PROMOTIONS AND VACANCIES. 3.1 The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification that is being filled. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing agency.
3.2 An agency’s internal layoff list will consist of employees who have elected to place their name on the layoff list through Article 35, Layoff and Recall, of this Agreement and are confined to each individual agency.
3.3 The statewide layoff list will consist of employees who have elected to place their name on the statewide layoff list in accordance with WAC 000-00-000.
3.4 A promotional candidate is defined as an employee who has completed the probationary period within a permanent appointment and has attained permanent status within the agency.
3.5 A transfer candidate is defined as an employee in permanent status in the same classification as the vacancy within the agency.
3.6 A voluntary demotion candidate is defined as an employee in permanent status moving to a class in a lower salary range maximum within the agency.
3.7 When filling a vacant position with a permanent appointment, candidates will be certified for further consideration in the following manner:
A. The most senior candidate on the agency’s internal layoff list with the required skills and abilities who has indicated an appropriate geographic availability will be appointed to the position.
B. If there are no names on the internal layoff list, the agency will certify up to twenty (20) candidates for further consideration. Up to seventy-five percent (75%) of those candidates will be statewide layoff, agency promotional, internal transfers, and agency voluntary demotions. All candidates certified must have the position-specific skills and abilities to perform the duties of the position to be filled. If there is a tie for the last position on the certification for either promotional or other candidates, the agency may consider up to ten (10) additional tied candidates. The agency may supplement the certification with additional tied candidates and replace other candidates who waive consideration with like candidates from the original pool.

PROMOTIONS AND VACANCIES. A. It shall be the policy of Broward County to encourage promotion from within, whenever feasible, consistent with qualified staffing and affirmative action goals. It shall be objective of the County to encourage promotion from within, free of political considerations, nepotism or other forms of unlawful favoritism or discrimination. Promotional appointments shall not be grievable except in cases where the grieving party(s) can substantiate that one of the above considerations resulted in such appointment. If the grieving party(s) pursues the grievance to arbitration and fails to prevail, the full expenses of the arbitrator shall be borne by the grieving party(s).
B. Employees who are interested in being promoted or changing divisions may request to receive notification of future openings in the job classification(s) in which they are interested by using the Human Resources Division’s online application/recruitment system. After an employee completes the electronic request, the online application/recruitment system will notify the employee when the classification is announced. The employee can then apply for the position. There shall be a one hundred and eighty (180) calendar day probationary period served when an employee is promoted. The promotional probationary period may be extended for up to an additional ninety (90) calendar days upon the written request of the Division Director and the approval of the Human Resources Director. If an employee is removed during the probationary period following a promotion for failure to perform satisfactorily the duties of the higher position, he or she shall be returned to the position held prior to the promotion or to a similar position. In cases where this occurs, the employee’s rate of pay will revert to the pay rate the employee would have otherwise been entitled had the promotion not occurred. A probationary promotional appointment does not affect an employee's earned permanent status and rights in the County system acquired in another position. The promoted employee retains the right to bring a grievance under any term or condition of employment specified in this Agreement except that no grievance may be filed on his/her behalf relating to a management decision to return the employee to his/her former or substantially equivalent position during the promotional probationary period. A promotional system will be maintained encompassing merit principles which will recognize County service, including related experience with Port Everglades as a major factor in promotions along with qualifications and work records. It shall be the objective of the County to encourage promotion from within, free of political considerations, nepotism or other forms of favoritism or unlawful discrimination. Promotional appointments shall not be grievable except in cases where the party (s) can substantiate that one of the above considerations resulted in such appointment.
PROMOTIONS AND VACANCIES. 9.1 All promotional vacancies shall be adequately publicized by the Superintendent in accordance with the following procedure:
(a) During the school year when school is in session or when the Principals are required to work, a notice shall be posted in each school building as far in advance as practical, ordinarily at least fourteen (14) calendar days before the final date when applications must be submitted. A copy of said notice shall be given to the MPA President at the time of posting. Principals who desire to apply for such vacancies shall submit their application in writing to the Superintendent within the time limit specified in the notice, and the Superintendent shall acknowledge promptly in writing the receipt of all such applications. Applications shall be kept on file as required by law.
(b) During the summer Principals who desire to apply for a vacancy or new positions which may be filled during the summer period when school is not regularly in session shall submit their names to the Personnel Office on the forms to be circulated by the Personnel Office prior to summer recess. Such notice shall be sent as far in advance as practicable, ordinarily at least twenty-one (21) calendar days before the final date when applications must be submitted and in not event less than fourteen (14) calendar days before such date. In addition, the Superintendent shall, within the same time period, post a list of positions to be filled during the summer period at the administration office, in schools which are open, with a copy of said notice sent to the President of the Montclair Principals Association.
9.2 The qualifications, salary, months of employment and certification required for the position shall be clearly set forth.
9.3 All qualified Principals shall be given adequate opportunity to make application and no position shall be filled until all properly submitted applications have been considered. Each applicant not selected shall, upon request, receive an explanation from the Board. Announcements of the appointments shall be made by posting a list in the office of the central administration and each school building or office and notice shall be given to the interested parties. The list shall be given to the interested Principals. The list shall be given to the President of the Montclair Principals Association and shall indicate which positions have been filled.

