TEACHERS' RIGHTS AND RESPONSIBILITIES. 3.1 Discrimination against any teacher for participation in sanctioned union activity is prohibited. 3.2 Teachers shall have the right to join or not to join the WCEA. Neither the Board nor WCEA shall interfere with this right. 3.3 The Board and WCEA agree not to interfere with a teacher in the exercising of any rights granted under this agreement. 3.4 Teachers shall adhere to the Code of Ethics and the Principles of Professional Conduct for the education profession as prescribed by the State of Florida. 3.5 Teachers shall be entitled to the full right of citizenship as granted by the laws and constitution of the Xxxxx xx Xxxxxxx xxx xx xxx Xxxxxx Xxxxxx. 3.6 The Master Contract between the Xxxxxx County school Board and the Xxxxxx County Education Association will be placed and maintained by the Xxxxxx County School Board on the Xxxxxx County School District web site. 3.7 Teachers shall be given any new rules and/or regulations that apply to them before their implementation. 3.8 There shall be a uniform countywide disciplinary form available in each school for disciplinary purposes. Any referrals of a pupil by a teacher shall be made on such disciplinary forms and submitted to the principal or his designee. A copy of the action taken will be returned to the teacher within three (3) working days except in emergencies. 3.9 No disciplinary action which affects a teacher's employment and/or evaluation shall be taken against a teacher on the basis of a complaint by a parent, student, or other individual, until notice of such action is provided to the teacher. A. A teacher may be disciplined, including reprimand, reduction in compensation, suspension, involuntary transfer, or dismissal for proper cause as defined in Florida Statues, State Board Rules and School Board Policies. No teacher shall be reprimanded without just cause as defined in Florida Statutes, State Board Rules and School Board Policies. B. In any of the above matters, the teacher shall be permitted a representative of his/her choice, if desired. This article shall not limit in any way the exercise of the Board’s rights as provided in this agreement. C. Teachers must be notified in writing twenty-four (24) hours prior to being called in for a disciplinary interview that could lead directly to discipline of any kind. TEACHERS' RIGHTS AND RESPONSIBILITIES. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every member of the Association shall have the right to organize, join, and support the Association for the purpose of engaging in collective bargaining and negotiations, or to refrain from such activities. B. The Board specifically recognizes the right of the Association members to appropriately invoke the assistance of the Michigan Employment Relations Commission. C. The Association and its members shall have the right to use the school facilities after students have been dismissed, when cleared and scheduled according to the District Facility Use Policy. D. Upon approval the Association shall have the right to use facilities and equipment, including computers including software programs and email systems, printers, duplication equipment, calculating machines, and all types of audio-visual equipment at reasonable times, when such equipment is not in use for school business. The Association shall pay for the reasonable cost of all materials and supplies incident to such use. Association use of email and internet will be subject to the District’s acceptable use policies and user agreements. E. The school mailboxes may be used by the Association. F. The Board agrees to make available to the Association in response to reasonable request all general public information concerning the financial resources of the District. The Association agrees to specify, in writing, the information desired. The Association will reimburse the District for any costs associated with the request. G. The Board agrees to provide an Agenda of its regular Board meetings to the Association. H. The provisions of this Agreement and the wages, hours, terms, and conditions of employment shall be applied in a manner which is not arbitrary, capricious, or discriminatory, and without regard to race, creed, religion, color, national origin, age, gender, political affiliation, marital status or sexual orientation. Xxxxxxxx to the Michigan Public Employees Relations Act, the Board agrees that teachers employed by the District shall have every right to freely organize and support the Association for the purpose of engaging in collective bargaining or negotiations and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage, deprive or coerce any teacher in the enjoyment of any rights conferred by the Michigan Public Employment Relations Act, MCL 423.201; or the United States; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association, or collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under the Agreement or with respect to any terms or conditions of employment. B. Each teacher is responsible for maintaining the proper teaching certificate. C. The Board shall make available in each building, adequate lunch room, restroom, and lavatory facilities for teachers’ use and a room which shall be reserved for use as a faculty workroom and/or lounge. TEACHERS' RIGHTS AND RESPONSIBILITIES. 1. The teacher accepts responsibility to strive for excellence in teaching, and to take advantage of opportunities for continually improving his teaching skills and his relationships with children resources made available at or through the school. 2. Nothing in this Agreement shall be construed to deny or restrict a teacher's rights under the Michigan General School Laws or applicable civil laws or the Michigan Tenure Law or Public Act 379 of 1965, as amended. The rights granted in this Agreement are deemed to be in addition to those provided elsewhere. 3. The Local Association and its members shall have the right to use school building facilities at all reasonable hours for meetings subject to Board control, providing that they pay a custodial and maintenance fee for larger than local groups. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises. Bulletin boards and other established media of communication shall be made available to the Association and its members at the expense of the Association. A sign-out log will be provided in the Superintendent's office for the Association president to sign out dittos, xxxxx of paper, etc., to be used for any and all communications to the Association. Use of the teacher bulletin boards will be restricted in that no notices or calls for strikes or any other illegal activity shall be posted thereon.
