Sick Leave Donation Bank. SCEA recognizes that members may experience a family medical emergency, resulting in a need for additional time off in excess of their available sick leave days. To address this need, all eligible members will be permitted to donate sick leave from their unused balance, in accordance with the policy outlined below. Member participation in the Sick Leave Donation Bank program is strictly voluntary. Participants will donate to the general pool, as opposed to a specific employee.
Sick Leave Donation Bank. Purpose: The purpose of a sick leave donation bank is to provide a safety net for employees who face catastrophic illness or unforeseen medical emergencies that have exhausted sick leave, personal days, and paid vacation days, and do not qualify for long-term disability benefits. Members who qualify for OFLA/FMLA leave may apply to access the sick leave bank. All bargaining unit employees shall be eligible to participate in a sick leave donation bank if they complete the correct forms on time. All bargaining unit employees who wish to participate in the sick leave bank must donate one (1) personal leave day or one sick leave day by completing the appropriate form (Form: LDON A-1) before October 30th of each year. Employees who are retiring may elect to donate up to twenty (20) days of their accumulated sick leave to the sick leave bank with Association certification that the affected employee has been apprised of their sick leave transfer rights.
a. When an employee faces a long-term absence from a serious illness (over five days) and has exhausted their sick leave, they can request days by contacting the Union Vice-President. The leave should be for the period of treatment for the illness whether that time is consecutive or intermittent. Recipients will be limited to forty-five (45) days per recipient in any given school year (form: LREQ A-2). The sick leave donation bank shall not cover normal delivery.
b. If the Association Sick Leave Bank Committee determines that the recipient's request meets the purpose stated above and the conditions stated in this section, the Association will inform the District to draw from the bank. If the bank is exhausted or approaching exhaustion, the Association Sick Leave Bank Committee will contact members of the bargaining unit to obtain additional donated days of leave in coordination with the school District business office.
c. All bargaining unit employees who wish to donate leave day(s) to the bank must donate at least one (1) personal leave day or one (1) sick leave day by completing the appropriate form (form LDON A-1). No bargaining unit member can contribute more than ten (10) total days per year.
d. The Union Vice-President shall oversee operation of this sick leave donation program bank with the technical assistance of designated central office personnel.
e. Unused sick leave donated to this bank will roll over to the next year.
Sick Leave Donation Bank. The Sick Leave Donation Bank and program shall be administered as follows:
Sick Leave Donation Bank. Employees may donate to and use the sick leave bank as provided within the Human Resources Guide of the UG.
Sick Leave Donation Bank. A. Effective September 1, 2000, all employees on active duty in Allegany County are eligible to participate in the Allegany County Sick Leave Bank, hereafter referred to as SLB, by donating the required number of days. However, no unit member shall be required to participate. Bargaining unit members may use these days for prolonged catastrophic, incapacitating personal illness, injury or quarantine of the employee during regular scheduled duty days. The primary purpose of the SLB is intended to help an employee with a prolonged serious illness or accident which requires the usage of available personal illness days and leaves the employee without the necessary personal illness days to carry her/him over to eligibility for Long Term Disability Insurance.
Sick Leave Donation Bank. Members of Local 136 may donate sick leave of up to twenty-four (24) hours per quarter, per member to the Local 136 Sick Leave Bank (SLB). Members shall be able to use the SLB for any reason provided in Article 11, Section 7, provided that:
1. Any Local 136 member wishing to utilize the SLB must donate or have donated at least twelve (12) hours to the SLB;
2. The affected member has exhausted all forms of available paid leave;
3. The affected member is unable to work restricted duty or full duty assignments based on a licensed physician’s recommendations;
4. The affected member has not reached maximum medical improvement related to their medical conditions based on a licensed physician’s opinion;
5. The affected member has an estimated return to full duty date within one (1) year from the outset of the medical condition;
6. Any donated, yet unused sick leave hours at the end of each quarter, shall be kept in the SLB. This SLB shall be overseen by Local 136 and the Department of Human Resources. The maximum allowable amount of sick leave donations when not currently being used shall not exceed three thousand six hundred (3,600) hours. When the SLB is reduced to less than six hundred (600) sick leave hours, Local 136 will submit a request to their members for donation to ensure there is sufficient time and donations to refill the SLB. When a member of Local 136 has an excess of sick leave hours totaling more than one thousand six hundred eighty (1,680) hours at the end of service, the member shall be allowed to donate any amount of their excess sick leave to the SLB as long as the total amount of sick leave in the SLB does not exceed three thousand six hundred (3,600) hours.
