The following is intended to define the normal hours of work for the full time employeesbut shall not be interpreted as a guarantee of hours of work per day or per week, or of days of work per week. The normal workweek shall beforty-four (44)hours a week, ten (10)hours per day for a total of forty-four (44)hours per week dependingon the time schedule or shift arrangement of such employee. An employeeshall receive payment at the rate of one and one-half times regular hourly rate for all work performed on any of the set out in Article in addition to any holiday pay to which he may be entitled. Night shift premiums shall be considered part of the regular hourly rate for employees who normally receive these premiums. The Company will endeavour to distribute the opportunity to work overtime on an equitable basis among the employees in the applicable job classification. No disciplinary action can be taken against any employee for refusing to work overtime for a legitimate and reasonable explanation which shall be given in advance to the Company. If any employee is asked to work overtime on any scheduled day off, such overtime shall be for a minimum of four (4)hours. Employeeswho work will not be requiredto take time off in regular hours to make up for overtime worked but may take time off equivalent to overtime by mutual agreement. Schedules of work for a four (4) week period will be posted at least two (2) weeks prior to the effective date of the schedule. Such posted schedules shall not be changed unless by mutual agreement between the Employer and employees so affected, or so as to allow the mutual exchanging of shifts between employees. The mutual exchange of shifts between employees will be allowed, whenever possible, providing however, that the request be written on the appropriate management form no later than four (4) days prior to such change, except in cases of emergency. The employer shall not be responsible for overtime claims and non compliance with the above provisions that might arise or accrue as a result of the exchange of shifts.
