Sick Day Bank. Upon hire an employee will earn one (1) shift for every month of active service to a maximum of 10 shifts. Any unused sick days will be accumulated in to the employee’s Short Disability Bank. Neither of these banks is redeemable for cash.

Sick Day Bank. 1. The Sick Day Bank is a program to offer assistance to employees in time of extended illness in the form of extension of their accrued personal sick days. It is not the purpose of the Bank to provide for an illness of a brief nature. The Sick Day Bank is a cooperative program whose implementation and maintenance is dependent on employee support. 2. The Bank will be built up once annually, as needed, by the employees contributing one or more of their accumulated sick leave days to the Bank. No days will be added to the Bank until the number drops below 300 days. At the end of the school year, any unused sick days remaining in the Bank will be carried over to the next year. 3. In the event that the Board of Education and the WCMA agree to dissolve the Bank for whatever reason, all days left in the Bank will be divided equally by the employees. No employee will receive more days than he/she has contributed to the Bank. 4. The Board of Trustees shall consist of five (5) WCMA members, appointed by the WCMA annually to receive requests for the use of sick leave days in the Bank and to determine whether to recommend such requests for approval. 5. The Trustees shall provide the Board annually with the names of employees who contributed to the sick leave bank and the number of days they contribute. The Board of Education shall maintain records on the donation and usage of sick leave bank days, which shall be the records relied on by all parties involved. At the end of each school year, the Board of Education shall provide the WCMA a written accounting of donation and usage for that year to support the total number of days shown by the Board of Education as remaining in the Bank. 6. The Board of Trustees reserves to itself, the right to have a second medical opinion of the employee making the claim for Bank use. The cost for such examination shall be paid for by the employee and the doctor used will be of the Bank’s choice. 7. The trustees of the Bank will be limited to granting up to sixty (60) school days at one time. A member may request additional sick leave by submitting a request and a doctor’s certificate. 8. If in the judgment of the Trustees the employee qualifies, the Trustees shall submit the request to the Board of Education. If the Board of Education agrees with the Trustees, the Board of Education will arrange payment to the employee. Sick Day Bank. Effective with the 1991-1992 school year, a Sick Day Bank shall be established. The purpose of the Sick Day Bank is to provide paid days for serious personal illness or family illness to contributors to the Bank who have exhausted their accumulated sick days and accrued vacation days and who are experiencing prolonged personal or family illness. Members may enroll in the Sick Day Bank during the initial enrollment period, which shall be the month of September, 1991, or during the subsequent enrollment periods, which shall be during the month of September of each school year. Upon enrollment, a member shall contribute one (1) of his/her accumulated sick days to the Sick Day Bank. Days contributed to the Sick Day Bank are non-returnable. Annually thereafter, members will be assessed one-half (1/2) day during the enrollment period to remain a member of the Bank, unless the Sick Bank Committee waives the assessment. Enrollment in the Sick Day Bank shall be continuous from year to year until a member withdraws. Withdrawals are accepted only during an enrollment period and only upon written notice by the member to the Sick Day Bank Committee (SBC) of his/her intent to withdraw.
Sick Day Bank. Each new teacher, or teacher who has borrowed days from the bank and has not repaid, may voluntarily donate one (1) or more days of accumulated sick leave, at the beginning or end of the school year, to a Sick Day Bank which shall be used in the event of an illness by a teacher who has exhausted their sick leave accumulation. If a new teacher has not donated to the sick day bank, they will not be allowed to draw from the bank. The bank shall be controlled solely by a committee composed of three (3) teachers and an administrator, all of which are selected by the Association. The above committee shall determine who shall be eligible to draw from the bank and shall establish whatever rules, guidelines or procedures it deems necessary for the fair and equitable management of the bank. The maximum number of days per illness or disability of the teacher is eight (8) days. A teacher granted days will sign a written contract supplied by the Sick Day Bank Committee acknowledging the obligation to repay the Bank from the ensuing year’s credit. If the teacher separates employment, goes on extended unpaid leave or is laid off and the days are not repaid in full, the District reserves the right to deduct the day(s) due on behalf of the Sick Day Bank Committee from the employee’s accumulated sick leave days in order to restore the Bank and if insufficient days are available, the balance remains due and payable by the teacher to the Bank prior any terminal pay distribution. The Committee and Association shall hold the Board harmless in any dispute which might occur as the result of any action by the Committee and shall reimburse, from Association funds, any judgments or expenses, including attorney fees, resulting from any actions against the Committee. Days in the sick day bank shall accumulate to not more than one hundred-fifty (150) days and they shall not be returned to the donor, if unused. At any time when there is a catastrophic illness of a teacher or the Bank has been depleted to less than twenty-five (25) days, the Association may request that the Board allow teachers to make an additional contribution to the Bank. A teacher leaving the district may contribute, upon departure, up to one-half (1/2) of their remaining sick days (minus any days owed to the Bank) to the Sick Day Bank.
