Emergency Sick Leave. In the event of an extended illness which exhausts all of an employee’s accumulated sick leave days, a request can be made to the Board for additional paid leave. Granting or denial of such additional leave shall be at the sole discretion of the Board and will be decided on an individual basis. Payment for such leave cannot exceed normal salary for that person, less the cost of a substitute or replacement employee. There is no contractual or legal right to Emergency Sick Leave.
Emergency Sick Leave. At the beginning of each fiscal year, the Board of Education shall contribute 10 sick leave days to a pool of Emergency Additional Sick Leave days (ESL days) to be available to members of the bargaining unit (teacher). If the ESL days are not used from this pool by teachers, as described below, the ESL days shall accumulate in subsequent fiscal years to a maximum of 20 days. To be eligible to use ESL days from the ESL pool, the teacher must make application in writing. If a teacher is unable to apply personally, for example, due to injury or illness, a member of the employee’s family, or Association president may do so on the teacher’s behalf. The teacher must meet the following conditions:
1. Have been employed full time by the district for at least 1 full year.
2. Have exhausted all other available paid leave.
3. Have a serious personal illness or injury which makes it impossible for the employee to return to work, or
(a) have a spouse, or
(b) a child under the age of 18 years who resides in the home of the employee, who has a serious personal illness or injury, and which requires the personal care of the employee.
4. Have incurred at least 5 days’ loss of pay as a result of the serious personal illness or injury. Any illness or injury, and its seriousness, must, at the request of the Administration, be verified by a physician. No employee shall be entitled to use more than 20 ESL days for the same serious illness or injury. In addition to the foregoing, the Board will contribute up to 20 additional sick leave days per school year to the ESL pool, one such day for each earned, accrued and available personal day waived by a member of the bargaining unit for that purpose. (Personal days which have been converted to sick leave are not personal days). The ESL days shall be used alternately, one from those provided by the Board and then one from personal days waived by employees. Days from the additional sick leave pool shall be granted on a first-to-apply basis, until the additional sick leave pool is exhausted.
Emergency Sick Leave. Effective March 31st of each year of this agreement, all bargaining unit members not currently in the sick leave bank shall automatically be enrolled and contribute three (3) days of accrued sick leave to the bank. Days contributed to the bank shall thereafter be allocated to employees with catastrophic or extended long term illness. Bargaining unit members with a sick leave balance of 105 hours or more on March 31st will have these three (3) days deducted effective immediately. Employees with less than a 105 hours sick leave balance on March 31st, will have one (1) day each deducted quarterly with all three (3) days deducted no later than the end of the calendar year. New hires will have one (1) day deducted in each of the 9th, 10th and 11th month accruals. To be eligible for allocation of sick days from the bank, an employee must meet the following conditions:
(a) Membership in the bank;
(b) Exhaustion of all personal sick leave, personal, or vacation leave and any other compensatory time due;
(c) The illness or injury is not covered by worker’s compensation or such benefit has been exhausted;
(d) An acceptable medical certificate supporting the absence is on file;
(e) The bank is not depleted. Days shall be allocated by a joint committee of four members, two designated by the Congress, two by the Employer. This Committee shall have full authority to grant benefits and administer the program in accordance with guidelines outlined above; in addition, the committee may by agreement provide for additional opportunities for contribution to the bank. Time off without loss of pay or benefits may be granted, as necessary, to members of the committee to attend meeting to administer this program. Unused days shall be carried over from year to year and shall not lapse. The actions or nonactions of this committee shall in no way be subject to collateral attack or the grievance/arbitration process. The panel shall not be considered a State agency, board, or any other subdivision of the Employer. No requests shall be conducted as contested cases or otherwise be subject to the Uniform Administrative Procedure Act. Upon retirement, bargaining unit members who have accrued in excess of 240 days of sick leave, shall have those days over 240 added to the sick bank.
