Personnel and Training. A. The City shall hire sufficient personnel to accomplish the requirements of this Scope of Services, including permitting, inspections, monitoring, and other required duties. Said personnel shall be provided proper equipment to accomplish their duties, including a dedicated 4 wheel drive vehicle for beach and dune monitoring and inspections, and any other required equipment. Required vehicles and equipment may be purchased using funds provided under this Cooperative Agreement.
B. The City shall conduct a training program for new personnel employed to carry out the services in (I.) through (V.) above.
1. Personnel training must be conducted to ensure knowledge of (1) appropriate provisions of the Alabama Coastal Area Management Plan document, (2) appropriate state acts, (3) applicable federal laws, (4) ordinances, and (5) ADEM Division 8 Coastal Program rules.
2. A minimum of two hours of initial training and additional refresher training, as needed, must be provided for each employee.
3. A record of training conducted shall be maintained to document the subject matter, hours, dates, attendees and instructors.
4. Upon request, the Department will provide technical assistance in providing required training.
Personnel and Training. A. Personnel Responsibility. edtec is responsible for providing the Academy with a School Administrator and qualified teachers, instructional support, pupil support, food service, secretarial, security, and other staff required to operate the Academy within the staffing levels approved by the Board in its annual budget. edtec shall have the authority to select, evaluate, as- sign, discipline, transfer, and terminate the employment of all individuals working at or for the Academy, with the exception of the Board employees, if any, consistent with applicable law and the provisions of this Agreement. With the exception of Board employees, if any, edtec shall be the employer of all individuals working at or for the Academy and will be responsible for the payment of all costs attributable to these employees, including wages, salaries, fringe benefits, unemployment costs, workers compensation costs, and liability insurance costs. Unless required by applicable statute, court, or administrative decision or Attorney General’s opinion, edtec shall not make payments to the Michigan Public School Employees’ Retirement System or any other public retirement system on behalf of its employees. edtec will provide the Board with a detailed listing of the anticipated compensation and fringe benefit costs for all employees of edtec who will be assigned to provide services at the Academy. The Board will reimburse edtec for the cost of the salaries, fringe benefits, and social security withholdings of employees assigned to the Academy, provided that these costs are not higher than anticipated and approved in the annual budget. At its option, the Board may advance funds to edtec for the cost of the salaries, fringe benefits, and social security of employees assigned to the Academy provided that documentation for the fees and ex- penses are provided by edtec for Board review and are consistent with budget allocations. At the request of the Board, edtec will provide payroll services for employees of the Board. All records pertaining to teacher and administrator certification, as well as a copy of the employee handbook, shall be maintained physically on site or be directly accessible at all Academy facilities. edtec shall not execute contracts with its staff assigned to the Academy that contain non-compete agreements of any nature.
Personnel and Training. 7.01 Provide sufficient training to meet obligations of this Quality Agreement. X
7.02 Provide adequate number of personnel qualified by appropriate training and experience to perform and supervise the manufacture, testing, packaging and disposition of the Product. X
7.03 Assure training is regularly conducted, assessed and documented by qualified individuals. X
7.04 Have written job descriptions for positions responsible for performing Good Manufacturing Practices related activities. X
7.05 Assure that non-employees, including consultants, advising on the manufacture and control of the Product have sufficient education, training, and experience to advise on the subject for which they are retained. Non-employees will be supervised as required and trained in Good Manufacturing Practices. X
Personnel and Training. 29.1 The Contractor shall employ Liberian citizens in the performance of Petroleum Operations in Liberia whenever suitably qualified and available for employment. In furtherance of this requirement:
(a) the Contractor shall hire only citizens of Liberia for unskilled labor positions within Liberia;
(b) the Contractor shall provide skill training and employment opportunities to Liberians for semi-skilled and skilled labor positions; and
(c) the Contractor shall give preference to the employment of competent and suitably qualified citizens of Liberia as managers, technicians, engineers, accountants, geologists, geophysicists, scientists, chemists, drillers, foremen, mechanics, skilled workers, secretaries and executive employees as and when such positions become available unless and to the extent that such competent and suitably qualified citizens are not available for such positions, in which case non-Liberians may be hired for such positions. Employment practices of the Contractor, including number of working hours, working conditions, salaries and any other matters relating to employment conditions shall conform to the Law. The Contractor will require its contractors or subcontractors to comply with this Article 29.1 with respect to their own employment practices within Liberia.
29.2 Nothing in this Contract shall bar the Contractor from employing its own key personnel in appropriate positions.
29.3 Upon commencement of the Petroleum Operations, the Contractor shall provide funding for training programs and for that purpose the Contractor shall devote an annual training budget of:
(a) One hundred thousand Dollars (US$100,000) during each year of the exploration and appraisal period; and
(b) Seven hundred and fifty thousand Dollars (US$750,000) during each year of the exploitation period. Additionally and subject to appropriate safeguards and confirmations as to the eventual destination and recipient of such funding, the Contractor shall make an annual contribution during the term of the Contract of one hundred and fifty thousand Dollars (US$150,000) to the University of Liberia for the enhancement of programs in geology, mining engineering and environmental studies.
