Medical Leave Bank. Such leave is to be used only in the event of illness or injury of the member or the member's immediate family, or other events authorized in this Article. There will be no further additions to the medical leave bank. The medical leave bank balance can be authorized for use only after the personal leave balance has been exhausted, except that any one (1) medical disability which prevents the employee from working, as certified by the attending health care provider, which exceeds five (5) consecutive working days shall be charged as follows:
1. to personal leave up to a maximum of five (5) consecutive working days.
2. after exceeding the five (5) consecutive days the total leave taken shall be charged to the medical leave bank.
3. if the medical leave bank has been exhausted, the leave shall be charged to personal leave. Such illnesses shall in all cases require a report from a health care provider recognized under the FMLA.
Medical Leave Bank. Any team member may become a member of the Medical Leave Bank by authorizing the donation of fifteen (15) hours of leave to the Bank on the form provided by the Employer. Newly-hired bargaining unit members must donate within the first one hundred (100) days of employment. Existing bargaining unit members may join by donating during an annual enrollment window of November 1 to December 15 each calendar year. Failure of the bargaining unit member to join by notification to the Employer during this period renders the bargaining unit member ineligible for use of the Medical Leave Bank for the following year. Thereafter, members of the Bank shall donate to the Bank a leave day (8.0 hours) the first pay period of each year until the Bank reaches a maximum balance of 120 days (960 hours). Except for new participants, no more leave donations will be deducted until the Bank is depleted to 60 days (480 hours). When the 60 day (480 hours) minimum is reached, each member of the Bank will again contribute one leave day (8.0 hours) each December 16 until the Bank again reaches a maximum of 120 days (960 hours).
Medical Leave Bank. Such leave as is provided in Paragraph A, above, shall be available for use in the event of a medical disability which prevents the employee form working or illness or injury to a member of the employee’s immediate family. The supervisor may require a physician’s certificate. If the employee has no Medical Leave Bank leave balance, or if that balance is exhausted during the period of disability/absence, leave shall be charged to the employee’s Personal Leave accrual in accordance with Section 8.04 - Utilization & Disposal, of this article, below.
Medical Leave Bank. The Fraternal Order of Police (FOP) Medical Leave Bank hereinafter referred to as “the Bank” will continue in effect. Membership in the Bank will be voluntary for all employees hired after June 25, 1997. All new employees who request membership in the bank will be assessed 8.5 hours of medical leave for deposit in the Bank. An employee in the bargaining unit may receive a grant from the Bank only after:
1. Filing an application with the Medical Leave Bank Committee.
2. Submitting satisfactory medical evidence of the illness or injury.
3. Submitting evidence of having exhausted all accumulated leave. The Board of Directors of the Bank shall be composed of two (2) representatives of the FOP appointed by the FOP President and two (2) representatives of the Employer appointed by the Police Commissioner. New employees must join the Bank within the first thirty (30) days after completion of their entrance level training or lose their right to join until the next contribution period. Employees may relinquish their membership in the Bank at any time; if they do so, however, they will lose their contribution in the Bank and will not be allowed to join again until the next contribution period. All contributions will remain in force and cannot be returned even upon cancellation of membership. Unused medical leave days in the bank at the end of the year shall be carried over to the next year. On or before April 1, 2012, the Labor Commissioner will convene a labor-management committee to establish an audit system which will keep accurate records of the number of days in the leave bank and to otherwise monitor activities of the medical leave bank. Medical Leave Bank. An employee transferring into the bargaining unit who has sick leave credited to their State sick leave account, shall have fifty percent (50%) of such leave transferred to their personal leave account and fifty (50%) transferred to a medical leave bank. Effective July 1, 2011, members who were employed on June 30, 2011 shall have fifty percent (50%) of any sick leave transferred to their personal leave account and fifty percent (50%) transferred to a medical leave bank. Members may use medical leave in the event of a medical disability which prevents the member from working or an illness or injury to the member or the member’s immediate family. If the member has no medical leave or if his or her medical leave balance is exhausted during the period of disability/absence, leave will be charged to the member’s personal leave balance. An injury or illness for which medical leave is taken may require a report from a licensed physician, at the discretion of the supervisor.
