Unpaid Personal Leave of Absence. 1. Any employee may apply for an unpaid personal leave of absence for good and sufficient reason. Leave pursuant to this provision may be for a period not exceeding nine (9) months in any fourteen (14) consecutive months. Such leave may be granted at the discretion of the appointing authority and shall not be unreasonably denied. Employees are encouraged to consult with their agency/department Personnel Officer to determine if they are eligible for benefits available under the Federal Family and Medical Leave Act. All requests for such leave and responses shall be in writing. The application for leave must specifically state the reasons for such application and the length of time requested. After completion of a period of personal leave of absence, the employee shall be entitled to return to the organizational unit, status and position held immediately prior to the beginning of the leave of absence. If the employee's position is abolished during any such leave, he/she shall be notified and al- lowed to exercise his/her rights under the Seniority Article of this Agreement.
2. A leave of absence without pay and without loss of seniority not to exceed one (1) year may be granted to an employee to permit the employee to accept a position in State service that is excluded from bargaining units under 26 M.R.S.A. §979-A(6) (the State Employees Labor Relations Act). Such employee shall be entitled to return to the organizational unit, status and position held immediately prior to the beginning of the leave of absence within the one (1) year period. Any employees who have filled vacancies created by the initial movement of the returning employee shall likewise be entitled to return to their former positions.
3. Except as provided in the Seniority Article, if an employee is laid off from an excluded position for reasons beyond his/her control after the expiration of said one (1) year leave, he/she shall at his/her request be placed on any reemployment registers for which he/she is eligible. Upon reemployment he/she shall be credited with the seniority earned up to the start of the leave granted pursuant to this Article.
4. Any employee currently on leave of absence from a position in this bargaining unit under Personnel Rules, Chapter 11, Section 3C shall be continued on such leave through the end of his/her current coterminous or fixed term appointment or for one (1) year from the effective date of this Agreement if he/she is serving in a position which does not in...
Unpaid Personal Leave of Absence. 7.10.1 The District may, in its sole discretion, grant a leave of absence without pay to permanent employees.
7.10.2 Leave of absence must, except under extenuating circumstances as approved by the District, be requested in writing 30 days prior to the date the leave is to commence. An employee on unpaid leave of absence for personal reasons may continue to participate in the health and welfare benefits at his/her option. If an employee on leave elects to continue in the health and welfare program, he/she must pay the full premium for such participation.
Unpaid Personal Leave of Absence. 17.10.1 The District may, in its sole discretion, grant a leave of absence without pay to probationary and tenured faculty. Within five working days from the date of the Board action, Human Resources will provide the faculty member requesting a leave pursuant to this section with written notice of the approval or disapproval of the leave request.
17.10.2 Personal leaves shall be in the best interest of the District, and may be granted when the withholding of such a leave would work an undue hardship upon the faculty member requesting the leave.
17.10.3 Personal leaves will be granted in one or two semester increments and except for emergencies shall start at the beginning of an academic semester. Extension of family leave and opportunity leaves are covered under this provision.
17.10.4 A faculty member on unpaid leave of absence for personal reasons may continue to participate in the health and welfare benefits at his/her option, as provided for in 17.1.11.
17.10.5 Unpaid leaves of any length have an impact on the faculty member’s status with STRS. This status is beyond the control of the District.
17.10.6 The Superintendent/President or his/her designee may, in his/her sole discretion, approve short term personal leave of up to 30 days to any tenured or probationary faculty member to meet emergency situations which arise out of circumstances which are unpredictable and unavoidable. A written notice will be provided to the faculty member requesting such a leave indicating whether the request for a personal leave has been approved or disapproved. The written notice will be sent to the faculty member within five (5) working days from the date the request for such leave was received by the Superintendent/President.
Unpaid Personal Leave of Absence. The Employer may in its discretion grant an employee an unpaid personal leave of absence in instances where no other leave section is applicable. Requests for an unpaid personal leave of absence shall be submitted in writing to the employee’s immediate supervisor at least five (5) working days in advance of the date of the requested leave of absence. All requests shall state the reason for the leave and must be signed by the employee. Unpaid personal leaves of absence will not normally be granted for periods in excess of thirty (30) calendar days. Leaves of absence under this section will not normally be granted beyond the end of the school year during which the leave commenced, but the Board in its discretion may grant extensions of a leave for periods of up to twelve (12) months. The commencement date and return date shall be specified in the grant of the leave of absence. All such leaves shall be without salary and benefits.
