Catastrophic Sick Leave. Employees may continue to participate in the management Catastrophic Sick Leave bank upon the same terms as management employees. Donations of sick leave to the Catastrophic Sick Leave Bank shall be combined with Catastrophic Sick Leave donations from the management group. The District and the Coalition shall each select two representatives to serve on the Catastrophic Sick Leave Committee. The Committee shall be convened within five days of an employee’s request to use Catastrophic Sick Leave. The Committee shall determine whether the requesting employee is eligible for such use, as set forth in the Management Catastrophic Leave Bank guidelines, which are attached as Appendix “F” and incorporated by reference as part of this Contract.
Catastrophic Sick Leave. 10.2.1 The District shall maintain an RBTA Catastrophic Leave Bank. This Catastrophic Leave Bank shall be maintained to provide paid leave to bargaining unit members who have exhausted all earned sick leave as described in Section 10.1 above who are suffering from catastrophic illnesses or injuries as verified by a physician and are not receiving benefits provided by any income protection insurance program. Catastrophic leave shall also be available to unit members who need to care for an immediate family member who is suffering from a catastrophic illness or injury as verified by a physician. The District shall provide the Association upon request a statement of activity on the bank for the prior month as well as the monthly ending balance of days in the bank. 10.2.2 A probationary or permanent unit member may donate up to five (5) days of sick leave per year to the Catastrophic Leave Bank described in Section 10.2.1 above. Such donations shall be irrevocable. Sick leave which is donated under this section shall be deducted from the accrued sick leave authorized under Section 10.1 above. A bargaining unit member who wishes to donate sick leave shall execute an authorization for the donation of the sick leave and an assignment of the leave to the leave bank This authorization must confirm the understanding that the donation of sick leave to the Catastrophic Leave Bank is voluntary and irrevocable. The authorization must further indicate unit member agreement to indemnify and hold the District and the Association harmless from any claims, demands, or causes of action related to the donation. Solicitations for donations to the Catastrophic Leave Bank shall be the sole responsibility of the Association. 10.2.3 A catastrophic illness or injury shall be defined by Education Code Section 44043.5. The District and the Association reserve the right to amend the definition of a catastrophic illness or injury upon mutual agreement. The use of catastrophic leave by a bargaining unit member shall be by mutual agreement of the District and the Association. 10.2.4 While utilizing the Catastrophic Leave Bank, a unit member shall be deemed to be on a paid sick leave. One donated day, when combined with one day of substitute differential pay, shall cause said unit member’s daily rate of pay to remain at 100%. Catastrophic Sick Leave. 3.12.1 Employees in the bargaining unit may donate eligible sick leave to any classified employee in the District when that employee or a member of his/her family suffers from a catastrophic illness or injury. Catastrophic illness or injury means an illness or injury that is expected to incapacitate the employee or a family member for an extended period of time. Eligible sick leave credit shall be granted under the following conditions: 3.12.1.1 The employee presents medical verification (as defined in G.C. 12945.2) for himself/herself or for his/her family member (as defined in G.C. 12945.
Catastrophic Sick Leave. Definition: Catastrophic Leave is intended for exceptional and demonstrable 15 hardship case, and is not to be considered or treated as a routine extension of paid 16 status for employees who have, by previous absences, exhausted their sick leave 17 and vacation leave. Catastrophic Sick Leave a. An employee shall not be entitled to use Catastrophic Sick Leave days before they are earned. b. Employees may not accumulate more than 1,200 hours pay within the Catastrophic Sick Leave Bank. The maximum number of Sick Leave hours that may be used at any one time is the number necessary to carry the employee through the 90 consecutive calendar day qualification period for long-term disability. c. Catastrophic Sick Leave Bank may be utilized when the employee’s PTO bank balance reaches a level of 40 hours or less, for the following purposes: 1) The employee’s illness, accident, or hospitalization; or 2) Illness, accident or hospitalization of a member of the immediate family (up to a maximum of two days per year for family care). d. Catastrophic Sick Leave days will not be applied to an illness or injury resulting from the performance of services for the Employer, which are covered by the provisions of the Worker’s Compensation Act. e. The Employer reserves the right to require written authentication of illness from a physician prior to granting the use of sick days. Cost of such authentication shall be the responsibility of the employee. f. An employee within the bargaining unit may, each contract year, donate up to 16 hours of accumulated Catastrophic Sick Leave Pay to no more than two other unit members who are off work for an illness or injury and have used all available compensation.