Medical Leave Bank. (MLB) Eligible employees covered by PTO also earn hours in a medical leave bank (MLB). MLB helps cover extended absences from work due to illness, injury, or disability. The hours are earned in a separate bank from PTO hours. The rate of accrual is seven (7) days per year for full-time employees. Eligible part-time employees receive pro-rated MLB based on hours paid. The maximum accrual is ninety (90) days MLB. In order to use MLB, an employee must first use PTO equal to one-half their authorized hours, or unpaid time if PTO is not available. An employee shall have the option to use PTO rather than MLB once they have reached one half of their authorized hours in PTO. An employee who is currently and has been continuously authorized forty (40) hours per two week pay period for at least twelve (12) months may use MLB for extended absences due to an illness of or an injury to the employee’s dependent child for such reasonable periods as the employees attendance with the dependent child may be medically necessary on the same terms as the employee is able to use MLB for the employee’s own illness or injury. Dependent child for purposes of this section is defined as a child who is born to the employee, adopted, a stepchild or a xxxxxx child, under the age of 18, or under age 20 and still attending secondary school.
Medical Leave Bank. 1. All classified staff employees who are not members of the Medical Leave Insurance Bank will be automatically enrolled on September 30, with a donation of two (2) days of sick leave. If the staff member does not have two (2) days as of September 30, membership will not occur. Staff can reject membership by notifying the Ddistrict office in writing with a signature prior to September 30. Classified staff hired after September 30 may join the Medical Leave Bank with a donation of two (2) days of sick leave. Notice must be given to the Ddistrict office in writing within ten (10) days of the start date. This donation will qualify the staff member for the first year of membership regardless of the hire date.
2. Only those who have contributed days to the bank may apply for days from the bank.
3. Members of the bank may apply for time from the bank for their own personal illness only after they have exhausted their own medical leave. Time granted to a bank member shall be equivalent to the daily assigned work hours of the member of each day of benefit approved. Employees receiving time loss benefits through disability insurance are ineligible to receive time from the bank in excess of their current wage.
4. When a member applies for time, in writing, he/she they must furnish certification from two (2) different a doctors that the illness or injury is of a serious emergency nature which prevents him/her them from performing assigned duties and medical treatment cannot be delayed until the next vacation period or the following summer. Medical leave bank hours are to be used exclusively for the treatment of the illness or injury described by the doctors in this section.
5. The maximum time a member can draw would be ten (10) days during any one
(1) contract year after one (1) year of membership in the bank; twenty (20) days after two (2) years; thirty (30) days after three (3) years; and the maximum time a member can draw would be forty (40) days during any one (1) contract year after four (4) years of membership in the bank. Members may receive time from the bank for intermittent days missed from work in any given year for a prescribed medical treatment. Following any use of the medical leave bank, the member must rejoin the bank according to this article with benefits to accrue at the rate described above.

Medical Leave Bank. Except for conversions due to retirement as later noted herein, the first three hundred sixty (360) hours of unused Medical leave shall accumulate into a Medical Leave bank and be available to the employee solely for the purpose of Medical Leave.
Medical Leave Bank. Full-time and part-time faculty may voluntarily donate one (1) emergency day from their sick day accruals per academic year during designated open periods. There shall be two open periods for donation to the Medical Leave Bank from November 1 to December 1 and April 15 to May 15. Unused time will remain in the Medical Leave Bank. Only those full-time and part-time faculty faced with a medical leave in the first seven (7) years of employment who have exhausted all of their sick leave are eligible to apply for additional medical leave from the bank. The request to use the medical leave bank needs the approval of the College President or designee which shall not be withheld unreasonably. A medical leave is any medical necessity which requires the faculty member’s absence for a period of seven (7) consecutive calendar days as defined in Article 6.12 due to the faculty member’s health condition. The faculty member must provide medical verification from a physician to support a request for medical leave because of the faculty member’s health condition. Elective or optional surgery is not considered a reason to use this medical leave bank. The maximum amount of time that can be received through the Medical Leave Bank based on availability shall not exceed the equivalent of three (3) calendar months during the seven (7) years of eligibility. The Medical Leave Bank may be used to compensate for days in the academic calendar as defined by Article