29.4 Upon commencement of the Petroleum Operations, the Contractor shall provide funding for social and welfare programs in Liberia and for that purpose the Contractor shall devote an annual social and welfare budget of:
(a) One hundred and fifty thousand Dollars (US$150,000) during each year ...
Personnel and Training. (a) Subject to the Sponsor Agreement, Sections 3.01 and 3.02 of this Agreement and all applicable laws and regulations, Company will have the sole responsibility and authority to determine staffing levels, and to select, evaluate, assign, discipline, supervise, manage and transfer personnel necessary to carry out the Educational Services, the Administrative Services, the Supplemental Programs implemented by the Company (if any) and all other services provided under this Agreement.
(b) Except as specified in this Agreement or as required by law, teachers and support staff recommended by the Company pursuant to this Agreement will be employees of the Company. The Company will be responsible for conducting reference, employment checks, criminal background checks and unprofessional conduct checks on its employees to the extent required under the Code and other applicable laws and regulations as if the employees were employed by a Charter School. Upon request, the Company will provide the Charter School and/or Sponsor documentary evidence of such background checks.
Personnel and Training. A. Personnel Responsibility. While partner school(s) staff will remain employees of HCPS, Contractor is responsible for working collaboratively with HCPS in providing the school(s) with effective administrators and teachers, instructional support, pupil support, and other staff required to operate the partner school(s) within the staffing and compensation levels approved by the Board in its annual budget (the "School Employees"). In collaboration with HCPS, Contractor shall have the authority to select, evaluate, assign, discipline, transfer, and recommend for termination of employment of all partner school(s) Employees.
Personnel and Training. Each TA should provide notice and training for personnel responsible for implementing its AML compliance program.
Personnel and Training. Patheon will provide appropriate training for all employees. Each person engaged in the manufacture, packaging, testing, storage, and shipping of the Product. Such employees will have the education, training, and experience necessary, consistent with current GMP and safety training requirements.
Personnel and Training. The Council shall obtain the services of trained, qualified, and licensed operators meeting all applicable standards and requirements of law and regulations and as necessary for the safe operation of transit vehicles used in providing services under this Agreement. The Council shall establish an information and safety meeting policy providing a means of instructing operators on safety issues and updating operators on administrative procedures relating to services provided under this Agreement. The Council’s operator selection procedures shall include a background reference check and criminal history check for all operator applicants before hiring. The Council is responsible for the satisfactory work performance of all persons providing services described in the Service Plan. The Council will train operators on every pick basis and the Council shall ensure its operators and any subcontractors adhere to the requirements listed in the “Maple Grove Service Requirements” attached hereto and incorporated herein as Exhibit D.
Personnel and Training. 7.1 The Service Provider will use sufficient, suitable, appropriately qualified, skilled and experienced Personnel who hold all necessary certificates and any other qualifications required in accordance with Debt Recovery Law to perform the Services.
7.2 The Service Provider shall not engage any person who will or who may carry out Enforcement Action for TfL unless the Service Provider has obtained satisfactory written references for such person.
7.3 On the Effective Date, and thereafter in the event of any change in its Personnel, the Service Provider shall provide TfL with the following details in writing in relation to each member of its Personnel:
(A) full name;
(B) in the case of Bailiffs, the name of the County Court at which he or she obtained his or her certification;
(C) his or her references; and
(D) the date on which he or she successfully completed the training referred to in clause 7.9(A) below, and the Service Provider shall promptly notify TfL from time to time of any changes to these details.
7.4 The Service Provider shall procure (as far as it is lawfully able to do so) that all its Personnel disclose to the Service Provider details of any convictions. The Service Provider shall not engage any of its Personnel who have convictions in the performance of the Services without the prior written consent of TfL.
7.5 The Service Provider shall require (as far as it is lawfully able to do so) that its Personnel declare any interests or relationships they have with Customers at any time and from time to time. The Service Provider shall notify TfL of all such declarations and shall ensure that none of its Personnel shall carry out Enforcement Action in respect of a Customer with whom he or she has declared an interest or relationship.
7.6 The Service Provider shall provide TfL, upon request, with copies of the contracts of employment or service (as the case may be) of Bailiffs engaged to perform Enforcement Action for TfL.
7.7 The Service Provider shall ensure that all Bailiffs update their County Court certification so as to indicate their employment or engagement by the Service Provider.
7.8 If TfL, acting reasonably, considers that any member of the Service Provider’s Personnel is not performing properly, efficiently or effectively or is in any way disruptive to TfL’s activities then TfL may, by written notice to the Service Provider, require the removal of such member of the Service Provider’s Personnel from the provision of the Services with im...
