Promotion and Seniority. For the purpose of seniority employees shall be grouped as shown below: - Signal Coordinator - Signal Technicians - Leading Signal Maintainers, Leading Signal Mechanics, Signal Test men - Signal Maintainers and Signal Mechanics - Assistant Signal Maintainers - Signal Helpers (a) For the purpose of promotion to Leading Signal Maintainer employees shall be grouped as shown below: - Leading Signal Maintainers, Leading Signal Mechanics, Signal Test men - Signal Maintainers and Signal Mechanics - Assistant Signal Maintainers (b) For the purpose of promotion to Signal Technician employees shall be grouped as shown below: - Signal Technician - Signal Maintainers and Signal Mechanics - Assistant Signal Maintainers The following classification line of promotion is on the basis that the senior of the highest rated qualified applicants will be awarded bulletined vacancies. A copy of this list shall be updated semi-annually as at 30 June and 31 December in each year and that the amended seniority list for each seniority unit will be delivered to the General Chairman and/or Designate within 15 days. A seniority date not protested in writing to the Director- Operations with a copy to the General Chairman within 60 days from its first posting on the list, will be considered permanently established, except that an employee who is laid- off or on leave of absence at the first time the seniority list is posted will have 60 days from date of return in service. Typographical errors on subsequent rosters may be corrected at any time. 9.3 A new employee shall not be regarded as Permanently employed until he has accumulated one hundred and twenty-five (125) working days’ service under this Agreement in the preceding twelve (12) months, and, if retained shall be accorded seniority as helper from the date first employed in a position covered by this Agreement. 9.4 Employees who have not accumulated one hundred and twenty-five (125) working days’ service will be laid off in reverse order of their employment and recalled to service in the order of their original employment when their services have been satisfactory. Promotion and Seniority. (a) All promotions shall be governed by ability, fitness and efficiency, provided that where these are equal, seniority of service shall govern. (b) All members holding a similar rank shall be ranked for purposes of seniority according to the number of years they have continuously served as members of the Service in that rank. (c) For the purposes of Vacation Entitlement, Service Pay and Promotion, service will be the total of all service with this Police Service and with other Police Services as governed by the Police Services Act or Equivalent, as a Police Officer. Where service with two or more Services is broken by more than twenty-four (24) consecutive months, only the service with the Peterborough Community Police Service shall be taken into account. For the purposes of placement on Holiday Signing Lists, only service with the Peterborough Community Police Service will be used.

The onus shall be on the particular employee involved to bring to the attention of the Company and to have any alleged errors on the seniority list corrected and any such alleged errors must be brought to the attention of the Company within thirty (30) days of the posting of the seniority list, otherwise any alleged errors shall be deemed to be waived; once any dispute has been dealt with, it will be considered conclusively settled.

Promotion and Seniority. 19.01 Where a full-time vacancy or a temporary vacancy known to exceed three (3) months occurs, or a new job is created within the bargaining unit, such vacancy or job will be internally bulletined within Tbaytel for a period of one (1) week. Internal bulletins shall become invalid if not filled within thirty (30) days of their respective closing dates. A copy of the bulletin will be sent to the Union at the time of posting, the position will then be posted as an “Open Competition”, a copy of which will also be sent to the Union. Employees who are members of Local Union 339, IBEW (Craft Unit) will be given preference on Office Unit positions over applicants from outside either bargaining unit, provided the applicant Craft Unit member meets all the competitive criteria as outlined in Clause 15.02 of the Office Agreement. The Union will be notified of the successful applicant’s name when the position is filled. In the event the Corporation is unable to place the successful applicant in a vacancy within ninety-one (91) calendar days of being awarded a position, the employee will be paid the hourly rate of the new position, or the rate of the job they are currently performing, whichever is greater, until they are placed in the vacancy. This clause does not remove the Corporation’s ability to cancel the job posting prior to the employee actively working in the new position. Wherever there are changes or amendments to qualifications or major job tasks as outlined on existing position descriptions, the Union will be notified of the change. The Union shall have ten (10) working days in which to submit to the President & CEO, in writing, any comments to the proposed changes.

For the purpose of holiday signing lists, only service with the Peterborough Lakefield Community Police Service will be used. When an employee of the Corporation of the City of Peterborough joins the Peterborough Lakefield Community Police Service as an unsworn member, without a break in service of more than twenty-four (24) months, that employee shall have their service recognized from the date of his or her permanent hire as an employee of the Corporation of the City of Peterborough. For the purpose of holiday signing lists, only service with the Peterborough Lakefield Community Police Service will be used. (e) For unsworn members, service shall include all time spent with the Peterborough Lakefield Community Police Service including part-time.

In the filling of the vacancies, the Corporation shall not be limited to selecting employees who have made application, but the Corporation shall be subject to the same limitations as set forth in Article Clause relating to cases of promotion. Nothing herein shall prevent the Corporation from hiring persons from outside the bargaining unit when no qualified employee applies.
