ASSOCIATION AND MEMBER RIGHTS a. Both the Board and the Association recognize the rights of Professional Employees as set forth in 72-5414. b. The Association shall be entitled to public documents as provided by Kansas statutes and Board policy. c. The Association shall have the right to appear at Board meetings as provided by Board policy concerning such matters. d. The Association shall be entitled to use College facilities and equipment, subject to availability and scheduling as directed by the Administration. The Association shall pay for the cost of supplies, but no charge shall be made for use of facilities and equipment. e. The Association shall have the right to use College mail services, professional mail boxes, and College e-mail for Association business. The Association shall have the right to use the college website to communicate information as mutually agreed upon by the Association and Administration.

ASSOCIATION AND MEMBER RIGHTS. A. Pursuant to the Michigan Public Employment Relations Act, the Board hereby agrees that every employee of the Board shall have the right to organize freely, join and support the Association for the purpose of engaging in collective bargaining or negotiation and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board will not deprive or coerce any member in the enjoyment of any rights conferred by the Act or by other laws of Michigan and the United States; that it will not discriminate against any member with respect to membership in the Association, his/her participation in any activities of the Association or collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. B. Nothing herein shall require any teacher to be a member of or participate in the activities of any organization. C. The authorized representative of the Association shall have the right to schedule Association meetings in accordance with Section V of the Board of Education Personnel Policy on school premises before or after regular class hours of the employees involved. In the event that damage to the building, furniture, or equipment occurs as the direct result of Association abuse the cost will be borne by the Association. D. By permission of the building Principal, the duly authorized representatives of the Association and their respective affiliates (Michigan Education Association and National Education Association) shall be permitted to transact official Association business on school property during regular school hours provided always that there be no interference with school functioning. E. The Association may use school equipment for Association official business in conformity with Board policy, when such equipment is not otherwise in use. The Association shall pay for material and supplies, and for the reasonable cost or repair of any equipment when such equipment was damaged because of misuse or neglect. F. No teacher shall be prevented from wearing normal insignia or other identification of membership in the Association, whether on or off school premises. G. ASSOCIATION AND MEMBER RIGHTS. A. Pursuant to Act 336 of the Michigan Public Acts of 1947 as amended, the Board agrees that every member included in the bargaining or negotiation unit defined in ARTICLE I has the right to join and support the Association for the purpose of engaging in collective bargaining or negotiations with the Board. B. As a duly elected body exercising governmental powers under the laws (or color of law) of the State of Michigan, the Board agrees that it will not, directly or indirectly, discourage, deprive, or coerce any member from enjoying any rights conferred by Act 336 of the Michigan Public Acts of 1947 as amended, other laws of the State of Michigan, or laws of the United States. The Board will not discriminate against any member with respect to hours, wages, or any other terms or conditions of employment by reason of: membership in the Association, participation in the Association's lawful activities, participation in collective bargaining or negotiations with the Board, or instituting a grievance(s), complaint or proceeding under this Agreement. Member rights regarding Board discrimination against a member for participation in statutorily-protected activities are specifically protected in Section B of this ARTICLE. C. Nothing contained in this Agreement shall be construed to deny or restrict any member rights granted under the laws of the State of Michigan and/or the laws of the United States. The rights granted to members in this Agreement shall be deemed to be in addition to those provided by the laws of the State of Michigan and/or the laws of the United States and members may enforce such rights in courts of competent jurisdiction. Nothing contained in this agreement shall be construed to grant members rights prohibited under the laws of Michigan and/or the United States. D. The Association and its members shall have the right to use equipment, materials and school building facilities for meetings concerning Association business, provided that such use does not conflict with prior scheduled activities and provided that no cost to the Board arises from such use or that such cost for such use shall be reimbursed to the Board by the Association. Bulletin board space shall be made available for use by the Association in each building's faculty workroom. Such space shall not exceed one-half (1/2) the available bulletin board space in each such workroom. The Association shall endeavor to keep such neat, orderly, and
