Traffic Improvements. Collectively, the Wagon Wheel Improvements and the ▇▇▇▇▇▇ ▇▇▇▇▇▇▇▇ ▇▇▇▇ Improvements.
Traffic Improvements. Developer, at its cost, shall install or construct all traffic signals, control devices, signs, road improvements, traffic regulating flow facilities, and lane markings for public streets listed, and according to, the schedule in Exhibit D (the “Traffic Improvements”). Furthermore, Developer acknowledges and agrees that all such traffic signals, control devices and signage shall be consistent with the Village’s existing sign schematic and style and shall otherwise be reasonably acceptable to the Village. Developer shall submit all engineering plans for Traffic Improvements to the Village for the Village’s approval, which approval shall not be unreasonably withheld, conditioned, or delayed. Developer shall perform all work required under this Section in a good and workmanlike manner, using qualified labor and quality materials. Developer shall coordinate and schedule all such work with the Village. The Village may inspect such work to assure conformance to the Village’s standards. After approval and acceptance by the Village of Traffic Improvements to standards approved by the Village, the appropriate governmental entity shall be responsible for maintaining the Traffic Improvements. In addition, eighteen (18) months after the Significant Initial Occupancy Date, Developer shall, at Developer’s expense, engage TMS Engineers, Inc. or another experienced traffic engineer selected by Developer and reasonably acceptable to the Village, to conduct a traffic impact study to determine whether additional public traffic improvements are necessary as a result of any underestimation of traffic needs and impact during the Project planning stages and shall, at Developer’s expense, implement such traffic improvements, subject to the Village’s reasonable discretion and approval. The foregoing described Traffic Improvements specifically do not include and the Village shall have no obligation or liability to maintain, any private roadways or other improvements constructed within the Project and deemed or designated as non-public roadways and areas, as may be otherwise and approved by the Village in the Final Development Plan.
Traffic Improvements. The amount of credits that shall be applied against the Phase 1 Traffic Fees to determine the amount of such fees that Summerhill must pay to obtain building permits shall be based upon the Current Estimates. For each of the four Phase 1 Traffic Improvements listed above, the applicable amount of the Current Estimates for each improvement shall be as listed below:
a) Westbound Lark to Hwy 17 northbound ramps: Construction total of $1,268,000 plus 12% for both soft costs and contingencies, for a total of $1,572,320.
b) Lark/Los Gatos Intersection Improvements: Construction total of $769,000 plus 12% for both soft costs and contingencies, for a total of $953,560.
c) Complete street Improvements – Lark from Garden Hill to Los Gatos: Construction total of $213,000 plus 12% for both soft costs and contingencies, for a total of $264,120.
d) Local Bikeway Improvements: No credit requested.
Traffic Improvements. In 2012, a payment of $187,500 was made at the request of the City as partial payment to improve the intersection of ▇▇▇▇▇ Avenue and San Pablo (1999 Amend- ment, Appendix B.2, 3). A final invoice was due upon completion of work late in 2012, but had not been received at the end of 2014. The scope of this work will exceed that agreed to in 1999, and the City will request additional funds from the Traffic Improvements Fund described below. Traffic Improvements. CCLC agrees to construct the traffic improvements reflected on Exhibit "N" in accordance with the time schedule set forth on Exhibit "N" and agrees to post and maintain fiscal deposits in the amount of the Estimated Costs for each traffic improvement in accordance with the schedule set forth on Exhibit "N". Fiscal deposits for traffic improvements may be posted from the Development Credit Bank in accordance with Section 12.4 of this Agreement. A fiscal deposit posted with the City for a traffic improvement will be released by the City when the traffic improvement has been completed by CCLC and accepted by the City. If a traffic improvement has not been completed in accordance with the time schedule set forth on Exhibit "N", the City will give CCLC a written notice specifying the failure and giving CCLC a 30 day opportunity to cure such failure. If such failure cannot reasonably be cured within 30 days, such 30 day period will be extended so long as CCLC commences to cure the failure within the initial 30 day period and thereafter diligently pursues such cure to completion. If CCLC fails to cure a failure to construct a traffic improvement after the notice and opportunity to cure in this paragraph, then the City may cure such failure and draw the fiscal deposit posted by CCLC for such traffic improvements to reimburse the City its actual costs for curing the failure. Any remaining amount in such fiscal deposit after the completion of a traffic improvement by the City will be released. Accordingly, no traffic impact analysis will be required to be performed and no further off-site traffic improvements or facilities will be required by the City to be constructed in connection with the development of the Land in accordance with this Agreement and the Conservation Easement; provided, however that the waivers of traffic impact analysis requirements and any further requirements to construct off-site traffic improvements or facilities will not apply during the continuance of any default by CCLC of its obligations to construct such traffic improvements, and/or post and maintain the requisite fiscal deposits, in accordance with the time schedule set forth on Exhibit "N". Traffic Improvements. A. As part of the development of phase I of the Northgate Project and prior to the Effective Date:
(i) Developer conducted a traffic study to determine the improvements required to provide sufficient transportation access to the Northgate Project (the “Traffic Study”);
(ii) Developer retained, and the County approved, ▇▇▇▇ & Company, LLC, (the “Civil Design Engineer”) a competent professional engineering firm registered in the State of Georgia, to design infrastructure improvements connecting the Northgate Project to Old August Road in accordance with the Traffic Study (the “Initial Traffic Improvements”) as depicted at Exhibit B attached hereto and forming part hereof;
(iii) the Developer’s general contractor determined the estimated cost of constructing the Initial Traffic Improvements, (the “Initial Traffic Improvements Cost Estimate”);
(iv) the Developer determined, in its sole discretion, and to facilitate traffic flow by constructing a roundabout (the “Roundabout”) at the intersection of General Way and Old Augusta Road (the “Intersection”). The Roundabout was one of the Intersection access infrastructure options presented in the Traffic Study and is in accordance with the County’s Effingham County Transportation Master Plan and the Developer’s preferred choice for vehicular access to the Northgate Project. The Roundabout and the improvements as are necessary to connect the onsite road systems of the Northgate Project to the Roundabout and expand existing access from the Northgate Project to the Intersection (collectively, the “Traffic Improvements”) are depicted at Exhibit C attached hereto and forming part hereof; and
(v) based on the results of the Developer’s analysis, discussions with the County, and continuing site plan, feasibility and implementation work to incorporate design updates to the Initial Traffic Improvements, the County approved the revised Traffic Improvements.
B. The Developer’s general contractor prepared an economic analysis of the difference between the Initial Traffic Improvements Cost Estimate and the construction cost of the approved Traffic Improvements, attached hereto as Exhibit D and forming part hereof. Traffic Improvements. In accordance with the Project’s Traffic Impact Statement submitted to City prepared by CivTech dated June 8, 2021, the Developer shall construct two right turn lanes and two driveways to access the subject Property in accordance with the requirements of Arizona Department of Transportation.
Traffic Improvements. (A) The Developer is in the process of completing a traffic study, at the Developer’s sole expense, with respect to the projected effects of the Project and finalizing a traffic plan with respect thereto (the “Traffic Plan”) and obtaining State Traffic Commission approval thereof, to the extent necessary.
(B) To the extent that the Traffic Plan requires a break in the median on State Street to create an entry to the Pitkin Tunnel from the left lane (northbound) of State Street (the “State Street Entry”) the City shall, subject to obtaining all necessary permits and approvals, and at the City’s sole cost and expense, provide a break in, or relocation of, the median, including design and engineering costs, to create a State Street Entry.
(C) The Developer acknowledges that subject to the provisions of Section 8.2(b) above, the Developer shall be responsible, at the Developer’s sole cost and expense, for implementation of the Traffic Plan. The City Traffic and Parking Department shall impose only those obligations on the Developer which are reasonably necessary to mitigate the impact of the Project, as further described in the Traffic Plan or as reasonably determined by the City Traffic and Parking Department and/or as determined by the State Traffic Commission.
Traffic Improvements. City acknowledges and agrees that the Department of Traffic and Parking and the New Haven Parking Authority have indicated their support for the Hospital’s Application to the State Traffic Commission, filed on May 8, 2006. The Application includes preliminary plans for (i) certain traffic improvements at the east end of the Air Rights Garage (“ARG”), including, specifically a roundabout to permit direct access to the ARG from Route 34, (ii) modifications to the ramp system on the south side of the ARG to permit direct egress from the ARG to Route 34, and (iii) modifications to the internal ARG ramps (collectively, the “Traffic Improvements”). The City shall work cooperatively with Hospital (or the private developer selected in accordance with the Ground Lease) in finalizing expeditiously the plans for such improvements and in seeking all necessary approvals for the Traffic Improvements from (A) the State of Connecticut Department of Transportation for Traffic Improvements, and (B) the State Traffic Commission in connection with the Cancer Center/North Pavilion, the Lot E Project and the Park Street Project
Traffic Improvements. Subject to receipt of all Approvals, RW shall be responsible for the payment of all agreed upon costs of improvements to transportation infrastructure including, but not limited to, road construction, bridges, road maintenance and traffic signals necessitated by the Project. The objective of such traffic improvements is to improve the existing road system by providing integrated road system improvements and to allow safe flow of traffic to and from the Project without material adverse impact to the Town.
