GRANTEE RESPONSIBILITIES. To participate as a provider under this Contract, the Grantee must: 2.1 Ensure compliance with this Contract, including these Grantee requirements; 2.2 Ensure compliance with all applicable federal and state laws, rules, regulations, standards, guidelines, and policies in effect on the beginning date of this Contract unless amended, including, but not limited to, Texas Health and Safety Code Chapter 31; 2.3 Ensure compliance with all state and federal statutes and regulations, HHSC rules, policies, procedures, and guidelines governing the Program, included but not limited to, TAC Title 25, Part 1 Chapter 39, and - Subchapter A, §39.1 -§39.11. The foregoing rules in TAC Title 25 - as they relate to the Program may be further modified and revised- within their existing title- during the term of the Contract. GRANTEE RESPONSIBILITIES. Grantee shall: A. Make strategic investments to support hiring, retaining, and training the public health workforce and strengthen public health infrastructure and systems related to the workforce and foundational capabilities in alignment with the Strengthening U.S. Public Health Infrastructure, Workforce, and Data Systems (Funding Opportunity Number CDC RFA OE22-2203) from the Centers for Disease Control and Prevention (CDC). B. Complete all activities required and allowable under this Contract by November 30, 2027 and complete all reports by the due dates listed in Article III. C. Perform required activities intended to help meet critical infrastructure needs and make possible strategic investments that will have lasting effects on public health agencies. Recipients should prioritize recruiting and hiring staff who are from the communities and populations served. Recipients should demonstrate a commitment to diversity, health disparities, inclusion, and accessibility in their workforce recruitment and selection processes, communication, and outcomes. Required activities include: 1. Recruit and hire new public health personnel (professional, clinical, disease investigation, program and/or administrative); expand recruitment efforts; create new positions, improve hiring incentives; and create new hiring mechanisms. Personnel may be permanent full or part-time staff, temporary or term-limited staff, fellows, interns and/or contracted employees. 2. Retain public health staff, strengthen retention incentives, and create promotional opportunities (e.g., career ladders, succession planning). 3. Support and sustain the public health workforce and strengthen workplace well-being programs and expand engagement with the workforce to address their mental, emotional, and physical well-being. 4. Train new and existing public health infrastructure grant staff and improve the quality and scope of training and professional development opportunities for staff. 5. Strengthen workforce planning, systems, processes, and policies; maintain and upgrade human resource systems; identify ways to better collect and use workforce data; and identify policies that could facilitate more efficient and effective workplace development and management. 6. GRANTEE RESPONSIBILITIES. To participate as a provider under this Grant Agreement, the Grantee must: 1.1 Ensure compliance with all obligations and contractual responsibilities of Grantee as set forth in the Grant Agreement, and comply with the Title V Maternal and Child Health Policy Manual, the System Agency request for applications (RFA) No. HHS0013927, and any changes to the policy manual made through the entirety of the Grant funding period. 1.2 Provide or assure the provision of child health and/or child dental services for Clients, including but not limited to screening and eligibility determination, direct clinical and/or dental services, laboratory services, and case management and appropriate referrals, as necessary. Grantee shall have an established referral relationship with a qualified provider for each approved service which it does not provide. 1.3 Submit a monthly voucher packet and corresponding billing strip, which include all services performed for the corresponding month, within thirty (30) calendar days after the end of the preceding month, according to the business requirements in the current Title V Maternal and Child Health Policy Manual (Policy Manual) which can be accessed at: xxxxx://xxx.xxx.xxxxx.xxx/providers/health-services-providers/title-v-maternal-child- health-fee-service-program. 1.4 Provide Title V Child Health and/or Dental Services in accordance with the Program Manual and in accordance with the terms of this Grant Agreement. 1.5 Provide services only to eligible individuals per the Policy Manual: Grantee shall follow requirements for presumptive eligibility and eligibility screening per the Policy Manual. A. Children and adolescents who would otherwise meet Title V eligibility requirements but lack the required documentation for full eligibility shall also be provided services on a short-term basis under presumptive eligibility guidelines, as outlined in the Program Manual. Individual Client eligibility shall be determined on an annual basis and at other times as necessary, based upon change in income; and B. Grantee will screen all Applicants for Title V eligibility and determine eligibility using a Title V program-approved screening process. GRANTEE RESPONSIBILITIES. (A) The Grantee agrees to abide by all applicable local, state, and federal laws, rules, ordinances, and regulations in the performance of this grant. (B) All local, state, and federal permits, if required, are the responsibility of the Grantee. Award of this grant is not a guarantee of permit approval by the State. (C) The Grantee shall be solely responsible to pay all applicable taxes and fees, if any, that arise from the Grantee’s receipt or execution of this grant. (D) The Grantee is responsible for the professional quality, technical accuracy, timely completion, and coordination of all designs, drawings, specifications, reports, and other services submitted to the State under this Agreement. The Grantee shall, without additional compensation, correct or revise any errors, omissions, or other deficiencies in drawings, designs, specifications, reports, or other services. (E) The State’s approval of drawings, designs, specifications, reports, and incidental work or materials furnished hereunder shall not in any way relieve the Grantee of responsibility for the technical adequacy of the work. The State’s review, approval, acceptance, or payment for any of the services shall not be construed as a waiver of any rights under this Agreement or of any cause of action arising out of the performance of this Agreement. (F) The Grantee acknowledges that it is a crime to knowingly and willingly file false information with the State for the purpose of obtaining this Agreement or any payment under the Agreement, and that any such filing may subject the Grantee, its agents, and/or employees to criminal and civil prosecution and/or termination of the grant.

