COMPENSATORY TIME OFF AND OVERTIME. Section 1. NDWA provides Compensatory Time Off (“Comp Time”) to allow bargaining unit employees time to rest and recharge in accordance with the provisions of this Article. Only exempt employees are eligible for Comp Time. Section 2. When an employee engages in at least four (4) continuous hours of approved travel, attendance at meetings, or other work assigned by their supervisor above a 40-hour workweek based on actual hours worked and not a routine part of the employee's usual job responsibilities, the employee is eligible for A. One (1) hour off for each hour worked between four (4) to eight (8) continuous hours that is eligible for Comp Time, and
COMPENSATORY TIME OFF AND OVERTIME. 7.5.1 All non‑attorney employees covered by California Labor Code Overtime Rules and authorized by the employer to work beyond seven (7) hours in a workday, or thirty‑five (35) hours in any week, exclusive of lunch hours, shall receive compensatory time off for all additional hours worked up to eight (8) hours in a day, or forty (40) hours per week. Those employees shall accrue compensatory time at the rate of one and one-half (1 ½) times the additional hours worked. 7.5.2 All non‑attorney employees covered by California Labor Code Overtime Rules and authorized by the employer to work beyond eight (8) hours in a day, or forty (40) hours in any week, exclusive of lunch hours, shall be paid for all additional hours worked at the rate of one and one‑half (1 1/2) times their base rate, with the exception of those hours worked in excess of twelve in a day, which shall be paid at two (2) times their base rate. An employee's base rate is determined by taking his or her weekly salary, exclusive of premiums (e.g. bilingual supplement), and dividing that weekly salary by thirty‑five (35) hours. All overtime must have the prior approval of the employer. 7.5.3 There shall be no pyramiding or duplication of overtime or premium pay. 7.5.4 Attorneys shall be entitled to receive compensatory time off for hours worked in excess of the regularly scheduled number of hours for a pay period (net per pay period), exclusive of lunch periods up to a maximum of 105 hours in any calendar year. Those employees shall accrue compensatory time off at a rate of one (1) times the additional hours worked. 7.5.5 Attorneys required to staff NLSLA mandated clinics for: Foreclosure, EITC, Workers’ Rights or Immigration and who take time off to compensate for longer work hours on “clinic days” will not have the time off taken counted against the 105 hour comp time cap. To utilize this provision, Attorneys must take the time off within the same work week as the week in which the NLSLA clinic is held. 7.5.6 Compensatory time shall not be carried over by attorneys from one calendar year to the next in excess of 105 hours. For purposes of this article, the twelve month period shall run from January 1 through December 31. No pay shall be provided for compensatory time not taken. 7.5.7 No employee may use more than 105 hours (3 weeks) of compensatory time off in any calendar year. COMPENSATORY TIME OFF AND OVERTIME. All hours worked in excess of eight and one-quarter (8 ¼) hours on a regular workday and all hours worked on an off day, including court time and training shall be compensated in pay or compensatory time off on a time and one- half basis. Employees called in for duty outside of their scheduled workweek shall be credited with at least two (2) hours each time they are called in for duty, regardless of the time worked. The maximum accumulation of compensatory time off for any employee at any one time shall be forty (40) hours, except that the Police Chief or designee may exercise discretion to allow an accumulation in excess of forty (40) hours. Such requests shall be in writing and the Police Chief or designee shall have the right to deny any request for compensatory time off, however, in no instance may an employee be allowed to take compensatory time off on a day which does not leave at least seven (7) employees on the schedule. Employees shall be allowed to carry over up to twenty-four (24) hours of compensatory time left on the books at the end of the year provided that any time carried over may only be taken as off-time and cannot be cashed out. If the number of consecutive or required mandatory training days should increase, so that Officers off-day(s) are affected, overtime will be paid at a time and one-half rate, to be utilized as compensatory time off only. The guideline for this will be the minimum mandatory required training set by the State of Wisconsin Training and Standards Board. B. Training or schooling of a specialized nature that is requested or voluntarily attended by an officer will not have overtime paid for affected off-day(s). If the training or schooling is granted, the Chief or his designee will alter the off-day(s) or off-time so as to have the least affect on the scheduling of other Officers, and off-day(s) or off-time will be repaid within a four-week time frame on the work schedule. C. Training for accepted voluntary assignments, i.e., M.E.G. Unit, SRT, or other such assignments that may be designated by the Chief or his designee, will not allow for overtime pay on off-days(s) or off-time.
