REDUCTION IN TEACHING STAFF. In the event the Board decides that the size of the teaching staff must be reduced, guidelines in this policy shall be followed. Insofar as possible, reduction of staff shall be accomplished by attrition due to resignations and retirement. The following steps will be utilized by the district’s administrative staff to reduce the teaching staff:
1. To determine the number of teaching positions to be reduced, the administrative staff will ascertain the educational program for the district to meet the educational goals established by the board. The number of teachers needed to implement the district’s educational program will then be determined by the administrative staff based on those educational goals as determined by the Board.
2. All teachers will be evaluated in relation to the educational goals of the district. Individual qualifications and specific skill areas or disciplines shall be ascertained and applied to the teacher needs of the district. Evaluation forms, instruments or tools will be used to measure each staff member’s teaching ability. Seniority, prior evaluations, certification, and teaching experience in assigned areas shall also be considered.
3. In the event two or more teachers have similar qualifications and skills in a teaching area deemed necessary to fulfill the district’s educational goals, the superintendent may recommend the tenured teacher, if any, for the position in question. A qualified tenured teacher shall be retained over a non-tenured teacher.
4. Any certified employee who has not been re-employed as a result of reduction of the teaching staff shall be considered for re-employment if a vacancy exists for which the teacher would qualify. The superintendent will recommend to the Board reinstatement of any such teacher whom he deems qualified and able to serve the best interests of the district. The Board shall not be required to consider reinstatement of any such teacher after a period of one year from the date of non-renewal.

REDUCTION IN TEACHING STAFF. 25.07.1 The BOARD may reduce the teaching staff positions because of financial reasons, decreased enrollment of pupils, return to duty of regular Professional Staff Members after leaves of absence or by reason of suspension of school, reorganization, or territorial changes affecting the District. In making such reduction, the BOARD will proceed to suspend contracts in accordance with the recommendation of the Superintendent of Schools, who will, within each teaching field affected, give preference to Professional Staff Members on continuing contracts and to Professional Staff Members who have greater seniority with comparable evaluations. Comparable evaluations shall be defined as professional staff members who are assigned an effectiveness rating in each of the following categories: ineffective; developing; skilled; and accomplished. The BOARD shall give preference to Professional Staff Members with greater seniority when making a decision between teachers who have comparable evaluations.
25.07.2 Professional Staff Members, whose continuing contracts are suspended, will have the right of restoration to continuing service status in the order of comparable evaluations if and when teaching positions become vacant or are created for which any of such Professional Staff Members are or become qualified.
25.07.3 After giving recall rights to eligible Professional Staff Members with continuing contract status, Professional Staff Members whose limited contracts have been suspended because of a reduction in force shall have the right to recall as follows:
A. Recall rights shall be limited to thirty-six (36) months and commence on the day following the employee's last day of work.
B. Professional Staff Members with comparable evaluations whose limited contracts were suspended shall be recalled to a vacancy in the inverse order of suspension as positions become available in their area(s) of certification license. Professional Staff Members whose contracts have been suspended must notify the District in writing of any changes in their area(s) of certification license. Inadequate Budget Funding 20 The Board of Education, on its own behalf and on behalf of the electors of the school district, hereby retains and reserves unto itself, without limitation, all powers, rights, authority, duties, and responsibilities conferred upon and vested in it by the Laws and Constitution of the State of Kansas and of the United States. The exercise of the powers, rights, authority, duties, and responsibilities by the Board; the adoption of policies, rules, regulations, and practices in furtherance thereof; and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of the agreement, and then only by the specific and express terms of the agreement, and then only to the extent such specific and express terms thereof are in compliance with the Constitution and Laws of the State of Kansas and the Constitution of the United States. This agreement shall govern the rights, as provided in this agreement, of the Board of Education (Board) and Rock Creek Educators (RCE) during the effective period from July 1, 2017 through June 30, 2018. This agreement, together with all terms, conditions, and effects thereof, shall expire on June 30, 2018. This agreement shall not be extended orally, and it is expressly understood that it shall expire on the date indicated. All negotiated items shall continue in force for one year and then automatically expire unless renegotiated and approved by the Board and teachers’ negotiating unit.
