REDUCTION AND RECALL OF STAFF. A. Seniority shall be defined as total years of service to the New Xxxxxxx Area Public Schools, computed from the first day the teacher reported to work. A teacher on leave does not lose accumulated seniority and does not receive seniority credit for the leave period. The seniority list shall be published by the 15th of January of each school year and shall include teachers' name and years of service. One-half (1/2) day teachers will accumulate seniority the same as full-time teachers. All seniority is lost when employment is terminated by resignation, retirement, discharge, or transfer to a non-certified position. In cases of layoff, all teachers so affected retain all seniority accumulated as to the effective date of the layoff.
REDUCTION AND RECALL OF STAFF. A. In the event it becomes necessary for the Board to effect a reduction in personnel, due to an emergency, a substantial decrease in student enrollment and/or district revenue, the following procedures will be utilized:
1. Probationary teachers shall be laid off first provided there are fully qualified, fully certificated tenure teachers to replace and perform all the duties of the laid off probationary teacher.
2. If further reduction is necessary, then tenure teachers will be laid off according to seniority.

Before official action on reduction of teachers is taken by the Board, it will give notice of the contemplated action to the Association and afford the Association opportunity to discuss it with the Board. As soon as the teachers to be laid off are known, a list of the affected teachers shall be given to the Association.
B. In October and May of each year, the Board shall provide the Association with a current teacher seniority list and post same on teacher bulletin boards.
1. The teacher's seniority date shall be either the date of signing the initial contract or the first day worked, whichever comes first.
2. Individual teachers having the same seniority date shall participate in a drawing to determine position on the seniority list. The drawing will be conducted openly and at a time and place which will reasonably allow affected teachers and Association Representatives to be in attendance.
3. The seniority list shall include the teacher's hire date, degree and employment status.
4. Only members of the bargaining unit shall possess and accrue seniority within the bargaining unit.
C. In the event of a necessary reduction in staff, such reduction shall be based upon seniority, certification and qualification for the vacant position(s).

a. Unpaid leaves of absence, except as provided elsewhere, do not accrue seniority.
b. Time spent on layoff shall continue to accrue seniority.
2. Certification shall be defined as possessing a valid teaching certificate as recognized by the State of Michigan.
3. For the purpose of this Agreement, qualified shall be defined at the elementary level as those teachers holding elementary certification. At the secondary level, qualified shall be defined as those teachers holding secondary certification and who possess the appropriate majors and/or minors. In grades 7-8 "qualified" shall be applied by assigning the teacher in the areas of his major and/or minor field of study with either elementary or secondary certification.

It is hereby specifically recognized, and agreed, that it is within the sole discretion of the Board to 49 reduce the number of Bargaining Unit positions through layoff from employment; to reduce the 50 number of Bargaining Unit positions in a given subject area, field, or program; to eliminate or 51 consolidate a position, or positions; or to reduce its educational program, curriculum, or services.

For purposes of assignment or retention under this Agreement, the term “certified” shall mean that 54 the bargaining unit member possesses either a Michigan teaching certificate and endorsement 55 appropriate to his/her assignment or, if certification is not required for the bargaining unit member’s 56 assignment, the appropriate license, approval or authorization, as applicable. The Board shall lay off and recall Bargaining Unit Members based on seniority with Branch Intermediate School District among equally qualified candidates within a seniority classification, but reserves the right to bypass seniority in accordance with the provisions of Article XIII, Section E (Evaluations). “Seniority” is defined to mean the amount of time an individual is continuously employed as a non-certified employee of the district within a seniority classification. Movement from one seniority classification to another shall establish a new date of seniority within the new classification, but shall not affect seniority date in previous classifications. Accrued seniority in the previous classification is frozen as of the date of the transfer to the new classification. If a reduction of staff occurs in a specific seniority classification, the Bargaining Unit Member in the affected position with seniority in another classification may “bump” a lower seniority Bargaining Unit Member in another classification if possessing higher seniority in that classification and appropriate qualifications. It is expressly understood that “bumping” shall occur at the lowest seniority level, which conforms to the requirements of this paragraph. It is expressly understood that Bargaining Unit Members continuously employed by Branch Intermediate School District but assigned to a position outside of BIO, shall maintain seniority for the specific period of time they were members of BIO, and shall have this seniority time apply within the classification or classification(s) they were employed in. REDUCTION AND RECALL OF STAFF. 5.01 In reducing staff, or layoff the most junior member shall be the first to be laid off. In case of recall, the most senior member shall be the first to be recalled.
5.02 Not less than four working days' advance notice will be given in the event of a reduction of staff, except in the event of a strike or work stoppage by employees in the Railway industry, in which case a shorter notice may be given.
5.03 Layoff notice under Article 5.02 may be served at any time, such as when a member is on vacation, on leave of absence, absent account illness, etc.
5.04 When staff is increased, members wishing to be recalled must file their names and addresses with the Chief of Police prior to the end of each year based on the date of lay off. A member who does not file their name and address by way of written notification, with the Chief of Police prior to the end of each year will have their name removed from the seniority list and their record will be closed.
5.04.01 Members laid off in excess of one year must, upon recall, successfully pass Mandated Qualifications, including, but not limited to, Use of Force, Firearms and Defensive Tactics.
5.04.02 Upon recall, the member will be given reasonable opportunity to practice and train prior to qualification.
5.04.03 A member who chooses not to take the re-qualification referred to in 5.06.01, or fails to successfully re-qualify shall have their name removed from the seniority list and their record will be closed. A member who fails to re-qualify on the first attempt will be given the opportunity to re-qualify, within sixty (60) days of failing at the first attempt. This timeline may be extended by mutual agreement.
5.05 When recalling staff, members failing to report for duty, or giving satisfactory reasons for not doing so within seven (7) days from the date of written notification, shall be considered out of service, except that a laid-off employee who is employed elsewhere at the time he is notified to report for duty may, without loss of seniority, be allowed to refuse such recall provided that it is known that the duration of this recall will not exceed ninety (90) days and other qualified laid-off members are available. In the application of item 5.07 a written application must be made to the designated Company Officer immediately upon receipt of notification of recall, otherwise the member’s record shall be closed and their name dropped from the seniority list. REDUCTION AND RECALL OF STAFF. A. Acting within the approved budget, the Superintendent is responsible for establishing the number and nature of teaching assignments to implement the approved curriculum. If the Superintendent determines that insufficient funds are budgeted for existing staff or that a reduction in teaching staff is necessary due to a program curriculum or other operational consideration(s), the superintendent will recommend to the Board the teaching positions to be reduced. The Association will be notified of the contemplated reduction in personnel at least ten (10) days before the layoff notices are distributed to the teachers. Prior to issuance of layoff notices, the NLEA will be given an opportunity to make specific recommendations regarding the particular implementation of layoff and recall procedures planned by the district.
B. The Superintendent has the discretion to layoff or recall a Bargaining Unit member for a reason that is not arbitrary or capricious including, but not limited to the following clear and transparent factors:
1) Compliance with State and Federal laws regulatory standards, and state grant, and categorical funding requirements.
2) Qualifications determined by the district, including but not limited to credentials necessary for school or program accreditation.
3) Effectiveness based on previous evaluations.
4) Length of service in the grade level or subject area.
5) Professional development, special training, additional training, additional certification(s) and experiences that lend themselves to the classroom.
6) If factors noted above are equal seniority may be the tiebreaking factor.
C. A teacher is eligible for recall for 2 years from the date the district implemented the reduction in force.
D. Probationary teachers cannot grieve any aspect of this article. Tenured teachers may grieve alleged violations of this article through mediation.
