POSTING AND VACANCIES. A position vacancy is defined as one in which a position has been vacated by a registered nurse who is not returning to said position. A temporary or substitute vacancy is defined as one in which a substitute registered nurse replaces an incumbent registered nurse who is returning to his/her position.
Subd. 1. All position vacancies will be posted for a two (2) week period. The posting time may be shortened as unexpected vacancies occur especially prior to the start of the school year.
Subd. 2. If a temporary vacancy becomes a position vacancy, it will be posted and filled in accordance with the provisions of this Agreement.
POSTING AND VACANCIES. A. If any bargaining unit member is promoted, retires, resigns, is terminated or transferred, and the Superintendent has determined to continue with the position and has not filled the position with a current bargaining unit member, the position will be considered vacant. The creation of any new positions in the bargaining unit and recurring or ongoing bargaining unit work outside of the workday will also be offered as a vacancy in accordance with this Article.
B. Employment advertisements for new positions and vacancies shall be posted non-publicly via District email three (3) business days prior to any public posting.
C. The Superintendent/designee will grant interviews to bargaining unit members among the applicants who are in the same classification series as the vacant position and to those other applicants who appear to the Superintendent/designee to be fully qualified for the position.
D. The Superintendent/designee has the sole discretion to determine which applicant is most qualified for the vacant position.
E. The Superintendent has the sole and exclusive authority and discretion to determine the appropriate placement of a bargaining unit member on the applicable compensation schedule.
F. The Superintendent has the sole and exclusive authority and discretion to assign and/or reassign bargaining unit members. If a bargaining unit member receives a notice of an assignment or reassignment to which they object, the member may request a meeting with the Superintendent/designee to present the objection(s) to the assignment/reassignment. The bargaining unit member may be represented by the Union at this meeting which will be scheduled without unreasonable delay. During this meeting, the Superintendent/designee will provide a written explanation for the assignment/reassignment (which may include but not be limited to the reason(s) for the purpose of, the motivating factor(s) behind, or other circumstances relating to the assignment/reassignment) to the bargaining unit member, and a copy of the written explanation shall be placed in the member’s personnel file.
POSTING AND VACANCIES. In the event new jobs are created or vacancies occur in existing job classifications including new positions created for a specific term or task (unless the Employer notifies the Union in writing that it intends to postpone or not fill a vacancy), the Employer will post such new jobs or vacancies for a period of ten calendar days, (or less by written mutual agreement of the parties) and shall stipulate the qualifications, classification, rate and department concerned before new employees are hired, in order to allow employees with seniority to apply. The Employer agrees to provide the chief xxxxxxx with a copy of each job posting. The parties agree that an administrative oversight in this regard does not void the job posting. Applications shall be submitted in writing by the employee, within the posting period. Until the vacancy is filled resulting from the job posting provisions, the Employer is free to fill the vacancy on a temporary basis as he sees fit. No external applications will be considered until the internal process is exhausted. When filling any such vacancy, the Employer shall not be required to consider any employee who does not possess the skill, competence, qualifications and efficiency to perform the required work. Subject to this proviso, the Employer shall select for any vacant position the employee who bids, who has the greatest skill, competence, qualifications and efficiency for the job. Where those criteria are relatively equal, seniority on a bargaining unit-wide basis shall govern. If a vacant position cannot be filled with employees that are employed, the Employer shall recall an employee from lay- off, provided such employee has the skill, competence, qualifications and efficiency to perform the required work. If a vacant position cannot be filled with active or laid off employees, under the above criteria, the Home shall have the right to hire from outside. The successful applicant shall be placed on trial in the new position for a period of three hundred and thirty seven and one-half (337 working hours. The trial period may be extended by mutual agreement, but in any case, not longer than an additional one hundred and twelve and one half (1 working hours. POSTING AND VACANCIES. All vacancies and new positions shall be posted in each building office and on the District web page for a period of five (5) calendar days. The District shall also e-mail all vacancies and new positions to all BLSD staff e-mail accounts. A vacancy is defined as any position resulting from a retirement, nonrenewal, termination, death, transfer, or the creation of a new position. The Board reserves the right at all times to determine whether to fill any vacancy.

POSTING AND VACANCIES. 23.01 Job Postings
(a) All permanent vacancies expected to last more than sixty (60) days shall be posted. A copy of the posting shall be sent to the Union. All Employees wishing to apply must submit a written request outlining his/her qualifications, for the position, via email or fax to Human Resources in order to be considered for the position. The posting document shall contain the following:
(i) position available;
(ii) hours of work;
(iii) schedule information;
(iv) required knowledge and qualifications;
(v) the date of the posting and the closing date for the available position and any other information that may be helpful in assisting the applicant in reaching a decision, which posting period shall be no less than ten (10) calendar days in duration.
(b) Employees who meet the minimal qualifications will be awarded said positions in accordance with seniority and full-time Employees wishing to apply for a promotion must do so in writing or by email, stating his qualifications for such appointment within Ten (10) calendar days of notification being posted.
(c) The deadline for applications shall be ten (10) calendar days from the date the posting document is distributed. The position shall be filled within twenty-one (21) calendar days.
(d) Within five (5) working days (excluding Saturdays, Sundays, and holidays) of the position being filled, all applicants for the posted position and the Union shall be notified in writing of the name of the successful applicant and the effective date of the promotion. Upon request, the Union shall be advised of the names, seniority and qualification of all applicants.
(e) The Employer shall post those permanent vacancies expected to last for more than sixty (60) days in the following manner:

POSTING AND VACANCIES. 8.01 All new and vacant positions in the Department of Public Works shall be given to the Association xxxxxxx for posting on the bulletin board. Employees who wish to apply for such vacancies shall make a request in writing to the Superintendent and to the Commissioner of Public Works for consideration.
8.02 It shall generally be the policy of the Borough to fill such vacancies from within the employees who comprise the bargaining unit subject, however, to the ability, training, education, experience and physical condition of the applicants being major factors in the decision from within or without the Borough to fill such vacancy. In the event the foregoing are deemed relatively equal by the Borough, the employees with the greatest seniority will be given preference, as between each other and between outside candidates.
POSTING AND VACANCIES. CHANGES IN EMPLOYMENT There shall be no immobilization of labour and it will not be open to any employee to refuse to engage in any employment during his or her regular hours. Any employee assigned to a higher rated position for a period of over two days shall be paid at the wage rate prevailing for such higher position. When an employee is assigned to a higher rated position for the purpose of relieving another employee who is absent due to sickness, accident or regular vacation, he or she shall be paid the wage rate prevailing for such higher position provided it is understood that he or she will go back to his or her own category when the employee he or she is relieving returns to the job. An employee shall continue to enjoy the rate for his or her when relieving another employee in a lower-rated classification who is absent due to sickness, accident or regular vacation. If the employee is transferred to a lower-rated posi- tion by the Company, his or her pay rate will be reduced to that of the new classification after the expiration of (15) days. However, if an em- ployee chooses to move into a lower-rated job for relief purposes by exercising seniority rights or if such transfer is due to demotion for just cause the lower rate of pay shall immediately take effect. If an employee returns to his or her classification as a result of the application of the seniority provision and is later transferred to a lower rated position, his or her rate will not be reduced to that of the new classificationuntil the expiration of fifteen (15)days.