Emergency Sick Leave. In a situation of an employee dealing with an illness of a severe nature, the school board has the ability to grant extra sick days to all full-time employees of the Elk Point-Jefferson School District. The board will set aside 50 sick leave days that can be drawn upon by any employee with committee approval.
1) The individual must submit an application to the superintendent who will present the request to a committee comprised of two teachers, two administrators and two board members for review. The application must be accompanied with a physician’s assessment of the illness attached. The committee can approve up to a maximum of 10 days per individual not to exceed 50 days in a school year.
2) The fifty days set aside by the school board do not accumulate from year to year.
3) In the event that the fifty days are exhausted, individuals may donate sick days with the approval of the school board. The superintendent will notify the staff of the situation and accept donations in a written form. The school board will approve all such donations.
4) Employees who are drawing from the plan when a new contract term begins will not qualify for the annual ten-day sick leave until they return to work on a full-time basis. ***It is important to note that the school board is under no obligation to grant the emergency sick leave and each case will be viewed according to its merit.
Emergency Sick Leave. When an employee exhausts all paid leave, and by virtue of personal illness or non-work related injury needs additional time off work, the following procedure shall be used:
A. The employee may be granted sick leave in advance of service, in an amount of not less than 8-hour blocks, up to a maximum of eighty (80) hours. The amount advanced will be recouped by the City by debiting against future accruals of sick leave or by repayment by the employee upon separation from service if the total cannot be recouped. Sick leave granted by this provision shall be for serious or continuing illness of 3 or more days’ duration.
B. Should an employee need further sick leave for extended illness beyond that provided in paragraph A above, the employee may be awarded supplemental sick leave as follows: Prerequisites: • The employee shall have exhausted all paid leaves. • The employee shall have exhausted the sick leave award in section A above. • The employee shall have an illness or injury not otherwise compensated by disability insurance or 411 plan. • The employee shall have been on non-paid status for 3 consecutive workdays.
Emergency Sick Leave. Emergency sick leave shall be granted to certificated employees from accumulated sick leave in the event a problem arises that requires the personal attention of the certificated employee that has been suddenly precipitated, of such a nature that pre-planning was not possible or where pre-planning could not relieve the necessity for the certificated employee's absence.
Emergency Sick Leave. If a teacher has used their family illness days for the current year, as defined in Section 4.1 A 8, they may apply for emergency family illness leave if the request is for a catastrophic event or terminal illness of an immediate family member (spouse, child or parent, etc). Catastrophic illness is defined as a life threatening illness or injury. It is not to be used for long-term absences such as maternity leave. Approval will be at the discretion of the Superintendent. This emergency family illness leave shall be limited to the number of days in the teacher's individual accumulated sick leave bank. Each teacher with a minimum of one (1) year seniority in the district may contribute up to two (2) sick leave days per request, from their personal accumulated sick leave bank, to another teacher in the event of a catastrophic event or illness, with the joint approval of the Board and the Association.
Emergency Sick Leave. In a situation of an employee, or member of their immediate family, dealing with an illness of a severe nature, the school board has the ability to grant extra sick days to all full-time employees of the Elk Point-Jefferson School District. Members of the immediate family shall mean parent, grandparent, child, brother, sister, spouse, parent of spouse, grandchild or wards of the employee. The board will set aside 50 sick leave days that can be drawn upon by any employee with committee approval. Staff must exhaust their own sick leave before using the emergency sick leave.
1) The individual must submit an application to the superintendent who will present the request to a committee comprised of two teachers, two administrators and two board members for review. The application must be accompanied sufficient medical documentation. The committee can approve up to a maximum of 10 days per individual not to exceed 50 days in a school year.
Emergency Sick Leave. When an emergency arises whereby an employee is required to use sick days beyond his accumulated limit, it is understood and agreed between the parties that the Board, at its sole discretion, may, and if it so desires, provide additional sick days. Other leaves of absence with pay may be granted by the Board for good reason.
