Where the Employer proposes to transfer an employee from one location to another as a result of a client request, or as a part of a disciplinary process, the employer shall notify and discuss the matter with the Union prior to the transfer taking place and the Union shall have the right to grieve the transfer.

Site Transfers. 2.7.1 Operational requirements may on occasion necessitate the transfer of Employees covered by this Agreement from the site to another site. The ability to transfer Employees between sites is a crucial aspect of the Company’s operational business.
2.7.2 The process of transferring an Employee to an alternate site must be conducted fairly and appropriately to address both the requirements of the business and of the Employee.
2.7.3 For the purpose of this clause, site transfers are defined as transfers where Employees may be relocated to an alternate site for an extended period, which has a typical duration of greater than two (2) roster tours. The short-term transfer (i.e. transfer for less than two (2) roster tours) of Employees between operational sites for relief or operational purposes is not considered a site transfer. A fair and reasonable process will apply in the case of short-term transfers.
2.7.4 Site transfers may be necessary in situations including, but not limited to, the following:
a. temporary reduction of plants production capacity as dictated by Clients;
b. requirement for additional resources to perform Sedgman CHPP Commissioning activities;
c. cessation of Sedgman CHPP operating contracts; or
d. establishment of new Sedgman CHPP operational sites.
2.7.5 Where an Employee transfers to an alternate site to carry out commissioning activities, the Employee will be paid a commissioning allowance for the relevant period in accordance with clause 4.6.
2.7.6 The following procedure shall apply once the Company has identified the need for site transfer(s) to occur:
Step 1: All relevant details relating to the required transfer/s shall be communicated to Employees and will include, but may not be limited to, the agreed period of the transfer, accommodation / travel arrangements, the applicable roster, associated remuneration and any annual leave limitations.
Step 2: In the first instance, current Employees will be asked to volunteer to meet this transfer requirement. Volunteers shall be assessed based on their suitability to fulfil the requirements of the role and may not obtain automatic acceptance.
Step 3: In the event that insufficient suitable candidates are obtained from the volunteering process, the Company may select suitable Employees to be seconded to any of the other Company CHPP sites.

Site Transfers. Wherever possible the Employer agrees to give an employee, who is to be transferred to an alternate site, at least two (2) hours of advanced notice in order to finish their daily duties, to gather tools and personal items. The Employer agrees that notice will only be given during regular working hours unless deemed an emergency. Employees will still be expected to complete their daily duties during this time. Site Transfers – Out of Town – Wherever possible, the Employer will give employees two (2) days’ notice of transfer to or from an out of town site.
