HOURS OF WORK AND RATES OF PAY. Section 1. The Production bargaining unit shall be divided into two categories within which all of the employees within the unit shall fall. The categories and their respective classifications are as follows: Category I [RESERVED] Category II Category I - Class I Technician Category II - Class I Operator Section 2. In the Employer's sole discretion, an employee may be employed at, or advanced to a wage rate in the "Length of service" progression contained on Exhibit "A" beyond the employee's length of service or above such progression scale, or be reduced from such point or wage rate to the rate of the scale for the length of service when the employee's performance, ability or experience is sufficient to justify. In applying the wage schedule set forth in Exhibit "A", all employees on the effective date of this agreement in the employ of WPTA shall be given Section 3. Time and one-half will be paid for all hours worked in excess of forty (40) hours in a work week. If an employee accumulates forty (40) hours' pay in a work week for which hours the employee was paid only straight pay, hours in excess thereof will be paid at time and one-half the employee's straight time hourly rate. A full-time bargaining unit employee shall be scheduled so that employee receives at least two (2) consecutive days off. In the event a full- time bargaining unit employee does not have two (2) consecutive days off, employee shall be paid at the overtime rate for all work performed on the day preceding or succeeding employee's scheduled day off. A work schedule where an employee's usual and regularly scheduled days off are Sunday and Monday and thus not granting the employee two (2) consecutive days off within a given work week shall not be a violation of this agreement provided that such a work schedule allows for two (2) consecutive days off when combined with the work schedules of the preceding and following work weeks and provided that such a schedule shall otherwise comply with and be subject to the provisions of this agreement. Section 4. When an employee is recalled for duty after completion of employee's daily assignments and after leaving the place of employment, employee shall be given a minimum of two (2) hours' additional work or a minimum of two (2) hours' additional pay at the applicable hourly rate. HOURS OF WORK AND RATES OF PAY. 22.01 The workweek will consist of seven (7) days. The seventh day will be the “designated day off” established by 22.03. Regular rates will apply for days one through five. The first eight (8) hours worked on the sixth day will be paid at the rate of time and one half. Any hours in excess of eight (8) will be paid at the rate of double time. All hours worked on the seventh day will be paid at the rate of double time. Except in special circumstances arranged between the Director of Production and the Union the workweek for Union members will not exceed 48 hours. At all times, any person covered by this contract retains the right to refuse work past forty-eight (48) hours per week. The intent and purpose of this clause is not to allow for the averaging of hours between pay periods. In accordance with the Employment Standards Act of Ontario, the Festival shall apply each year or as required for a permit enabling employees to work more than forty-eight (48) hours, and up to sixty (60) hours per week, and the Union agrees to support such application. Should the Festival determine it necessary, an application for a permit to work in excess of sixty (60) hours will be made.
HOURS OF WORK AND RATES OF PAY. 1. Shifts: (a) Ship Planner: The normal hours of work for employees employed as Ship Planner shall be set by the COMPANY. Ship Planners shall be scheduled for an average of 40 hours per week so as to provide coverage for and co-ordination of vessel schedules, cargo plans, and COMPANY operations. HOURS OF WORK AND RATES OF PAY. Section 1 - Hours of Work and Overtime: (a) All employees of the Cooperative covered by this Agreement, except Building and Transportation Maintenance Department employees, will be non-shift and will work regular schedules five (5) consecutive eight (8) hour days per work week Monday through Friday between the hours of seven o’clock (7:00) a.m. and five o’clock (5:00) p.m., with an unpaid lunch period not to exceed one-half (1/2) hour. Building and Transportation Maintenance employees shall be considered as “scheduled” and defined as those whose regular hours of work may be during any twenty-four (24) hour period usually on day or evening schedule, but not around the clock. So far as possible, regular schedules and individual employee shift assignments shall be established for thirty (30) day periods, which may be changed by the Cooperative upon thirty (30) days notice. Normally, line crew employees, other than meter servicemen and the meter serviceman chief, will be scheduled 7:00 a.m. to 3:30 p.m. Normally, meter servicemen and the meter serviceman chief will be scheduled 7:30 a.m. to 4:00 p.m. Any deviation from present schedules will be discussed and mutually agreed upon. In order to promote efficiency and customer service, unit employees may be scheduled to work four (4), ten (10) hour shifts per work week, Monday through Friday, during the period beginning the Monday after Memorial Day and ending the Friday before Labor Day. Prior to commencing this schedule, the Cooperative agrees to meet and discuss its plan with the Union. The Cooperative’s plan with respect to the issues raised by the schedule are set forth in a Memorandum of Understanding which is attached to this Agreement. (b) Overtime shall consist of all the time worked off schedule on regularly scheduled work day and all the time worked on Saturday or Sunday. Compensation for overtime hours of work shall be one and one-half times the regular rate except where otherwise provided. (c) All work performed on Sunday and Holidays shall be paid at two (2) times the regular hourly rate. Section 2 - Call-Out Minimum: When employees are called out to work in an emergency, they shall be paid four (4) hours straight time as a minimum, but the maximum time to be paid for shall be governed by the applicable overtime rate. In case of emergency call-out, working time shall be computed from the time the call is received.