B. Complete all activities required and allowable under this Contract by June 30, 2023. C. Perform required activities intended to slow the transmission of COVID-19, minimize morbidity and mortality, preserve function of healthcare workforce and infrastructure, and minimize social and economic impacts. Required activities include: 1. Hire public health personnel (professional, clinical, disease investigation, program and/or administrative) in support of COVID-19 and infectious disease preparedness and response. Personnel may be permanent full or part-time staff, temporary or term- limited staff, fellows, interns and/or contracted employees. 2. Establish a formal committee that will ensure Grantee’s health programs, methods and outcomes meet the diverse needs of the communities served. a. Within 30 days of Contract execution, submit a roster of this committee that describes how members are reflective of the communities to be served and can best address community public health needs to XxxxxxxxxXxXx@xxxx.xxxxx.xxx and the assigned Contract Manager. b. Within 60 days of Contract execution, submit proposed plan to address health disparities, and your training plan to XxxxxxxxxXxXx@xxxx.xxxxx.xxx and the assigned Contract Manager, using the template provided by System Agency. 3. Provide training for staff to be equipped to address health disparities appropriately, as recommended by the committee, to existing and new staff, focusing on issues relevant to the local communities served. Funds cannot be used for research, clinical care, medical or clinical supplies, fund-raising activities, construction or major renovations, to supplant existing state or federal funds for activities, purchase of vehicles of any kind (including mobile medical clinics), clothing to include uniforms or scrubs or funding an award to another party or provider who is ineligible. GRANTEE RESPONSIBILITIES. Grantee will: A. Implement and operate an immunization program for children, adolescents, and adults, with special emphasis on accelerating interventions to improve the immunization coverage of children three (3) years of age or younger (birth to 35 months of age). Grantee shall incorporate traditional and non-traditional systematic approaches designed to eliminate barriers, expand immunization capacity, and establish uniform operating policies, as described herein. B. Be enrolled as a provider in the Texas Vaccines for Children (TVFC) and the Adult Safety Net (ASN) Programs by the effective date of this Contract. This includes a signed Deputization Addendum Form (EF11-13999). C. Comply with written policies and procedures provided by DSHS in managing vaccines supplied through the ASN and TVFC Programs, including guidelines for proper storage, handling, and safeguarding of vaccines in the event of natural disaster. D. Adhere to DSHS Immunization updated guidance according to Attachment H-3, Immunization/Locals Program Guidance Document. E. Maintain staffing levels to meet required activities of the Contract and ensure staff funded by this Contract attend required training. F. Report all notifiable conditions as specified in Texas Administrative Code (TAC) Title 25, Part I §§ 97.1-97.6, as amended, and as otherwise required by law. G. GRANTEE RESPONSIBILITIES. Grantee shall: A. Perform activities in support of the Public Health Emergency Preparedness (“PHEP”) Cooperative Agreement between the Centers for Disease Control and Prevention (“CDC”) and the Department of State Health Services (“System Agency”) to advance public health emergency preparedness. B. Perform the activities required under this Contract in the following cities, counties, or groups of counties (cumulatively, Grantee’s “Jurisdiction”): Cherokee County. C. Provide System Agency with situational awareness data generated through interoperable networks of electronic data systems. D. Coordinate with System Agency program staff to develop a preparedness activity plan for Grantee’s Jurisdiction.
