Construction Administration Phase Services. Conduct inspections at appropriate intervals to review conformance of the work with the Contract Documents. • Identify non-conforming work. • Review and certify the amounts due the contractor and issue certificates in such amounts. • Review and take appropriate action on contractor submittals and requests for information. • Determine the date of Substantial Completion and issue a Certificate of Substantial Completion. Schematic Design: $1,155.00 Construction Documents: $2,695.00 Construction Administration: $1,750.00 Additional Services:Design for Courtyard Fencing: $1,500.00 Changes to the program beyond the completion of Schematic Design phase will likely require a new proposal for Additional Services. During the Schematic Design Phase, one design solution with two revisions is included in our fee. These services do not include revisions for value engineering, or any revisions after the General Contractor has begun bidding or pricing of the project for the purpose of reducing construction costs of the project. These services also do not include revisions for deviations from the AHJ-approved Permit Documents made without the Architect or Engineer of Record’s consent. This proposal remains valid for 60 days from the date on this proposal letter. Billing will occur upon completion of the individual phases listed above, except Construction Administration which may be billed monthly or periodically throughout construction. Construction Documents phase services will be billed their full amount upon submittal of permit documents to the client. Construction Administration Phase Services. Consistent with the standard of care and practice stipulated in Section 3.3 above, upon the award of the Construction Contract, the Designer and its Consultants shall: be charged with general administration of the Construction Contract to the extent set forth herein; furnish the general contractor with information for establishing lines and grades, and shall prepare a set of plans and specifications that incorporate all addenda and SK drawings issued during the bidding process; promptly and in accordance with the requirements of the Construction Contract check, obtain testing where necessary, and approve samples, schedules, shop drawings and other submissions by the general contractor; prepare, maintain and update logs for all submittals and changes to the Construction Contract; visit the site at intervals appropriate to the stage of construction, but not less than weekly, and observe the progress of the work, issue written progress reports, conduct job meetings, and prepare and distribute meeting minutes to assure that the work is being built in conformance with Approved construction documents; report to MassDevelopment weekly in writing on the progress of the work including whether or not the general contractor is keeping As-Built Drawings updated; on a weekly basis (or more often as may be necessary), make specific recommendations on rejection of all Project work observed by the Designer that fails to conform to the Construction Contract documents, and review and inspect corrected work; require each Consultant employed in accordance with Article 3 to make visits weekly during the progress of any work to which that Consultant's services relate and to report upon it in writing to the Designer; conduct semi-final and final inspections of the Project and report the results of such inspections in writing to MassDevelopment; observe the balancing of air and water circulation systems and report the results thereof; observe the setting and adjustment of automatic controls and report thereon; in a timely manner, decide all questions regarding interpretation of, or compliance with, the Construction Contract documents, except as MassDevelopment may in writing otherwise determine; furnish electronic versions of the Record Drawings, a final cost report, and other required documents; and assist MassDevelopment in any bid protest hearings, change order appeal hearings requested under M.G.L. c. 30, § 39Q, and any other litigation, except as provided in Article 6. Construction Administration Phase Services. The Construction Administration Phase (herein so called) shall commence upon Owner’s award of the Construction Contract and Owner’s issuance to Architect of a written notice to proceed with Construction Administration Phase Services, and shall end upon the later of (a) sixty (60) days after final payment is made by Owner to Contractor, and (b) the date Architect has satisfactorily performed all of the Services. Architect and the Consultants shall have access to the Site and the Work at all times during the Construction Administration Phase. During the Construction Administration Phase, Architect shall provide the Services required of the “Architect/Engineer” or the “AE” under the UGC and SGC, as well as the following listed Services (collectively, the “Construction Administration Phase Services”): 2.8.1 Participate in a pre-construction conference. 2.8.2 As Owner’s representative during the construction of the Project, advise and consult with Owner and serve as liaison between Owner and Contractor for all purposes including, but not limited to, issuing all instructions from Owner to Contractor and receiving all communications from Contractor to Owner; provided, however, Owner may, at its discretion, communicate directly with Construction Manager (if any). Architect’s authority to act on behalf of Owner shall be to the extent provided in the Construction Documents and may not be restricted, modified, or extended without Owner’s written instruction to such effect, which Owner may issue at Owner’s sole discretion. 2.8.3 Review Contractor’s list of proposed subcontractors for the Work, and Contractor’s initial administrative submittals for Project schedule, schedule of values, submittal schedule, and equipment matrix to establish the appropriate basis for construction monitoring, payment processing, and system commissioning. Architect shall advise Contractor in writing of any necessary revisions to the documents submitted by Contractor and recommend acceptance of such documents by Owner as and when appropriate.