Sick Day Bank i. A voluntary teacher sick day bank will be established. A teacher must contribute two (2) sick days to become a member and one (1) sick day each year thereafter to continue membership. In order to qualify for membership in the sick day bank, a teacher wishing to participate shall notify the designee of the Board in writing of his/her intention to participate on or before the 15th day of October. Such authorization shall remain in force until the teacher withdraws from the program in writing. Sick Day Bank. The Union will develop and maintain a Sick Day Bank ("Bank") to be operated by a Board of Trustees ("BOT") appointed by the Union. The Union will inform the Board of Education ("BOE") of the names of the employees who have contributed days to the Bank and the names of employees who are to receive days from the Bank. Upon receipt of the names of participants in the Bank the BOE will record the transfer of the teacher's day(s) to the Bank. When the BOE receives notification of a grant of days to a teacher, the BOE will credit the teacher with the number of days specified by the BOT. The BOE shall have no other duties or functions with respect to the Bank that are not explicitly set forth in this Section. Any disputes between employees regarding the Bank shall be resolved exclusively by the Union. Bargaining unit members may not file a grievance to resolve disputes over the provisions of this section. The Union may file a grievance to resolve a dispute limited to the BOE's recording and transfer of days but only after first giving the BOE written notice of the alleged discrepancy and the opportunity to resolve the discrepancy. The Union shall indemnify and hold harmless the Board of Education, it members, officers, agents, and employees from and against any and all claims, demands, actions, complaints, suits, or other forms of liability that shall arise out of, or by reason of action taken by the Board of Trustees in the operation of the Sick Bank.
Sick Day Bank. 22.1 For the purposes of this article, sick leave is defined as those periods when an Employee takes leave with pay pursuant to Article 22.2 because the employee is ill or disabled for reasons not covered by the Workers’ Compensation Act and as a result is unable to attend work. For the purposes of this article, compensation for a sick day shall be equal to the hours of work scheduled on the day taken. 22.2 Permanent Employees shall be eligible for one (1) day of sick leave for each month of service. Other Employees shall be entitled to the number of sick days dictated by provincial regulation. 22.3 The yearly sick leave entitlement of twelve (12) days shall be credited to an employee’s sick day bank on January 1st of each year of service. In the first year of employment, the number of sick days for the remainder of that year shall be credited to an employee’s sick bank upon completion of probation. However, should the employment of such employee be terminated for any reason before the yearly sick-leave advance entitlement has been earned that year, an adjustment shall be made to the employee’s final cheque to repay such advances. 22.4 Unused sick days from the previous calendar year shall be carried forward for use in subsequent years, at a rate of 50% of the unused entitlement. The maximum days in the sick bank shall be twenty (20) days. 22.5 No cash payment for unused sick leave will be paid to any employee leaving the service of the G.I.T.D.. 22.6 The G.I.T.D. reserves the right to require satisfactory proof of illness before any paid sick leave is granted. 22.7 A full time employee who receives wage loss benefits from the Insurance Corporation of B.C. or a court action shall reimburse the G.I.T.D. (at the rate paid out) for benefits received under this article up to the amount of: a) benefits received from the G.I.T.D. as sick leave; or b) benefits received from the Insurance Corporation of B.C. or a court action and designated as compensation for loss of wages; whichever is less. It is understood that this provision is not intended to affect a private insurance program carried by a regular full-time employee.
Sick Day Bank. A Sick Day Bank will be established in this school district under the following conditions: 6.1 All contributions will be voluntary. 6.2 Any professional employee in the negotiating unit whose position requires a teaching certificate is eligible to participate. 6.3 The sick day bank may only be used for involuntary disabilities or illnesses. Involuntary illness or disability shall be further defined as a period during which a person is recuperating from an injury or a prolonged serious illness. An employee who has a disability covered by the provisions of the Workers' Compensation Law shall not be entitled to use the sick day bank.
