily starting time for each employee. Daily hours of work for employees shall be consecutive with the exception of rest periods and meal periods. No split shifts shall be worked.

Basic Work Week and Overtime. 3.1 Forty (40) hours per week, consisting of five (5) days of eight (8) hours each, Sunday to Thursday, or Monday to Friday inclusive, shall constitute the basic work week. Notwithstanding the foregoing, the Union agrees to meet with the Company and discuss, in good faith, any scheduling changes that may be required to satisfy volume increases and/or customer demands that may be encountered mid agreement. All time worked in excess of the daily hours, or the basic work week shall be paid at the rate of time and one half (1 1/2 X) the regular hourly rate. The Company will pay double (2X) time on all hours worked over ten (10) hours per day or forty-five (45) hours per week. (a) In a week in which one (1) Statutory Holiday occurs, employees shall receive forty (40) hours pay at straight time rate and work thirty-two (32) hours. In a week in which two (2) Statutory Holidays occur, employees shall receive forty (40) hours pay at straight time rate and work twenty-four (24) hours. (b) When overtime is necessary, the most senior qualified employee (as defined in Article 4.7) in the department shall have the first opportunity to declare their availability. If there are insufficient volunteers for overtime, then the selection of employees shall be on a reverse seniority basis. The Company agrees to make best efforts to minimize the number of employees needed to fulfill the overtime assignment. The most senior qualified employees in the department will be afforded the overtime work available and shall be paid at the applicable rate of pay for the overtime work performed. Where P5 employees voluntarily work overtime in a P1 position, they shall be paid at the P1 overtime rate. Departments are defined as follows: - Kill and Live Hang - Eviscerating - Packaging - Shipping - Trucking - Sanitation - Maintenance The Company agrees to provide the opportunity to train the senior employees in Packaging so that they have the skills required to work the overtime. Those employees who wish to be trained in other jobs within Packaging will make application to the Plant Superintendent. Upon request by the Union, the Company will supply the Union with a copy of all regularly scheduled shifts. 3.2 The basic work day for employees not covered by Articles 3.3 and 3.3 (a) will have shifts starting between 3:00 a.m. and 7:00 p.m. and shifts starting before 3:00 a.m. and after 7:00 p.m. shall be paid at the overtime rate for the period outside the sixteen (16) hour period.

Any overtime in excess of thirty (30) minutes will be considered scheduled overtime. If there are insufficient volunteers for overtime, then the selection of employees shall be on a reverse seniority basis in the department, subject to their qualifications. If a senior qualified person is missed in this procedure, that employee shall be paid an amount of overtime equal to the amount that was missed. If management determines it necessary to change the Monday through Friday schedule the basic work week of forty (40) hours shall be scheduled within a five (5) day period. Should a significant segment of the bargaining unit be affected by such change, the Employer shall provide the Union with the most notice possible.

The schedule of an employee may be changed, without notice, in the event of an unscheduled absence of other Meat Department employees, or in the event of emergencies such as fire, flood, breakdown of machinery, or other instances of force majeure. In all other cases at least forty-eight (48) hours’ notice of any change must be given or four (4) additional hours’ pay given in lieu of notice. Employees will not be required to work more than seven (7) consecutive days unless they are relieving in the event of unscheduled absence of other staff or affected by emergencies as indicated above. It shall be the Employer’s responsibility to notify the employees of a change in their schedule. 5.5 Employees will record their time electronically. Employees shall punch their own time at the time they commence and finish work and the time they commence and return from meal periods, and rest periods if so required. Management agrees to assume its full responsibility in seeing that the employees are paid for all time worked and recorded. In a grievance involving time worked the Union can request a copy of the time and attendance records involved for employees. Any time and attendance records requested shall be made available as soon as conveniently possible.

The Company will endeavor to provide senior fulltime employees with two (2) consecutive days off, one (1) of which will be a Saturday or Sunday. If that is not possible, then two (2) consecutive days off will be provided on the basis of reverse seniority. b) When the Company identifies the need for a permanent ten (10) hour shift it will be administered in the following manner: 1) Full-time employees will be provided with the opportunity to move from their existing eight (8) hour shift to the new ten (10) hour shift. The new ten (10) hour shift will be posted and employees will be selected based on their ability to do the jobs available and their seniority. 2) Where there are vacancies in existing jobs as a result of employees moving from an eight (8) hour shift to a ten (10) hour shift, such vacancies will be posted in accordance with Article 12.05 b). c) The Company agrees to notify the Union no less than two (2) weeks prior to implementing the first four (4) ten (10) hour shift. Rest periods for ten (10) hour shifts; A fifteen (15) minute rest period will be given following the first two (2) hours worked. A half-hour (½) unpaid lunch break after four (4) hours worked, a second fifteen (15) minute rest period after six and one half-hours (6 ½). A third fifteen (15) minute paid break after eight and one half-hour (8 ½) from start time. Sick days and bereavement days will be paid as ten (10) hour days. d) The Company will endeavor to provide three (3) consecutive days off for employees working four (4) ten (10) hour shifts. However, it is understood that this may not be possible at which time the employee will be provided with two (2) consecutive days off and one (1) other day off. Upon request when the Union is dealing with a specific employee related situation, the Company will provide its reasons for scheduling days off in such circumstances.

Management agrees to assume its full responsibility in seeing that the employees are paid for all time worked and recorded. a] No member of the bargaining unit shall, outside paid working hours, instruct other members of the bargaining unit on matters pertaining to their work. All such time worked shall be paid in accordance with Article 5.6 and Article 5.7.