PROMOTIONS AND VACANCIES. 1. Full-time vacancies and regular part-time vacancies or new positions created during the life of this Agreement, or until a new Agreement has been executed, shall be posted on the bulletin board.
2. A period of seven (7) working days shall be allowed employees in which to make application for such vacancies or new positions. Should it be necessary to fill a vacancy or new position before the expiration of seven (7) days, the time for such posting shall be mutually agreed upon by the Co-operative and the Union.
3. In filling vacancies or new positions, where merit and ability is sufficient to handle the job to be filled, seniority shall be the governing factor.
4. All employees filling a new position or vacancy shall be allowed a qualifying period of three (3) months. If such employee does not perform the duties satisfactorily within such time, or if the employee so wishes, he/she shall revert to his/her former position without loss of seniority. If it appears to the Co-operative that such employee is incapable of performing the duties satisfactorily, he/she may be required to revert to his/her former position before the expiration of three (3) months.
5. If the Co-operative provides training to fill a vacant position in the Co-operative, the first opportunity will be granted according to seniority if it appears that the senior person has sufficient ability to fill the position.
6. Upon promotion to a position paying a higher rate of pay, an employee shall receive the wage rate applicable to the new position retroactive to the date he/she assumed the duties of the new position. Whenever an employee's rate prior to promotion is within the range of the new classification, his/her rate shall not be reduced, and after promotion, the employee shall be paid his/her regular increment increases until the top of the range is reached.
PROMOTIONS AND VACANCIES. The parties will convene a promotional committee to jointly develop promotional testing procedures. The jointly-developed procedures will be mutually agreed upon by both parties through the Labor Management Committee. Once the parties agree, the procedures will be memorialized and distributed throughout the Department. Once developed, any changes to the procedures must be agreed upon by both parties through the LMC. It will be the responsibility of the Fire Chief to make the promotional selection.

During the posting and selection process, the Employer may assign a person to the job.
10.02 Posted positions within the scope of this Agreement shall be filled on the basis of ability and qualifications. Where ability and qualifications are equal and sufficient, the senior applicant will be selected. No outside applicant will be hired if an internal applicant has sufficient ability and qualifications to do the job.
10.03 Employees who fill a vacancy under this clause shall have twenty (20) working days to determine whether they wish to retain the job or to satisfy the Employer of their suitability for the job. If either of the above occurs, the employee will revert to his/her former position and all other employees will be placed in the positions held before the vacancy was filled.
10.04 Employees who are going to be absent from their place of employment may, prior to their leaving or during their leave, apply for specific vacancies, new jobs or positions that might or do occur during their absence.
