Declaration In the event of a decline in enrollment, reorganization, or budget reduction in U.S.D. 323 during any school year, the Board, on or before May 1, may declare that the staff reductions will be made effective at the start of the fall semester of the next succeeding academic year.
REDUCTION IN TEACHING STAFF. 25.07.1 The BOARD may reduce the teaching staff positions because of financial reasons, decreased enrollment of pupils, return to duty of regular Professional Staff Members after leaves of absence or by reason of suspension of school, reorganization, or territorial changes affecting the District. In making such reduction, the BOARD will proceed to suspend contracts in accordance with the recommendation of the Superintendent of Schools, who will, within each teaching field affected, give preference to Professional Staff Members on continuing contracts and to Professional Staff Members who have greater seniority with comparable evaluations. Comparable evaluations shall be defined as professional staff members who are assigned an effectiveness rating in each of the following categories: ineffective; developing; skilled; and accomplished. The BOARD shall give preference to Professional Staff Members with greater seniority when making a decision between teachers who have comparable evaluations.

Inadequate Budget Funding 21 U.S.D. 323 NEGOTIATED AGREEMENT PREAMBLE The Board of Education, on its own behalf and on behalf of the electors of the school district, hereby retains and reserves unto itself, without limitation, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it by the Laws and Constitution of the State of Kansas and of the United States. The exercise of the powers, rights, authority, duties, and responsibilities by the Board; the adoption of policies, rules, regulations, and practices in furtherance thereof; and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of the agreement, and then only by the specific and express terms of the agreement, and then only to the extent such specific and express terms thereof are in compliance with the Constitution and Laws of the State of Kansas and the Constitution of the United States. REDUCTION IN TEACHING STAFF. The Board of Education has the sole and exclusive prerogative to eliminate professional staff positions consistent with the provisions of statute, providing such elimination does not result in the failure in its duty as a state agency to implement the educational interests of the state, and to provide good public elementary and secondary schools. Elimination of professional staff positions may result from decreases in student enrollment, changes in curriculum, financial conditions, or other circumstances as determined by the board of education. Professional staff members’ contracts will be terminated under this policy only when authorized by the Board of Education.

REDUCTION IN TEACHING STAFF. 534 In the event the board decides that the size of the teaching staff must be reduced, these guidelines shall be 535 followed. 536 Reductions in licensed staff may be required due to decreasing enrollments, changes in financial support, 537 changing programs or other factors and shall be in accordance with the educational goals established by the 538 board. When possible, the normal procedures of resignations, retirements, and other methods of attrition of 539 staff will be used to accomplish such reductions. 540 If the necessary staff reductions cannot be accomplished through normal attrition, the superintendent will 541 recommend to the board the names of those teachers to be non-renewed. Dates of notification shall correspond 542 with those of the continuing contract law. 543 The process of selecting teachers for non-renewal will also involve consideration of (not listed in order of 544 importance): performance evaluations, skills, contribution to extra-curricular programs, educational goals and 545 needs of the district, areas of licensure which may be required to maintain school district accreditation, special 546 qualifications that may require specific training and/or experience, and state and federal regulations which 547 may mandate certain employment practices. 548 If two or more teachers have the same years of service, licensure, qualifications, training, skills, and 549 evaluations in a teaching area deemed necessary to fulfill the district's educational goals, the superintendent 550 will recommend the tenured teacher, if any, for the position in question. If all of the teachers have the same 551 number of years of service, licensure, qualifications, training, skills, and evaluations and all are tenured, the 552 teacher(s) who best meet(s) the needs of the district considering the factors outlined above will be retained. 553 Where a determination based on the foregoing criteria cannot be made, length of uninterrupted service 554 shall be considered as an additional factor and part-time or non-tenured teachers shall have the lowest priority 555 for retention. 556 Those teachers who have not been reemployed as a result of a reduction-in-force shall be considered as 557 "released with honor" and shall be considered for reemployment with the district for a period of two years 558 following the date of non-renewal when vacancies occur for which they are qualified.
