UNPAID PERSONAL LEAVES OF ABSENCE. 1. Any employee may apply for an unpaid personal leave of absence for good and sufficient reason. Leave pursuant to this provision may be for a period not exceeding twelve (12) months in any fourteen (14) consecutive months. Such leave may be granted at the discretion of the appointing authority and shall not be unreasonably denied. Employees are encouraged to consult with their agency/department Personnel Officer to determine if they are eligible for benefits available under the Federal Family and Medical Leave Act. All requests for such leave and responses shall be in writing. The application for leave must specifically state the reasons for such application and the length of time requested. After completion of a period of personal leave of absence, the employee shall be entitled to return to the organizational unit, status and position held immediately prior to the beginning of the leave of absence. If the employee's position is abolished during any such leave, he/she shall be notified and allowed to exercise his/her rights under the Seniority Article of this Agreement.
2. A leave of absence without pay and without loss of seniority not to exceed one (1) year may be granted to an employee to permit the employee to accept a position in State service that is excluded from bargaining units under

Except as provided in the Seniority Article, if an employee is laid off from an excluded position for reasons beyond his/her control after the expiration of said one (1) year leave, he/she shall at his/her request be placed on any reemployment registers for which he/she is eligible. Upon reemployment he/she shall be credited with the seniority earned up to the start of the leave granted pursuant to this Article.
4. Any employee currently on leave of absence from a position in this bargaining unit under Personnel Rule, Chapter 11, Section 3C shall be continued on such leave through the end of his/her current coterminous or fixed term appointment or for one (1) year from the effective date of this Agreement if he/she is serving in a position which does not involve a fixed or coterminous term. An employee on leave for a fixed term or coterminous appointment may upon application have such leave extended for up to three (3) months pending reappointment to such excluded position.

UNPAID PERSONAL LEAVES OF ABSENCE. Lists of employees by seniority in their current classifications within an organizational unit shall be posted on the appropriate MCC System bulletin boards as soon as practicable after execution of this Agreement and shall be provided to MSEA simultaneously. These lists shall be updated from time to time as necessary.
UNPAID PERSONAL LEAVES OF ABSENCE. 19.1 For justifiable reasons and upon recommendation of the Department Head and approval of the Human Resources Director, an employee may be granted a personal leave of absence without pay for a period of up to six months. Authorization for such leave must be in writing and signed by the Department Head and the Human Resources Director. In cases of extreme hardship, an extension of up to six months may be granted at the discretion of the Employer. The Employer shall have the right to fill a position vacated by a Personal Leave of Absence for greater than 120 days with a temporary employee, should this be necessary.
19.2 During the period of absence the employee shall not engage in gainful employment outside of Midland County. Violation of this provision may warrant immediate discharge and complete loss of seniority rights for the employee involved.

ETO benefits to be used before 17 ESDP benefits. ESDP leave under Hospital policy may not be used 18 for time off work due to dependent care, or parental, educational, or 19 military leaves. It is recognized that a spouse or dependent illness, 20 accident, or death may be sufficiently serious to cause a medical 21 condition to an RN that would qualify the RN for ESDP use (medical 22 verification may be required. 23 24 Nurses returning from a personal medical leave of absence may be 25 requested to have a medical examination by a physician designated 26 by the Hospital and at the Hospital’s expense. 27

UNPAID PERSONAL LEAVES OF ABSENCE. It is recognized that Employees may request leave from their jobs for personal reasons other than medical. The Employer shall attempt to accommodate such requests based on the merits of the leave and the best interest of the City. The Employees past record and the purpose for which the leave is requested shall be considered for granting such leave. During such leave period whereby an Employee is not paid at least two (2) weeks in any month, the accrual of vacation and sick leave shall cease and the Employee shall pay the cost of health and life insurances.
UNPAID PERSONAL LEAVES OF ABSENCE. A. General Provisions of Unpaid Personal Leaves of Absence
1. The Employer and the Association will comply with all provisions of the Family and Medical Leave Act (FMLA), Uniformed Services Employment and Reemployment Rights Act (USERRA), and all other laws and regulations governing protected leaves of absence.
2. Personal leave requests will be considered only after the employee has two (2) consecutive years of service with Employer.
3. Except as specifically provided, no payment of any kind will be made to or for any employee on a leave covered by this provision nor will any benefits of any kind accrue to any employee on a leave covered by this provision.
B. Types of Unpaid Personal Leaves
1. Extended Health Leave
a. Leave extensions will be granted only upon recommendation of the President and approval of the Board of Trustees.
b. Failure to request extension or submit intention to return will constitute termination of leave. Failure to secure extension of leave or to return to employment will constitute just cause for termination of employment.
c. Payment for accumulated sick leave days may not be granted during the term of such leave.
d. An employee absent on personal leave shall receive credit for any regularly scheduled salary increases granted, excluding increments, and shall also be subject to any general salary adjustments.
UNPAID PERSONAL LEAVES OF ABSENCE. A one (1) year leave of absence may be granted without pay and fringe benefits at the discretion of the Board.
1. Each teacher on any approved leave of absence shall notify the Board, in writing, not later than March 1 if s/he intends to return to employment with Board for the next school year immediately following said leave. Failure to supply such notice shall relieve the Board of any obligation to return the teacher to work.
2. The teacher shall be entitled to return to his/her same position when it is available or the first available comparable position for which s/he is qualified subject to provisions of the Tenure Act.
3. When an employee is granted such a leave of absence, s/he shall, upon re-employment, retain the following employment rights held by him/her before such leave was granted:
a. Unused sick leave held at the start of the leave of absence.
b. The regular salary increment occurring during such period shall be allowed.
4. Unpaid personal leaves may be granted for the following purposes:
A. Exchange/Work Programs: Participation in exchange teaching programs in other states, territories, or countries, foreign or military teaching programs, the Peace Corps, Teachers’ Corps, or Job Corps as a full time participant in such program; or a cultural travel or work program related to his professional responsibilities; provided said teacher states his/her intention to return to the school system. Such leave shall commence prior to the beginning of or at the conclusion of a school year. A renewal of said leave shall be at the discretion of the Board.
B. Campaign/Public Office: Campaigning for himself/herself or serving in an elected public office. Such leave shall commence prior to the beginning of or at the conclusion of a school year. A renewal of said leave shall be at the discretion of the Board.

Nurses returning from a personal medical leave of absence may be requested to have a medical examination by a physician designated by the Hospital and at the Hospital’s expense. After two (2) years seniority and once every two (2) years thereafter, a regular status nurse may request a maximum of five (5) weeks personal leave of absence where staffing permits. This personal leave may be extended up to an additional eight (8) weeks by mutual agreement of the Hospital and nurse. A short-hour (Code 3) RN may request a leave of absence under similar terms as regular status RNs. Articles 9.6 and 12.1 apply to such leaves. A short-term disability plan, which includes coverage for pregnancy-related disabilities as well as other disabilities, is available to eligible employees.
