10.01 The regular hours of work shall be:
(a) Per Day Day Employees & 8 Hr. Shift Employees - 8 Hrs. 12 Hr. Shift Employees, 12 Hr. Day Shift Employees & 12 Hr. Day Employees - 12 Hrs.
(b) Average Hours Per Week All Employees – 38 Hours beginning January 1, 2006. Note: For purposes of accounting “day” shall mean a twenty-four (24) hour period commencing at the employee’s normal “AM” starting time.
HOURS OF WORK AND PREMIUM PAY. Section 1 The normal work year shall be based on 2,080 hours per year. Premium pay in the form of cash or compensatory time off, at one and one-half (1 1/2) times the base rate, shall be paid for hours worked or taken as paid leave in excess of the normal schedule cycle as a proportion of the normal work year. Premium pay shall be earned for hours worked in excess of the normal schedule day unless such hours are necessary to develop the required hours in the normal schedule cycle, again, based on a normal work year of 2,080 hours. Employees shall receive the two (2) hour minimum at the overtime rate to attend mandatory meetings on a regularly scheduled day off or on an approved time off. Employees shall be entitled to bank up to one hundred twenty (120) hours of compensatory time for later use.
Section 2 Court time or call back time which does not directly follow a normal work shift shall be paid at a minimum of two (2) hours. Premium pay shall apply if the time worked or the minimum, when added to hours worked in the regular work cycle in which the call back or court time is earned, exceeds normal cycle hours. Section 3 The normal work schedule for full-time employees shall equal a forty hour work week when averaged over a six week cycle. The normal shift shall include two fifteen (15) minute breaks and one-half (1/2) hour lunch period available but subject to call. Public Safety Telecommunicators scheduled to work alone shall be paid an additional thirty (30) minutes at straight time rates for each four (4) hours worked in lieu of a break.
Section 4 The employees will maintain a record keeping system to be used when offering overtime assignments. Overtime will be offered to available employees based on seniority. Overtime refused by an employee will, for record purposes, be considered as unpaid overtime worked. For the purpose of computing premium pay, hours worked shall not be pyramided, compounded or paid twice for the same hours. Overtime shall be calculated to the nearest fifteen (15) minutes.
Section 5 The Employer may honor voluntary requests and acceptance of shift exchanges between bargaining unit employees, but only in the event that there is no adverse effect upon the Department program and functions. Refusal to grant shift exchanges shall not be grievable.

(A) The normal work period consists of one hundred sixty (160) hours worked within a twenty-eight (28) consecutive day period.
(B) (1) The normal work day consists of either twelve (12) or eight (8) hours inclusive of a paid meal period.

A member who performs his duties in one (1) period of twelve (12) consecutive hours shall, where the requirements of the service permit, be allowed two forty- five (45) minute lunch breaks. One forty-five (45) minute break during the first six (6) hours of the tour of duty and one forty-five (45) minute break during the second six (6) hours of the tour of duty. Where a member is unable to take the first forty-five (45) minute break due to the exigencies of the service he shall receive one and one-half (1-1/2) hours during the second six (6) hours of his tour of duty subject to the exigencies of the service. If a member does not receive at least one (1) hour for lunch during his twelve (12) hour tour of duty, he shall be compensated for any lost time at straight time rates. Further, a member on maternity leave shall be deemed to be working a normal forty (40) hour work week.
(A) A member shall be credited with accrued time to a maximum of 104 hours per annum calculated on the basis of the actual time spent working a compressed work week. Members shall receive this time in two blocks with each block being not more than 52 hours. The first block is to be credited on January 1st, the second to be credited on July 1st, during the calendar year of this Agreement.
(B) Accrued time shall be taken off in time only by Agreement between the member and his Unit Commander subject to the exigencies of the service. If the member has any accrued time remaining to his credit six (6) weeks prior to the end of each six (6) month period, the York Regional Police shall assign such remaining time, subject to the exigencies of the service and;
(1) time shall be assigned in minimum blocks of four (4) hours;
(2) a member shall receive at least twenty-four (24) hours’ notice for any time assigned to the member that exceeds four (4) hours;
(3) a member who is unable to use his accrued time due to illness, or due to injury or illness compensable under the Workplace Safety and Insurance Act prior to December 15 of the calendar year in which the illness or injury occurred, shall subject to the approval of the Chief of Police, be permitted to take such time off between December 15 and December 31 of the calendar year.