Catastrophic Sick Leave. 7.4.1 The board will provide 15 days yearly for certified employees to use as employee catastrophic sick leave and 5 days yearly for employees to use as immediate family catastrophic sick leave. The combined number of days will not exceed these 15 days and 5 days, respectively, in any given school year for all certified employees. Catastrophic sick leave will not accumulate from year to year. 7.4.2 Illness or injury of a staff member or immediate family that is catastrophic in nature may be reasons for use of catastrophic sick leave. 7.4.3 Application of this leave must be initiated in writing through the superintendent to the business manager no later than thirty days after the teacher’s paid leave days are exhausted or the end of the catastrophic illness or injury, whichever is earlier. 7.4.4 Upon receipt of an application for catastrophic sick leave, a committee shall be formed. This committee shall be composed of five voting members and one non-voting member. The five voting members would be two school board members, one elementary teacher, one middle school teacher, and one high school teacher. The business manager would be the non-voting member. Appointment of the board members to the committee will be made by the school board president. Selection of the teachers to the committee would be made by the representative bargaining unit. The discussion and decision of this application will be done in executive session and confidential. The committee would require a majority vote to approve catastrophic sick leave. 7.4.5 When an employee applies for employee catastrophic sick leave: 7.4.5.1 All remaining sick leave days must be used before catastrophic sick leave days are paid beyond sick leave days. 7.4.5.2 All remaining personal leave days must be used before catastrophic sick leave days are paid. 7.4.6 When an employee applies for immediate family catastrophic sick leave: 7.4.6.1 All remaining family sick leave days must be used before catastrophic sick leave days are paid beyond family sick leave days. 7.4.6.2 All remaining personal leave days must be used before catastrophic sick leave days are paid. 7.4.6.3 Immediate family includes spouse and or children.
Catastrophic Sick Leave. An employee, or eligible dependent as defined below, who is suffering from a catastrophic illness or injury may request donations of accrued sick leave credits under the District’s Catastrophic Leave program, as detailed below.

For purposes of Catastrophic 16 Illness/Injury, a member of the employee’s family will be limited to spouse, 17 children, mother, father, or an individual over which the employee has legal 18 guardianship.
Catastrophic Sick Leave. A catastrophic illness or injury is defined as a serious debilitating illness , injury, impairment, or physical or mental condition that is present for a minimum of three consecutive work days, and that involves: • A period of illness, injury or treatment connected with impatient care (e.g., overnight stay) in the hospital, hospice, or residential medical care facility; and that also involves continuing treatment by (or under the supervision of) a licensed heath care provider; or • A period of illness or injury (or treatment) due to a chronic serious health condition (e.g., asthma, diabetes, epilepsy, etc.)that requires the employee to be absent from work at least three consecutive scheduled work days; or • A period of illness or injury that is long term due to a condition for which treatment may be ineffective (e.g., stroke, terminal disease, etc) and that requires the employee to be absent from work for at least three consecutive scheduled work days; or • An illness or injury which requires multiple treatments (including any period of recovery time there from) either for restorative surgery after an accident or other injury, for a chronic condition, i.e.,cancer or kidney disease. Catastrophic sick leave for illness or injury may be used for the employee as well as the employee’s child, spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent, or stepparent. Employees must promptly provide an appropriate verification of a catastrophic illness or injury or catastrophic event to his/her Department Head of designee (e.g., medical certification of an employee’s illness) An officer having exhausted all accumulated sick time and other paid leave may request up to two hundred (240) additional sick leave hours. Catastrophic illness or injury is considered to be a non-duty related illness or injury which would cause an employee to be off for a period of time without pay that would cause a financial hardship. The first one hundred twenty (120) hours shall be borrowed from an employee’s anticipated sick time. The last one hundred twenty (120) hours shall be provided by the City. In the event that sick time is utilized in relation to a catastrophic illness or injury as defined in Section 11.4 sick leave shall be calculated at the rate of 8 hours a day regardless of the length of shift (8 or 12).