Unpaid Personal Leave of Absence. A permanent Unit Member may be granted an unpaid leave of absence for personal reasons including, but not limited to, personal health, family concerns, child rearing, adoption, and other personal matters for which there are no other leave provisions, or where other applicable leave provisions have been exhausted. An unpaid leave of absence shall not normally exceed six (6) calendar months and shall be subject to approval by the campus President/Xxxxxxx, the Vice Chancellor of Human Resources or designee and the Board of Trustees.
15.6.1 A request for an unpaid leave of absence shall be submitted in writing to the Immediate Management Supervisor, normally at least thirty (30) calendar days prior to the effective date of the requested leave. The request shall indicate the beginning and ending dates of the requested leave and the reasons for the request.
15.6.2 The request, accompanied by the Immediate Management Supervisor’s recommendation, shall be forwarded through established administrative channels. If the request is denied by the campus President/Xxxxxxx, or in the case of the District Administrative Offices, by the Chancellor or appropriate Chancellor’s Staff administrator, the Unit Member may appeal the decision in writing to the Vice Chancellor of Human Resources. The decision of the Vice Chancellor or designee shall be final.
15.6.3 On an approved unpaid leave of absence, a Unit Member shall have the option to continue health and welfare coverage at the Unit Member’s expense.

Employees are encouraged to consult with their Site Director to determine if they are eligible for benefits available under the federal or state Family and Medical Leave Act. All requests for such leave and responses shall be in writing. The application for leave must specifically state the reasons for such application and the length of time requested. After completion of a period of personal leave of absence, the employee shall be entitled to return to the Regional Site, status and position held immediately prior to the beginning of the leave of absence, if available, or a similar position. If the employee’s position is abolished during any such leave, he/she shall be notified and allowed to exercise his/her rights under the Seniority and Reduction in Force Article of this Agreement. To the extent permitted by law, an employee shall be responsible for paying the full premiums of any health insurance benefits during the unpaid personal leave of absence.
Unpaid Personal Leave of Absence. All Supplements and Riders shall maintain the unpaid personal leave of absence provisions contained in those labor agreements in effect prior to the contract ratification date, unless otherwise set forth in the current Supplements and/or Riders.
Unpaid Personal Leave of Absence. 7.8.1 A teacher may request a personal leave of absence without pay, stating the length and purpose of the leave. If the reasons for the leave are compelling, and the teacher has had a satisfactory record of employment with the District, an effort will be made to grant the request. Leave requests are expected to coincide with school semesters/terms to the greatest extent possible.
7.8.2 Leave requests should be submitted as far in advance as possible, preferably five calendar months or more before the desired start of a non-emergency leave. The teacher requesting unpaid personal leave shall submit a request in writing to the Principal, who shall refer it to the Superintendent with a recommendation. The request shall include the reason for seeking leave and an indication of its probable duration. Normally, unpaid leave requests will not exceed one school year, although requests for longer leave periods may be considered. The teacher shall be notified in writing of the Superintendent’s decision.
7.8.3 A teacher returning from an unpaid leave of one school year or less shall be guaranteed employment in the same position held at the time such leave commenced, or to a substantially equivalent position, provided the elimination or reduction in FTE of teaching positions under Article XIV (“RIF”) during the leave period would not have resulted in the teacher's being reassigned to a lower FTE position or laid off in the interim. A teacher who wishes to return to work after a leave of more than a school year may be guaranteed such re-employment at the discretion of the Board (unless required by law).
Unpaid Personal Leave of Absence. The Employer may in its discretion grant an employee an unpaid personal leave of absence for matters that necessitate the employee's absence from work. An unpaid personal leave of absence may be for a period not to exceed thirty (30) calendar days. Requests for a personal leave of absence shall be in writing, signed by the employee, and given to the superintendent no later than thirty days prior to the requested absence. In emergencies only, this timeline may be altered with Superintendent’s approval. Such requests shall state the reason for the leave. An extension of personal leave of absence may be granted by the employer in its sole discretion, provided the extension is requested in writing prior to the termination of the original leave period. Disputes concerning the denial of requests for unpaid personal leaves of absence are not subject to arbitration.
Unpaid Personal Leave of Absence. It is recognized that employees from time to time may request unpaid leave from their jobs for personal reasons other than medical. The Employer shall attempt to accommodate such requests based on the merits of the leave and the best interest of the Employer. Such request shall not be unreasonably denied. The employee’s past record and the purpose for which the leave is requested shall be considered when granting or denying such leave. During such leave period whereby an employee is not paid at least ten (10) work days in any month, the accrual of vacation and sick leave shall cease and the employee shall pay the cost of health and life insurance (except as provided in Article 12, Section 6).
