VACANCIES, TRANSFERS AND PROMOTIONS. A. As it relates to individual employees who are not regulated by the Teacher Tenure Act, a vacancy is defined as a newly created position or a current position in the bargaining unit which the Board intends to fill which has become open due to death, reassignment, retirement, resignation or dismissal of an employee. Such positions will not be posted until all teachers are assigned.
1. The above vacancies shall be posted online and via school email to all staff.
2. Positions as described above shall be posted at least ten (10) business days prior to being permanently filled, unless the vacancy occurs and is posted within ten (10) business days of the first official teacher work day of the school year. In that case, the posting period will be five (5) business days.
3. Any employee may apply for such positions by submitting a written letter to the Superintendent's Office.
4. After the last instructional day of the year, the Board shall post vacancies at the Superintendent’s Office. An employee with a request for a transfer on file under D. below or who has requested summer vacancy notices under C. below will be notified.
B. As it relates to individual employees who are not regulated by the Teacher Tenure Act, an employee desiring to learn of position vacancies that occur during the summer shall leave self-addressed, stamped envelopes in the Personnel Office. Application for and filling of such summer vacancies shall follow the procedures in B. above.
C. As it relates to individual employees who are not regulated by the Teacher Tenure Act, a request by an employee for transfer to a different building or position may be made at any time. Such request shall be made in writing to the Personnel Office with a copy to the Association President. The application shall set forth the school, grade or position sought, and the applicant's qualifications. Such request shall be reviewed twice each year to assure active consideration by the Board. In the event an employee is granted a transfer, the record of the transfer and any pertinent information related to the transfer shall be placed into the employee’s personnel file. No employee will be discriminated against because of a request to transfer.
VACANCIES, TRANSFERS AND PROMOTIONS. 3 A. A vacancy shall be defined, for purposes of this Agreement, as a position previously held by 4 a bargaining unit member, an administrative secretarial position, a newly created position, 5 or changing a part-time position to a full-time position within the bargaining unit. No vacancy 6 shall be filled until it has been posted for at least ten (10) working days.
7 B. Whenever a vacancy occurs or is anticipated, the Office of Personnel shall immediately 8 notify, in writing, the Association. Notice of such vacancy shall be sent to all Association 9 members and shall be mailed to each laid-off bargaining unit member.
10 C. Members of the bargaining unit shall be granted full consideration in the filling of any 11 vacancies. Vacancies shall be filled on the basis of experience, competency, qualifications 12 and seniority of the individual. Currently employed bargaining unit members shall be 13 considered for any vacancies before laid-off bargaining unit members subject to recall, 14 regardless of the seniority of the laid-off bargaining unit member.
15 D. No employee shall suffer a reduction of pay because of an involuntary transfer.
16 E. Current employees moving to another position in a higher classification shall be considered 17 to be in a trial period during their first ninety (90) calendar days in the new position. During 18 this trial period, the employee shall receive training in the duties of the new position. The 19 trial period may be extended to a maximum of 180 calendar days only by mutual 20 agreement. Upon completion of the trial period, the Board shall notify the employee and the 21 Association.
22 F. If before the end of the trial period the employee’s performance is found unsatisfactory by 23 an evaluation procedure, or at the employee’s discretion, the employee shall move back to 24 their previous classification and position.
25 G. When question of performance arise, the supervisor will evaluate the employee and give 26 them specific directions for improvement. Training will then be provided. A lack of 27 communication by the supervisor will result in a satisfactory evaluation.
28 H. In the event of transferring to another position or retirement, the employee training the 29 replacement employee will receive an additional $.40 an hour over the trainer’s current 30 wage during training. Training hours will be verified and agreed upon by the transferring or 31 retiring employee and the direct supervisor of the vacated position.
VACANCIES, TRANSFERS AND PROMOTIONS. A. A vacancy shall be defined as a newly-created position or a present position that is not filled.
B. All vacancies shall be posted in a conspicuous place in each building of the district for a period of ten [10] work days. Said posting shall contain the following information:

VACANCIES, TRANSFERS AND PROMOTIONS. College is recognized as having the sole authority to appoint an applicant to a vacant College position. When the College determines that a vacancy will be filled, it will post a notice of the vacancy. Vacancies shall include newly created positions. For the purpose of this Article, promotion shall be defined as an appointment to a position of a higher job grade; a change in job title without a change in job grade shall be considered a lateral appointment.
VACANCIES, TRANSFERS AND PROMOTIONS. Section 5.7.1 Employees shall have the right to apply for and be interviewed when vacancies occur or new positions are created for which they are qualified. Vacancies and new positions shall be posted at least seven (7) calendar days except for 1) bus driver positions, which shall be filled pursuant to Section 5.3 and its subsections, and 2) Level I, II or III substitute or temporary positions which are not required to be posted. All transfers must be approved by the appropriate supervisor or administrator.
Section 5.7.1.1 When a vacancy occurs due to separation from employment (i.e., resignation, retirement, death, or reassignment) the District shall make every effort to fill the position within twenty-five (25) workdays from the initial posting date, absent unusual circumstances.
Section 5.7.2 Positions shall be filled among the best-qualified applicants. In the event of a tie among equally qualified in-district applicants, or between in-district and out-of-district applicants, seniority shall be used to break the tie.
