Leave for Personal Necessity. 1. Upon prior notification to the immediate supervisor, up to 7 days of authorized sick leave per year may be used for personal necessity. District approved forms must be used. This leave shall not accumulate from year to year. 2. A unit member may use up to four (4) of the seven (7) days, per school year, of personal necessity leave without verification with 24 hours prior notification. 3. Circumstances for taking the three (3) remaining personal necessity days are as follows (In examples a, b, c, prior notification to the immediate supervisor is not required.): (a) Death or serious illness of a member of his/her immediate family. "Immediate family" for purposes as used in this article shall be limited to the mother, father, grandmother, grandfather, or grandchild of the unit member or of the spouse or registered domestic partner of the unit member, and the spouse, registered domestic partner, son, stepson, son-in-law, daughter, stepdaughter, daughter-in-law, brother, brother-in-law or sister, sister-in-law of the unit member, or any relative living in the immediate household of the unit member. (b) Accident, involving his/her person or property, or the person or property of a member of his/her immediate family. (c) Verifiable emergencies, which were beyond the control of the individual. (d) Appearances in court as a litigant or as a witness under an official order. (e) Funeral attendance. (f) Observances of religious holidays or civil obligations which cannot be conducted before or after the workday. (g) Matters pertaining to personal welfare. (h) Compelling personal reasons that cannot be conducted after the work day such as attendance at a child's graduation, appointments with professionals (attorneys, accountants, etc.) and attendance at immediate family weddings. (a) In cases of the three days of personal necessity leave use, the unit member shall, upon return, submit a signed statement on a District- approved form which sets forth the nature of the personal necessity involved and may include any subsequent proof as requested by the District except as specified in paragraph B.2 of this Article. (b) Site administrators may limit the number of unit members at their site who may use this leave on any one day. 5. Personal necessity shall not include the use of such leave for any of the following: (a) Attendance at, or participation in, functions or activities which are primarily for the unit member's pleasure, amusement, or personal convenience. It shall be the unit member’s 12 responsibility to track their usage of personal necessity leave. Absences 15 which may be charged to accumulated sick leave under this section include, but 16 are not limited to, the following categories: 17 16.3.1 Death of a member of his/her immediate family when 18 additional leave is required beyond that provided for in other sections of this 19 Agreement. 20 16.3.2 Death of a relative outside the immediate family or of a close 21 friend. 22 16.3.3 Accident involving his/her person or property, or the person or 23 property of his/her immediate family. 24 16.3.4 Appearance in court as a litigant, as a witness, or other 25 absence required under official government order or direction, except as outlined 26 in 16.8.2. 27 16.3.5 Professional improvement, such as: registration for courses 28 in recognized educational institutions, the taking of graduate or other examinations 29 or tests that could not be taken at other times, etc. This provision does not include 30 attendance at classes or lectures that are available at other times which would not 31 conflict with the unit member's obligations to the District.

Leave for Personal Necessity. 10.1 Personal necessity leave up to seven (7) days annually may be granted. Days granted are to be deducted from sick leave as provided in Education Code Section 44981. For purposes of proof of personal necessity and in accordance with the Education Code, the employee would provide information regarding the general nature of the personal necessity to his/her immediate supervisor. See Appendix C for applicable definitions of immediate family. Such leave shall be requested in advance except for: A. Death or serious illness of a member of the immediate family. B. Accident, involving employee's person or property, or the person or property of a member of the immediate family. C. One (1) day for bereavement involving other than immediate family members specified in Bereavement Leave Article XII. However, exceptions may be made by the Superintendent or designee to extend the number of days due to special circumstances. 10.2 No such accumulated leave in excess of seven (7) days plus, six (6) days per Labor Code Section 233 as defined in 10.2.1, may be used in any school year with the following exception: If an employee is out of personal necessity leave and/or sick leave for the current year, differential pay rather than a full day’s pay will be deducted in the case of illness or injury to an immediate family member and verified by a physician for a maximum of four (4) days per school year. 10.2.1 Labor Code Section 233 permits an employee to use in any calendar year the employee’s accrued and available sick leave to attend to the illness of a child, parent, spouse, or domestic partner of the employee. The maximum leave an employee may use for this purpose is the amount of leave the employee accrues in a six-month period. 10.3 Two days from the total of seven (7) days of personal leave noted in Section 10.1 may be used for compelling personal leave. 10.4 Three (3) days from the total seven (7) days of personal leave noted in 10.1 may be used for leave in accordance to the provisions currently specified under Healthy Workplaces, Healthy Families Act of 2014 and is subject to change based on potential clean-up legislation. 10.5 All Personal Leave shall not be allowed if it results in the extension of a holiday, vacation period, or school break (exceptions may be made by the Superintendent or designee due to special circumstances), for personal convenience or recreational activities, or other normal minor matters which can be dealt with outside the workday. 10.6 A “...
