13.01 (a) Where it becomes necessary to reduce the working force, the most junior seniority employee within the classification, shift and department affected will receive notice of layoff, provided the remaining employee(s) are qualified by virtue of skill and ability to perform the work required. Employees laid off indefinitely from a permanent job will be provided with a minimum of one weeks’ notice in writing.
Layoff Recall and Bumping. 18.01 A “short term layoff” will be defined as any layoff of five consecutive working days or less. Where a short term layoff is to occur, the Company will endeavour to provide employees and the Union with as much notice as it can, given to the circumstances which require a short term layoff. Employees shall not be subject to being laid off out of seniority in accordance with the “short term layoff” provisions more than one time in any twelve month period.
18.02 “Short-term” layoffs will be carried out as follows: The Company will first identify the classification(s) that will be the subject of a short term layoff. The Company will then lay off employees within the classification(s) as follows:
(a) Probationary employees will be laid off first.
(b) In reverse order of seniority provided the remaining employees have the skill and ability to perform the remaining work without familiarization.
18.03 Employees who are subject to a short-term layoff will have no right to displace another employee in another classification.
18.04 At the conclusion of a short term layoff, all employees will return to the classification they were assigned at the time the layoff took effect.
18.05 In the event of a long-term lay-off the Company will surplus employees based on the following factors:
(a) Probationary employees will be laid off first, followed by:
(b) Employees, in reverse order of seniority, starting with the most junior employees in the affected classification, provided the remaining employees have the skill and ability to perform the work available at the time of lay-off, with a maximum of a five (5) day familiarization period.
18.06 Seniority will be exercised on a job classification, then plant-wide basis.
18.07 An employee can exercise seniority within their classification or to a lateral job classification or may elect to displace the most junior employee at the next succeeding downward classification on the flow chart, provided the employee has the ability to perform the work remaining at the time of layoff, within a maximum of a five (5) day familiarization period.
18.08 An employee who is surplus or displaced shall have the right to elect one of the following:
(a) Accept the layoff; or
(b) Displace the junior employee identified in accordance with Article 18.

Layoff Recall and Bumping. 14.1 The term “layoff” shall be defined as a reduction in the working force which arises from a reduction or shortage of work or from the permanent elimination of aposition.
14.2 In the event of a layoff greater than five (5) working days, the Company will notify employees and the Union, in writing, on the next working day following notification to the Company by the Customer or Board of any situation that gives cause to the layoff. In the case of a permanent layoff, notice or pay in lieu of notice will be provided in accordance with the Ontario Employment Standards Xxx 0000.
14.3 When the Company deems it necessary to reduce theworkforce for a period greater than five (5) working days, the following process will befollowed:
(a) Probationary employees will be laid off first in reverse order of seniority with the most junior employee. The Company xxxxx then layoff employees in reverse order of seniority starting with the most junior employee.
(b) An employee affected by a reduction in the workforce or if an employee’s position is permanently eliminated by the Customer or the Company (ex. Reduction of the number of routes), he/she will have the right to displace a more junior employee. The affected employee will:
1. Select a vacant route within his/her zone, or displace the most junior employee in his/her zone, if qualified. If he/she cannot then;
2. Select a vacant route in a zone, or displace the most junior employee in a zone, if qualified, that is within two (2) kilometres of his/her parkingspace. If he/she cannot then;
3. Accept the layoff with recall rights or;
4. Displace the most junior employee in the bargaining unit.
14.4 If an employee does not have the seniority to remain at work following alayoff, he/she may apply for available work in another division, subject to Article 16.
14.5 Employees will be recalled to work in the reverse order in which they were laid off. The Company will provide the Union Chairperson with the name of any employeewho is recalled.
14.6 When the Company deems it necessary to reduce a position for five (5) working days or less, the employee assigned to the position may be laid off, without regard to seniority, and he or she will not exercise bumping rights. If, the layoff of 5 days or less will effect a group of employees working in the dedicated charter or spare driver position, the reduction will be made by first canvassing for volunteers. (a) Where it becomes necessary to reduce the working force, the most junior seniority employee within the classification, shift and work area affected will receive notice of layoff, provided the remaining employee(s) are qualified by virtue of skill and ability to perform the work required. Employees laid off indefinitely will be provided with a minimum of one weeks’ notice in writing. At the time of receiving notice of layoff, employees will be permitted to indicate their choice of accepting layoff or of exercising their seniority by displacing another employee as described in clause Employees failing to make a choice will be laid At the time of layoff, employees will be entitled to indicate a second choice of recall to another shift or job which will be in addition to the shift and job they had at the time of layoff. Employees who choose to displace will be advised of the job into which they can displace prior to the displacement being effected and will be given a final opportunity to accept layoff. The Company will not be obligated to follow the above or clauses and when layoffs are due to breakdown or other emergency for the rest of the day, or shift on which such breakdown or emergency occurs, except where the Company has information the day prior. Probationary employees in the affected work area will be laid off first in these layoff situations. Employees alleging that they have been laid off improperly must do so in writing not later than working days the effective date of layoff. Such written statement will be submitted directly to the Manager, Industrial Relations at that time and will be treated as a grievance and dealt with at Step 3 of the grievance procedure. Layoff Recall and Bumping. (a) If a reduction in the workforce is necessary an employee in a line of progression will revert down the line to a job previously held to which the employee’s department seniority entitles them. An employee without enough department seniority to remain on any job in the line of progression will revert to a job in the plant to which the employee’s plant seniority entitles them, and which the employee has sufficient ability to perform.
(b) An employee faced with a layoff will displace a junior employee (plant seniority) on any job the employee has sufficient ability to perform. In the event no such job exists, and sufficient ability is attainable, up to seven (7) days training will be given to provide an employee with the sufficient ability, in order to prevent layoff out of seniority.
(c) An employee who bumps to a lower rated job will have their rate “red circled.” In other words, an employee who bumps into a lower rated job will maintain their regular rate they had before the bump, until such time as the rate for the job they bumped into “catches up” to their previous rate, or for a maximum of one (1) year, whichever first occurs.
(d) Laid-off employees will be recalled in order of plant seniority, for any department having a vacancy, provided that the senior employee has sufficient ability to do the job.
Layoff Recall and Bumping. 23.01 It is understood and agreed that the duties required of an employee engaged in school bus industry are of a nature that a driver so involved is deemed to be laid off during the period of the school Christmas break, the school spring break and the school summer vacation. It is further understood that seniority will continue to accumulate during the period of such lay off. At that time the reopening of the school will be deemed in the normal course to constitute a recall notice which shall be deemed to have been given. A failure to return to work in accordance with this clause shall be deemed a "quit".
Layoff Recall and Bumping. If it becomes necessary to lay off employees, those employees with the least Company seniority within an affected job classification shall be laid off first. Employees on layoff shall be recalled in reverse order of layoff beginning with the laid-off employee with the greatest Company seniority within the affected job classification. In the event of a permanent unit closing or layoff, a laid-off employee, based on Company seniority, will be permitted to bump into a position with the Employer in the same classification but in a different location or in a different schedule with comparable total hours, if available, held by an employee in the same job classification with less Company seniority. If there is no less senior person within the same job classification, the employee to be laid off shall be permitted to use his Company seniority to bump to a job classification in which the employee previously worked. Bumping shall not be permitted except in cases of permanent unit closing or layoff.
