Union Membership and Security. A) Employees of Champion Township Fire Department have the right to join or not to join the Union as they may choose. B) Employees of the Bargaining Unit who have completed their initial probationary period and who are not members of IAFF local 2948 shall, as condition of employment, pay a monetary service charge hereinafter referred to as “fair share fee,” which shall be certified by the Secretary-Treasurer of IAFF local 2948, April 1st of each year. Such fee shall be deducted by Employer and remitted during the same period as IAFF dues. Such deduction shall not require non-member written authorization. C) Any individual employee objection to payment of the fair share fee based upon bona fide religious tenets or teachings of a church or religious body of which such Employee is a member, will require such Employee to notify the Employer and the Union of his/her objection and provide proof of same. Within thirty (30) calendar days of notification, the Employee will meet with representatives of the Union and establish a satisfactory arrangement for distribution of a monetary contribution equivalent to the fair share fee as described herein, to a nonreligious charity. The Employee shall furnish written proof to the Employer and the Union that this has been done within thirty (30) days of establishment of the arrangement. All other objections to either the amount of the actual payment of the fair share fee shall be subject to the internal rebate procedure of the IAFF local #2948 and applicable State law.
Union Membership and Security. 3.01 The parties hereto mutually agree that any employee covered by this Agreement will become a member of the Union. The Union will supply the Employer with application cards for new employees. The Employer will include an application card in the orientation package for each new bargaining unit employee. The Employer will send a list of new employees each month to the Union. Each new employee has ten (10) days to sign an application card and return it to the Union. 3.02 The Employer agrees to deduct the Union’s fees and dues from the employees and forward them to the Union, Unifor Local 324, 000 Xxxxxxxx Xx., Dryden, ON, P8N 2R7 by the fifteenth (15th) of the following month. The Employer shall put employees on a check- off list in alphabetical order showing deductions of such fees and dues. 3.03 It is also understood that no employee laid off or on an approved leave of absence will pay dues. The check-off list will include the name, address, hours worked, reason for absence, union dues amount deducted, two (2) hours (local dues) and 0.7485% x rate x hours to a maximum of 160 hours per month (national dues) and a total of each column. The Employer agrees to change the check-off list when notified by the Union of any changes or additions. a) The Employer agrees to include on each employee’s income tax slip (T-4) the amount of union dues deducted in the calendar year. b) The Company will supply a ‘T2200’ to all employees signed by the Employer or authorized person at the employee’s request. 3.05 The Union shall furnish the Employer with a list of local Officers and Stewards and shall amend these lists as changes occur. The Employer will do the same for their supervisors and persons above the rank of supervisor working in and out of the City of Xxxxxx. 3.06 Supervisors shall not perform services for clients normally performed by members of the bargaining unit, save and except in cases of emergency or for training or demonstration. 3.07 The Employer does not use contractors to perform bargaining unit work. Students are hired for summer replacements from May 1st to September 1st. 3.08 Stewards, members of committees and Union Officers will be required to perform their regular duties and will not leave or otherwise interrupt their regular duties to attend to union business without first informing the Supervisor or her designated representative. The Employer agrees that for the term of this Agreement all present employees who are members of the Union shall remain members of the Union as a condition of employment; and that all present employees who are not members of the Union shall become and remain members of the Union thirty-one (31) calendar days on or after the later of the successful conclusion of their probationary period or the execution of this Agreement as a condition of employment; and that all new employees shall become and remain members of the Union thirty-one (31) calendar days after the successful completion of the employee’s probationary period. 6.2. For purposes of this article, a Union member is an employee who has made current payment on that portion of Union dues attributable to the Union’s representational activities. 6.3. Effective with the date of this Agreement and upon receipt of a voluntary written authorization from an employee, the Employer shall deduct from the authorizing employee’s wages, on a pay period basis, the dues uniformly required of all Union members. The Employer shall transmit on a monthly basis, no later than the 15th day of the calendar month following the month in which the payroll period ends, to the financial secretary of the Union the aggregate sum collected together with an itemized list showing the names and amounts deducted from each employee. The Union will submit to the Employer authorizations as they are obtained from the employee who has authorized the deductions. If an employee has insufficient earnings to equal the dues deduction, the deduction shall be made in the next payroll period in which the employee has sufficient earnings. 6.4. The Union shall indemnify the Employer and hold it harmless against any and all suits, claims, demands and liabilities (including reasonable attorney’s fees) that shall arise out of or by reason of any action that shall be taken by the Employer for the purpose of complying with the provisions of this article. 6.5. Employees transferred out of the certified bargaining unit shall be automatically dropped by the Employer from the check-off authorization rolls. The Union shall be notified of such transfers. 6.6. The amount deducted from any authorized employee’s wages shall not exceed two (2) months’ dues. 6.7. The Employer will fax and send to the Union office the names and addresses of all new hires within five (5) working days of the employee’s first day of work. 6.8. Union Membership and Security. ‌ NEW EMPLOYEES‌ The Union shall receive a copy of all signed letters of employment. All employees to whom this Agreement is applicable, shall, as a condition of employment, become members of the Union upon initial payment of union dues.‌‌