Sick Leave Donation Bank. A sick leave bank may be established from which an employee may request to borrow up to thirty (30) days. The amount dispensed will be based on whether they chose a twenty hour per week (4 hour per day driver), twenty-five hours per week (five hour per day driver), or thirty hours per week (6 hour per day driver.) This sick leave bank shall be established beginning September 2000 by employees covered by the Agreement contributing sick leave days.
(a) The Sick Leave Donation Bank shall be by the District. Decisions as to whether an employee qualifies for the bank is at the sole discretion of the ORCSD Business Administrator.
(b) The Sick Leave Donation Bank is intended to serve an employee who, because of extended or serious illness has exhausted her/his accumulated sick leave.
(c) The Employer shall cooperate in the operation of the Bank in the following ways:
i. Tracking the balance of hours in the Bank ii. Deducting sick days from employees as reported by the Union
iii. Pay employees for days approved by the Union
(d) Contributing days to the Sick Leave Bank balance will be done only in September and June of each year. In order to participate, an employee must contribute one sick day to the bank annually.
(e) The Sick Leave Donation Bank shall be limited to a maximum of one-thousand two hundred (1200) hours. In no case shall any one employee be allowed more three hundred (300) total hours. Days will be based upon the hours they declared to work at the beginning of the school year.
Sick Leave Donation Bank. 1.) In case of prolonged or exceptional cases of absence due to catastrophic illness of at least fifteen (15) workdays employees may apply to the Sick Leave Donation Bank. A catastrophic illness is a severe illness requiring prolonged hospitalization or recovery. Examples include coma, cancer, heart attack, and stroke. The employee must exhaust all available paid leave and vacation days. To qualify for such donation, an absent employee must apply to the Union and fill out all required paperwork. The Union will provide the District with the name and number of days donated by employees.
2.) The Sauk Village Education Association agrees to indemnify, and save and hold harmless, the Board of Education from any and all liability, costs, attorneys' fees or damages suffered by the Board as a result of any litigation, arbitration, or administrative agency proceeding, which might arise as a result of this Article.
3.) Any dispute, which arises as to the administration of this Section, shall be non-grievable.
Sick Leave Donation Bank. A sick leave donation bank has been estabwbed to continue the income of eligible employees under the following circumstances:
Sick Leave Donation Bank. Employees may participate in a Sick Leave Bank established for classified employees. To be eligible, the employee or spouse, parent, sibling or child(ren) must have suffered an illness or injury and have used all of his or her their paid leave accrual. Forms authorizing the donation of sick leave will be made available to employees.
A. Initial membership in the bank shall be established by an initial investment of one day of previously accrued leave.
B. Days shall be invested on a non-refundable basis by voluntary action of any CSP (covered by this agreement) who wishes to participate in the sick leave bank.
C. All classified employees with at least one year of service shall be members of the Sick Leave Bank unless they specifically opt to withdraw in writing by September 30 of the current school year. Classified employees new to the district may, at their option, join the Sick Leave Bank by notifying the District in writing by September 30 of the current school year. Exceptional cases for admission shall be considered by the governing body.
D. When the accumulated balance of days in the bank falls below a figure equal to half the number of participants in the bank, each member shall automatically donate one additional day.
E. If a bank participant has exhausted his/her their sick leave and cannot return to work because of personal, spouse, parents, children or sibling’s incapacitation, he/she shall be eligible to draw (from the Bank) not more than twice the number of days of sick leave he/she has accumulated as of the beginning of the school year. However, in a case of severe illness or extreme hardship, the Governing Body may permit an ESP to draw more leave.