Section 5.7.3 The reasons for an applicant’s non-acceptance for transfer or promotion will be given upon written request. After receiving the written request for reasons for non-acceptance, an employee may request in writing to meet with a Review Committee (composed of the Union President, Assistant Superintendent for Personnel and Labor Relations, and the involved supervisor) to discuss reasons for the affected employee’s non-acceptance.
Section 5.7.4 The District will provide in-service training for the specific purposes of improving work-related skills and knowledge. Employees shall be paid for all time spent in approved training during regular working hours.
Section 5.7.5 In the event a regular employee is selected to fill another position in this bargaining unit, with the exception of bus driver positions, then the employee shall have twenty (20) workdays to return to their former
Section 5.7.6 The District shall provide the Union president with a list of employees included on interview teams for SEIU positions.
Section 5.7.7 Involuntary Transfers The District reserves the right to involuntarily transfer employees in the best interest of the District. The District shall give the employee being transferred at least five (5) working days written notice before the date of involuntary transfer and a copy of such notice shall be sent to the Union President. VACANCIES, TRANSFERS AND PROMOTIONS. A. A vacancy shall be defined as a position which is unfilled because it is newly created or because the employee who previously held the position permanently separated from employment as a result of retirement, resignation, death or discharge. Vacancies shall be posted in the event the Board, in its discretion, determines the vacancy should be filled. Vacancies may be filled on an interim basis while they are posted. The position will be filled within 30 days of the posting deadline.
B. All vacancies shall be posted in a conspicuous place in each building of the District for a period of at least ten (10) working days. Said posting shall contain the following information.

VACANCIES, TRANSFERS AND PROMOTIONS. 11.1 A vacancy shall be defined as an opening for a period greater than ninety (90) days in a classification previously held by a Bargaining Unit Member or a newly created position. No position shall be filled until it has been posted five (5) working days, and shall be awarded ten (10) working days after the administration has determined to fill the position. In filling vacancies that are across classifications: i.e., a bus driver applies for a custodian's position, the administration shall evaluate the credentials of the applicants to determine their ability to do the job. The most qualified applicant shall be awarded the position. If the bargaining unit member is deemed not to be qualified, s/he shall be given the reasons as to why s/he was not deemed the most qualified. In the event of promotion in or transfer from one classification to another, the bargaining unit member shall be given a twenty (20) workday trial in which to show his/her ability to perform on the new job. The Employer shall give the promoted or transferred bargaining unit member reasonable assistance to enable him/her to perform up to the Employer's standards on the new job. If the bargaining unit member is unable to demonstrate ability to perform the work required during the trial period or at the option of the affected bargaining unit member, the bargaining unit member shall be returned to his/her previous assignment.
11.2 When a vacancy occurs, the Employer will send a copy of the notice to the Union and a copy will be posted in each building. SUCH POSTING SHALL CONTAIN THE FOLLOWING INFORMATION: 1) TYPE OF WORK, 2) LOCATION OF WORK, 3) STARTING DATE, 4) RATE OF PAY, 5) HOURS TO BE WORKED, 6) CLASSIFICATION, 7)
VACANCIES, TRANSFERS AND PROMOTIONS. A. Unless required otherwise by law, the assignment, promotion, and transfer of Employees shall conform to the provisions of this Agreement.
B. A vacancy shall be defined, for the purpose of this Agreement, as an open position previously held by a Bargaining Unit Member, which the Employer intends to fill, or a newly created position within the Bargaining Unit. No vacancy shall be filled on a permanent basis until it has been posted for at least five (5) working days.
C. All notification of vacancies shall be posted, in writing, to members of the Bargaining Unit at least two (2) working days before the notification is given to other persons or outside agencies. Said posting shall contain job classification, minimum qualifications, hours, immediate supervisor, work year, date of vacancy, and whether the vacancy is permanent or the temporary period to be filled. A vacancy that can be filled by a laid off Employee does not need to be posted.
VACANCIES, TRANSFERS AND PROMOTIONS. A: For purposes of this Agreement, a vacancy shall be defined as an open position known by the administration to have no ancillary staff with an outstanding right to return to the position for a full year or no displaced ancillary staff who are qualified for the position. A displaced ancillary staff is an individual whose position has been eliminated. It is understood that during a reduction in personnel, both voluntary and involuntary transfers may occur prior to the filling of vacancies.
VACANCIES, TRANSFERS AND PROMOTIONS. A. A vacancy shall be defined as any position, either newly created or a present position, which is not filled, that the Board wishes to fill. Substitutes or temporary employees from outside the bargaining unit will not be used to fill a vacant position for longer than twenty (20) working days. The Board shall use a current bargaining unit member for longer than twenty (20) days in the case of filling a position created by a bargaining unit member being on leave, if another bargaining unit member is interested in doing so and meets the job requirements as described in IX c.
B. If a bargaining unit member chooses to displace another bargaining unit member in the unit, they must first displace the least senior member within their classification. However, if the member is unable to displace another bargaining unit member in the same classification and still maintain their current hours, they may then choose to displace the least senior bargaining unit member in the bargaining unit closest to their hours regardless of classification provided they are qualified and possess the necessary skills under the guidelines in Article IX C of the Agreement.
C. All vacancies shall be posted in the main office, kitchen, and couriers/custodial/maintenance personnel break room of each building of the District, staff lounge and in the mechanic’s workroom of the bus garage for a minimum period of ten (10) days. Posting will indicate:
