TEACHERS' RIGHTS AND RESPONSIBILITIES. 3.1 Discrimination against any teacher for participation in sanctioned union activity is prohibited. 3.2 Teachers shall have the right to join or not to join the WCEA. Neither the Board nor WCEA shall interfere with this right. 3.3 The Board and WCEA agree not to interfere with a teacher in the exercising of any rights granted under this agreement. 3.4 Teachers shall adhere to the Code of Ethics and the Principles of Professional Conduct for the education profession as prescribed by the State of Florida. 3.5 Teachers shall be entitled to the full right of citizenship as granted by the laws and constitution of the Xxxxx xx Xxxxxxx xxx xx xxx Xxxxxx Xxxxxx. 3.6 The Master Contract between the Xxxxxx County school Board and the Xxxxxx County Education Association will be placed and maintained by the Xxxxxx County School Board on the Xxxxxx County School District web site. 3.7 Teachers shall be given any new rules and/or regulations that apply to them before their implementation. 3.8 There shall be a uniform countywide disciplinary form available in each school for disciplinary purposes. Any referrals of a pupil by a teacher shall be made on such disciplinary forms and submitted to the principal or his designee. A copy of the action taken will be returned to the teacher within three (3) working days except in emergencies. 3.9 No disciplinary action which affects a teacher's employment and/or evaluation shall be taken against a teacher on the basis of a complaint by a parent, student, or other individual, until notice of such action is provided to the teacher. A. A teacher may be disciplined, including reprimand, reduction in compensation, suspension, involuntary transfer, or dismissal for proper cause as defined in Florida Statues, State Board Rules and School Board Policies. No teacher shall be reprimanded without just cause as defined in Florida Statutes, State Board Rules and School Board Policies. B. In any of the above matters, the teacher shall be permitted a representative of his/her choice, if desired. This article shall not limit in any way the exercise of the Board’s rights as provided in this agreement. C. Teachers must be notified in writing twenty-four (24) hours prior to being called in for a disciplinary interview that could lead directly to discipline of any kind. TEACHERS' RIGHTS AND RESPONSIBILITIES. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every member of the Association shall have the right to organize, join, and support the Association for the purpose of engaging in collective bargaining and negotiations, or to refrain from such activities. B. The Board specifically recognizes the right of the Association members to appropriately invoke the assistance of the Michigan Employment Relations Commission. C. The Association and its members shall have the right to use the school facilities after students have been dismissed, when cleared and scheduled according to the District Facility Use Policy. D. Upon approval the Association shall have the right to use facilities and equipment, including computers including software programs and email systems, printers, duplication equipment, calculating machines, and all types of audio-visual equipment at reasonable times, when such equipment is not in use for school business. The Association shall pay for the reasonable cost of all materials and supplies incident to such use. Association use of email and internet will be subject to the District’s acceptable use policies and user agreements. E. The school mailboxes may be used by the Association. F. The Board agrees to make available to the Association in response to reasonable request all general public information concerning the financial resources of the District. The Association agrees to specify, in writing, the information desired. The Association will reimburse the District for any costs associated with the request. G. The Board agrees to provide an Agenda of its regular Board meetings to the Association. H. The provisions of this Agreement and the wages, hours, terms, and conditions of employment shall be applied in a manner which is not arbitrary, capricious, or discriminatory, and without regard to race, creed, religion, color, national origin, age, gender, political affiliation, marital status or sexual orientation. The private and personal life of any teacher is not within the appropriate concern or attention of the Board, unless it directly impairs the ability of the teacher to perform his teaching duties or is qualified within student safety legislation wherein conviction of certain crimes (even when off- duty) could result in loss of certification and presumption of unfitness under the State of Michigan Tenure Act. Xxxxxxxx to the Michigan Public Employees Relations Act, the Board agrees that teachers employed by the District shall have every right to freely organize and support the Association for the purpose of engaging in collective bargaining or negotiations and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage, deprive or coerce any teacher in the enjoyment of any rights conferred by the Michigan Public Employment Relations Act, MCL 423.201; or the United States; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association, or collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under the Agreement or with respect to any terms or conditions of employment. B. Each teacher is responsible for maintaining the proper teaching certificate. C. The Board shall make available in each building, adequate lunch room, restroom, and lavatory facilities for teachers’ use and a room which shall be reserved for use as a faculty workroom and/or lounge. The Board and the Association agree that neither will, directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by the Michigan Public Employment Relations Act, MCL 423.211 et seq. or the laws of Michigan and the Constitution of Michigan and the United States, discriminate against any teacher with respect to wages, hours, and other terms and conditions of employment by reason of the teacher's membership or non-membership in the Association, the teacher's participation in any activities of the Association, collective professional negotiations with the Board, the teacher's institution of any grievance, complaint or proceeding pursuant to this Agreement, or otherwise to any terms and conditions of employment.