HOURS OF WORK AND RATES OF PAY. Section 8.1.1 Work Schedules (12-hour Patrol Shift) (A) Work schedules shall be determined by the Director of Public Safety so that employees are scheduled to work a normal two-week pay period consisting of 80 hours. The normal pay period will consist of six 12-hour shifts and one 8-hour shift. Shift date is determined by the start time of the shift worked. (B) Employees working a 12-hour shift will be allowed a paid 45-minute lunch break. A paid 15-minute break during the first half of the shift and a paid 15-minute break in the second half of the shift will also be available to employees. Lunch break and shift breaks shall not be combined. The lunch break shall be taken as the workload and the Officer in Charge of the shift permit. (C) Shifts for sergeants shall consist of a Day Shift (0800 to 2000 hrs.) and a Night Shift (2000 to 0800 hrs.). Sergeants will select their short day when submitting their annual shift bid. Day shift sergeants will normally work 0800 to 1600 hrs. on their short day, while night shift sergeants will normally work 2000 to 0400 hrs. on their short day. The normal start time of the short day may be shifted to cover manpower shortages that may occur due to scheduled time off, court appearances and training. (D) All employees assigned to 12-hour patrol shift work shall be granted one full three-day weekend off each 28-day period, unless mutually agreed upon by the employer and employee affected. The full three- day weekend may consist of scheduled pass days on Friday, Saturday and Sunday or Saturday, Sunday and Monday. (E) The initial 28-day scheduling sequence shall begin on Sunday, July 21, 2013. The 28-day period shall consist of two consecutive 14-day pay periods, which begin on a Sunday and end 14 days later on a Saturday. (F) A 28-day period is linked to the payroll system. Three-day weekends will routinely begin in one period and end in another. If a three-day weekend, consisting of three consecutive days off beginning on a Friday or Saturday, extends across the 28-day boundary, it shall be considered a full three-day weekend for the 28- day period in which the three-day weekend began. (G) An officer’s normal schedule will include two (2) three-day weekends in each 28 day period. If the Director, or his or her designee, schedules an officer to work on one of his or her three-day weekends, the other three-day weekend in the same 28-day pay period shall be considered a protected weekend.   • HOURS OF WORK & OVERTIME Section 15.1 This Article is intended to define the normal hours of work per day or per week in effect at the time of execution of this Agreement. Nothing contained herein shall be construed as preventing the Employer from restructuring the normal workday or workweek as necessary to promote efficiency or improve services, or from establishing the work schedules of employees. However, nothing in this Section shall relieve the Employer of its duty to bargain the affects of such decisions on employee wages, hours, terms and other conditions of employment. This Article shall be used as the basis for computing overtime for employees who are not exempt from the overtime provisions of the Fair Labor Standards Act and shall not be construed as a guarantee of hours of work per day or per week. Section 15.2 Employees may take one paid fifteen (15) minute break for every four (4) hour block worked. Employees may combine breaks to take up to one (1) sixty (60) minute paid break. Employees may not leave campus on their paid breaks. Section 15.3 Bargaining unit employees who are not exempt from the provisions of the Fair Labor Standards Act will be paid one and one-half times their normal hourly rate for all hours actually worked in excess of forty (40) hours per work week. All overtime shall have prior supervisory approval, except when it is necessary for a nurse to remain on duty to protect patient safety. Only hours actually worked are counted for the purpose of computing an employee's eligibility for overtime pay. There shall be no pyramiding of hours or pay. Section 15.4 The Board serves individuals 24 hours per day, 7 days per week. To meet this need for service to our individuals evening and weekend hours may be required of any bargaining unit employee. The Employer will establish the standard work day as beginning at 6:00 a.m. and ending at 5:59 a.m. and starting and ending times for each shift in each department. Supervisors will establish daily workschedules. Section 15.5 Absent an emergency situation, management will notify the Union in the event management intends to institute a long-term change in the present shift times for nurses. Following notification and upon request by the Union, management will meet with the Union to discuss the reason for the change and possible alternatives.