TEACHERS' RIGHTS AND RESPONSIBILITIES. A. No teacher shall be warned (either verbally or in writing), reprimanded, docked, or suspended without just cause. A teacher shall be entitled to have present a representative of the Association during any disciplinary action when such action will become part of the teacher's personnel file. The Board subscribes to the concept of progressive discipline. The progressive discipline steps include verbal warning, written warning, suspension with or without pay and discharge. The steps may vary depending on the seriousness of the offense. B. Notwithstanding their employment, teachers shall be entitled to full rights of citizenship. The private and personal life of any teacher is not within the appropriate concern or attention of the Board, unless such interferes in any way with his professional service. If such conduct does exist the Administration agrees to consult with the Association prior to taking any action. C. A telephone shall be made available to teachers in the faculty lounge for their reasonable use. The Building Principal must approve toll calls outside the District. Personal toll calls shall not be charged to the school district. X. Xxxxxx shall be applied according to the provisions of the State Teacher Tenure Law. E. Teachers are responsible to volunteer or accept invitations to serve on committees established by the School Administration to insure and promote the legitimate, student oriented objective of the School District. The Board recognizes that the demands of such activities can become excessive and recognizes that teachers may have legitimate professional or personal reasons for declining to serve on such committees. In such cases the Board will honor the wishes of the teacher. F. Each teacher shall be responsible for maintaining his/her proper teaching certification. G. Teachers shall be expected to dress in reasonable attire consistent with the teaching profession. H. Teachers shall be responsible for the supervision of students between the passing of classes. For the purposes of implementing this section, it is understood by both parties that supervision of students will routinely be done by the classroom teacher from the classroom entranceway. The Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Association and its affiliates for the purpose of engaging in collective negotiations and other activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of New Jersey, the Board undertakes and agrees that it shall not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by Chapter 123, Public Laws of 1974, or other laws of New Jersey or the Constitutions of New Jersey and the United States. That it shall not take punitive action against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association and its affiliates, his/her participation in activities of the Association and its affiliates which do not conflict with normal professional duties, collective negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement, or otherwise, with respect to any terms or conditions of employment. B. Nothing contained herein shall be construed to deny or restrict to any teacher such rights as he/she may have under New Jersey School Laws or other applicable laws and regulations. C. Any disciplinary interviews and reprimands will be conducted in private. A teacher shall have the right, in all instances, to request the presence of an Association representative at said interview and when such request is made, the interview shall not proceed until the representative is in attendance. D. There shall be no public discussion concerning the renewal, failure to renew or termination of a teacher's contract by either the Board or the Association. E. Upon his/her professional judgment, the teacher shall maintain the right and responsibility to determine grades within the grading policy of the district. Teachers shall be involved in all decisions relating to promotion or retention of students. F. Any teacher, upon presentation of advanced written request, may inspect his/her personnel file. TEACHERS' RIGHTS AND RESPONSIBILITIES. Section 1 Acknowledgment of Legal Rights Nothing contained herein shall be construed to deny or restrict to any teacher rights he/she may have under the Michigan General School Laws and regulations. Section 2 Personnel File Each teacher shall have the right, upon written request, to review his/her personnel file, which shall be kept in the central administration offices, in the presence of a witness, but such file shall not be removed from the office where it is kept. The teacher shall have access to his/her tenure evaluations, principal or other administrator evaluations, complaints, transcripts of college credits, and all other items. Access to the file shall be limited to the teacher and administrators unless written consent is given by the respective teacher. Upon request, a copy of any material placed in a teacher’s personnel file shall be given to the teacher, at his/her expense, so long as said requests do not exceed two (2) per year. No material derogatory to a teacher’s conduct, service, or character shall be placed in the file unless the teacher has had the opportunity to read, discuss and initial the material. The teacher shall have the right to answer any material and his/her answer shall be inserted into the file. The teacher’s initials do not mean that he/she agrees with the content of said item, only that he/she has read it. If a teacher refuses to initial the material, the refusal shall be noted and the Association shall be advised of the refusal. The item shall then be placed in the personnel file. A teacher may request the removal of any derogatory material placed in his/her personnel file and such request may be granted at the discretion of the Superintendent. Upon the teacher’s request, all derogatory material placed in the personnel file shall be removed and destroyed no later than four (4) years after the date of insertion.