TEACHERS' RIGHTS AND RESPONSIBILITIES. 1. The teacher accepts responsibility to strive for excellence in teaching, and to take advantage of opportunities for continually improving his teaching skills and his relationships with children resources made available at or through the school. 2. Nothing in this Agreement shall be construed to deny or restrict a teacher's rights under the Michigan General School Laws or applicable civil laws or the Michigan Tenure Law or Public Act 379 of 1965, as amended. The rights granted in this Agreement are deemed to be in addition to those provided elsewhere. 3. The Local Association and its members shall have the right to use school building facilities at all reasonable hours for meetings subject to Board control, providing that they pay a custodial and maintenance fee for larger than local groups. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises. Bulletin boards and other established media of communication shall be made available to the Association and its members at the expense of the Association. A sign-out log will be provided in the Superintendent's office for the Association president to sign out dittos, xxxxx of paper, etc., to be used for any and all communications to the Association. Use of the teacher bulletin boards will be restricted in that no notices or calls for strikes or any other illegal activity shall be posted thereon.
TEACHERS' RIGHTS AND RESPONSIBILITIES. Section 1: Upon written request, each teacher shall have the right to review the contents of his/her personnel file located in the Central Administration Office. The teacher may request an Association member to accompany him/her in this review. Section 2: If an administrator conducts a conference for the purpose of disciplining a teacher orally or in writing, the teacher shall be notified of this purpose in advance so that the teacher will have an opportunity to request a witness of his/her choice to be present. In addition, any conference between an administrator and teacher resulting in formal disciplinary action against the teacher shall have as an integral part of its proceedings the right of either party to request a witness of his/her choice. For purposes of this section, formal disciplinary action shall be defined as demotion, suspension, or discharge of the teacher in question. Section 3: There will be no mandatory lunch room duty for teachers unless as a teaching assignment. Playground duty shall be assigned only during K-6 recess time and only if deemed necessary by the principal. Section 4: The negotiations committee of the Association shall be permitted a reasonable number of meetings to be held at the conclusion of the work day. Section 5: When a teacher is absent, the teacher is responsible for the preparation and submission of an emergency lesson plan which contains sufficient detail that a substitute teacher can reasonably be expected to carry on classroom instruction. This section shall not be construed to imply that a teacher is not responsible to prepare lesson plans for those days when the teacher is not absent. It is recognized that the nature and content of lesson plans prepared for the use of a substitute teacher are different than the nature and content of a lesson plan prepared by a teacher for his/her daily use. Section 6: It is the sole responsibility of the teacher to maintain his/her teaching certification. The certification a teacher has on file with the school district at the time a decision is made will govern. The certification of a teacher is on file with the school district if the teacher has filed with the school district either an appropriate teaching certificate issued by the Michigan Department of Education or written evidence from the teachers education college that the teacher has met the requirements for the certification according to Section 1535 of the School Code, MCL 380.1535. TEACHERS' RIGHTS AND RESPONSIBILITIES. A. The Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Association and its affiliates for the purpose of engaging in collective negotiations and other activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of New Jersey, the Board undertakes and agrees that it shall not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by Chapter 123, Public Laws of 1974, or other laws of New Jersey or the Constitutions of New Jersey and the United States. That it shall not take punitive action against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association and its affiliates, his/her participation in activities of the Association and its affiliates which do not conflict with normal professional duties, collective negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement, or otherwise, with respect to any terms or conditions of employment. B. Nothing contained herein shall be construed to deny or restrict to any teacher such rights as he/she may have under New Jersey School Laws or other applicable laws and regulations. C. Any disciplinary interviews and reprimands will be conducted in private. A teacher shall have the right, in all instances, to request the presence of an Association representative at said interview and when such request is made, the interview shall not proceed until the representative is in attendance. D. There shall be no public discussion concerning the renewal, failure to renew or termination of a teacher's contract by either the Board or the Association. E. Upon his/her professional judgment, the teacher shall maintain the right and responsibility to determine grades within the grading policy of the district. Teachers shall be involved in all decisions relating to promotion or retention of students. F. Any teacher, upon presentation of advanced written request, may inspect his/her personnel file.