REDUCTION IN TEACHING STAFF. 3. In the event two employees have exactly the same index, the employee with the longer continuous full time service to the district shall be retained. If the index is equal, and the years of service are equal, the Board of Education shall make the final determination.
4. No teacher shall be RIF’d as a result of race, creed, color, religion, age, national origin, sex domicile, marital status, membership in the Association or participation in the negotiation process.
REDUCTION IN TEACHING STAFF. 1. In the event of conditions necessitating a reduction in the number of teachers employed by the Board, the following procedure shall be followed:
a. If a reduction in staff is necessary, teachers with the least amount of continuous service under a regular teacher’s contract in this school corporation shall be laid off first within their area of certification. Service under a regular teacher’s contract does not include service under supplemental, temporary, substitute, and/or other contract.
b. Those holding limited licenses will be subjected to layoff before those holding standard licenses in the area of certification regardless of service credit unless a waiver is agreed to by the Joint Communications Committee.
c. Elementary teachers with multiple certifications who are protected from layoff in one area of certification may not transfer to another area of certification if there are qualified teachers for that area in layoff status. Teachers protected from layoff due to multiple certifications must teach in those areas the following school year. If no one qualified for a vacancy remains on a recall list and/or there are no bounce- back rights for that vacancy, and if there is a vacancy in the area of the multiple certification of the teacher, the teacher may leave the protected area after all contractual processes for filling that vacancy are followed.
2. Service shall commence to accumulate the date the Board approved the individual teacher contract or the date the teacher starts to teach, whichever is earlier, and shall continue to accumulate during approved leaves of absence and layoffs due to staff reductions as provided in this section. If more than one teacher commenced service on the same date, the following procedure will be used to break the tie:
a. The sum of the last four digits of the social security number will be added. The higher sum of the two is granted the greater seniority.
b. If an additional tiebreaker is needed, representatives of FWCS and FWEA will draw lots with the first drawn granted the greater seniority.
3. The Association shall receive the proposed list of teachers to be subjected to a reduction-in-force no later than five (5) school days prior to notification of the bargaining unit members of his/her reduction. REDUCTION IN TEACHING STAFF. 534 In the event the board decides that the size of the teaching staff must be reduced, these guidelines shall be 535 followed. 536 Reductions in licensed staff may be required due to decreasing enrollments, changes in financial support, 537 changing programs or other factors and shall be in accordance with the educational goals established by the 538 board. When possible, the normal procedures of resignations, retirements, and other methods of attrition of 539 staff will be used to accomplish such reductions. 540 If the necessary staff reductions cannot be accomplished through normal attrition, the superintendent will 541 recommend to the board the names of those teachers to be non-renewed. Dates of notification shall correspond 542 with those of the continuing contract law. 543 The process of selecting teachers for non-renewal will also involve consideration of (not listed in order of 544 importance): performance evaluations, skills, contribution to extra-curricular programs, educational goals and 545 needs of the district, areas of licensure which may be required to maintain school district accreditation, special 546 qualifications that may require specific training and/or experience, and state and federal regulations which 547 may mandate certain employment practices. 548 If two or more teachers have the same years of service, licensure, qualifications, training, skills, and 549 evaluations in a teaching area deemed necessary to fulfill the district's educational goals, the superintendent 550 will recommend the tenured teacher, if any, for the position in question. If all of the teachers have the same 551 number of years of service, licensure, qualifications, training, skills, and evaluations and all are tenured, the 552 teacher(s) who best meet(s) the needs of the district considering the factors outlined above will be retained. 553 Where a determination based on the foregoing criteria cannot be made, length of uninterrupted service 554 shall be considered as an additional factor and part-time or non-tenured teachers shall have the lowest priority 555 for retention. 556 Those teachers who have not been reemployed as a result of a reduction-in-force shall be considered as 557 "released with honor" and shall be considered for reemployment with the district for a period of two years 558 following the date of non-renewal when vacancies occur for which they are qualified.