ASSOCIATION AND MEMBER RIGHTS. 3 3.1 ASSOCIATION RIGHTS‌ 5 3.1.1 Access to District Facilities 7 3.1.1.1 The Association shall have access to faculty offices and other non-teaching areas on 8 the campus where faculty congregate, subject to reasonable regulation by the District. The 9 Association may use available institutional facilities for meetings concerned with Association 10 business covered by the Educational Employment Relations Act, subject to the reasonable rules 11 of the District. Association activities will not interfere with the District's operation, classes, or 12 employees' work activity. 14 3.1.1.2 The Association shall have access to faculty mailboxes. 16 3.1.1.3 The Association may use the school mailboxes and bulletin board spaces 17 designated by the Superintendent/President subject to the following conditions: 18 19 A. The District will identify bulletin board space for use by the Association; 21 B. All postings for bulletin boards or items for school mailboxes must contain the date of 22 posting or distribution and the identification of the organization together with a 23 designated authorization by an authorized Association officer; 25 C. A copy of such postings or distributions must be delivered to the 26 Superintendent/President or designee at the same time as posting or distribution; and 28 D. The Association will not post or distribute information which is defamatory of the District 29 or its personnel or that violates California Education Code Section 7054. 33 The Association Executive Board shall be given 75 percent release time based upon the actual 34 hours of instruction/work assignment time for each of the recipients of said release time. The 35 District shall contribute backfill adjunct funding at an annual maximum of 162 hours, towards 36 Association release time. Further, the Association shall reimburse the District for all actual hours 37 of instruction/work assignment time beyond the District’s annual contribution of 162 hours, using 38 the current highest adjunct hourly lecture rate, including payroll taxes. 40 The Association shall notify the District no later than May 15th of the immediately preceding 41 school year of the names of the individuals to be granted the release time. 43 3.1.2.1 One designated representative of the Association may be released from duty when 44 representing a member for attending a grievance conference with management scheduled 45 during duty time or at any investigatory meeting where a member reasonably believes may le...
ASSOCIATION AND MEMBER RIGHTS. 9.1 The Board and the Association agree to abide by Act 379 of the Public Acts of 1965 as amended, and Public Act 112 of 1993, and to all the applicable laws and statutes pertaining to members' rights and responsibilities. The Board agrees that every TIPPA/MEA employee of the Board shall have the right to organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiation and other concerted legal activities for mutual aid and protection. The Board agrees that it will not directly or indirectly discourage or deprive or coerce any member in the enjoyment of any rights conferred by the Act or other laws of Michigan or the Constitution of the United States and the Constitution of the State of Michigan; that it will not discriminate against any member with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association; his/her participation in any activities of the Association or collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. 9.2 Members shall be entitled to full rights of citizenship. The religious or political activities of any member or the lack thereof shall not be grounds for any discipline or discrimination with respect to the professional employment of such member. The private and personal life of any member is not within the appropriate concern or attention of the Board except where the same shall adversely affect the student-member relationship. 9.3 The provisions of the Agreement shall be applied without regard to race, creed, religion, color, age, sex, marital status, disability, or national origin. 9.4 The Association, or a committee thereof, shall have the right to use Intermediate School building and facilities for Association meetings after the close of school. The Association agrees to reimburse the Board for any damage to equipment or facilities entrusted to its use and care, and to reimburse the Board for any materials consumed in the use of any of the facilities or duplication equipment. 9.5 No member of the Board shall respond to a public complaint regarding the individual employee at a Board of Education meeting. ASSOCIATION AND MEMBER RIGHTS. A. The Association, a majority representative of public employees in an appropriate unit, shall be entitled to act for and to negotiate agreements covering all employees in the unit and shall be responsible for representing the interests of all such employees without discrimination and without regard to employee organization membership. Proposed new rules or modifications of existing rules governing working conditions shall be negotiated with the majority representative before they are established. B. Just Cause Provision - No employee shall be discharged, disciplined, reprimanded, reduced in rank or compensation, without just cause. Any such action asserted by the Board, or any agent or representative thereof, shall be subject to the grievance procedure herein set forth.

An employee shall not be coerced or intimidated or suffer any reprisals either directly or indirectly that may adversely affect his/her hours of work, wages or working conditions as the result of exercising his/her rights under this agreement. G. The Employer shall not discharge, discipline or suspend any employee without just cause. Any such action by the Employer shall be subjected to the grievance and arbitration provisions of this Agreement. The extent of the disciplinary action may include warnings (oral and written), suspensions (with or without pay), demotions and discharge. H. Except as modified by this Agreement all rights, privileges and benefits existing prior to this Agreement shall continue to be applicable during the term of the Agreement. I. Whenever any member is required to appear before the Township Administrator or his designee, or Township Committee concerning any matter which could adversely affect the continuation of that employee in his/her position, employment, or the salary or any increments pertaining to salary, then he/she shall be afforded the opportunity to have a representative of the Association present to advise him/her.