  • HOURS OF WORK AND OVERTIME 16.01 The normal work week is thirty-seven point five (37.5) hours over five (5) days. Employees shall be entitled to a one half (0.5)) hour unpaid lunch period taken at a time directed by the Employer. Where the work day exceeds nine (9) hours, there shall be a second thirty (30) minute unpaid lunch break taken at a time directed by the Employer. In the event that patient care programs (e.g. flu shot clinic, patient education sessions) are scheduled and require an Employee to work hours other than those listed above, such employee shall be given a minimum of two weeks’ notice prior to the change in shift. It is understood and agreed that the provisions of this Article are intended only to provide a basis for calculating time worked and shall not be considered a guarantee as to the hours of work per day or the days of work per week. Should the Employer wish to make a change to the current schedule, a meeting shall occur with the Union to discuss the implementation of such schedule. 16.02 Authorized hours worked in excess of forty-four hours per week (Sunday to Saturday) shall be paid at the rate of one and one-half (1.5) times the Nurse’s regular hourly rate of pay. The Employee may elect time off in lieu at the rate of time and one-half (1½) her regular rate of pay. The time off will be taken at a time which is mutually convenient to the individual and the Employer. 16.03 Schedules will be posted monthly. 16.04 An Employee who is called in and required to work outside his/her normal scheduled hours, other than those hours immediately prior to or after normal starting or quitting time, shall receive a minimum of four (4) hours pay at straight time or payment for the actual hours worked. It is agreed that there shall be no pyramiding of overtime or any premiums provided for in this agreement.

  • HOURS OF WORK i) Where employees are now working a longer daily tour, the provisions set out in this Article governing the regular hours of work on a daily tour shall be adjusted accordingly. ii) The normal daily extended tour shall be 11.25 consecutive hours in any 24-hour period, exclusive of a total of forty-five (45) minutes of unpaid meal time. For hybrid schedules, there will be scheduled normal daily tours of seven and one-half (7½) hours and 11.25 consecutive hours per day. iii) Employees working an extended tour shall be entitled, subject to the exigencies of resident care, to paid relief periods during the tour of a total of forty-five (45) minutes. For hybrid schedules, there will also be shifts that provide for relief periods in accordance with Article 15.02. iv) Scheduling issues will be resolved at the local level. v) Where the union and the employer have agreed to or agree to an extended daily tour or hybrid schedule that differs from the normal daily extended tour, the proportion of unpaid time to hours of work shall maintain the same ratio as set out in paragraph ii) and iii) of this Article.

  • Ordinary Hours of Work The ordinary hours of work will be worked any time between 6.00am to 6.00pm Monday to Friday. Ordinary hours of work may be varied by agreement between the Employer and the majority of the employees concerned and the ETU State Secretary (via the relevant full time ETU Official) to accommodate the hours or work required for the most efficient and safe operation of the Employer and the requirements of its client. Should the reporting time extend beyond fifteen (15) minutes however, the entire period shall be considered overtime for the purposes of payment. 15.04 Requests for change in posted work schedules must be submitted in writing and co-signed by the employee willing to exchange days off or shifts and are subject to the discretion of the Administrator or her designate. In any event, it is understood that such a change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment or any other claims on the Employer by any employee under the terms of this Agreement. 15.05 Where there is a change to Daylight Savings from Standard Time or vice-versa, an employee who is scheduled and works a full shift shall be paid for a seven and one-half (7½) hour shift rather than the actual hours worked. 15.06 In the event that a meal period is interrupted requiring an employee to attend to a work related problem, then the balance of the unused meal period will be taken within two (2) hours of the interruption. If the employee is unable to reschedule such time, she shall be paid time and one-half (1½) her regular straight time hourly rate for all time worked in excess of her normal daily hours, in accordance with Article 16.01.
