PROMOTIONS, VACANCIES AND TRANSFERS. Section 20.1
PROMOTIONS, VACANCIES AND TRANSFERS. A. A vacancy shall be deemed to exist when:
1. A new permanent budgeted position is authorized.
2. A person occupying a position leaves the employ of the school system and the position remains an authorized, budgeted position.
3. When a vacancy as defined above occurs in the Food and Nutrition Services Department, the following provisions shall be followed:
a. Notice of any vacancy to be filled shall be posted on the bulletin board in a designated work area of all employees. A copy of said notice shall be given to the Federation at the time it is posted.
b. The Notice of Vacancy to be filled shall include the title, work location, salary range, classification, qualifications of the position, effective date of the position, information concerning the securing of, and deadline for filing of the application, and the person with whom the application is to be filed.
c. The Notice of Vacancy shall remain posted for not less than five

18.01 Where the Employer determines the need to fill a vacant bargaining unit position on a permanent basis, such a vacancy shall be posted a minimum of eight (8) calendar days prior to filling the position. The posting shall be in a format and location accessible to all employees.
18.02 Where circumstances require the Employer to fill a posted vacancy before the expiry of the eight (8) calendar days, the appointment shall be made on a temporary or relief basis only.
18.03 Promotion and the filling of vacancies within the bargaining unit shall be based upon qualifications established by the Employer. Employees shall be entitled to bid for posted vacancies by means of written application submitted as directed before the deadline date and time.
18.04 In making promotions and filling vacancies, experience, performance and qualifications applicable to the position shall be the primary consideration. Where these factors are adjudged by the Employer to be relatively equal, seniority shall be the deciding factor.
18.05 Subject to Article 18.04 where vacancies are filled, first consideration shall be given to employees who are already members of the bargaining unit. Where, in the Employer’s opinion, there is no bargaining unit applicant who satisfactorily meets the level of qualifications and performance established for the position, the Employer may hire from any source.
18.06 The notice of posting referred to in Article 18.01 shall contain the following information:
(a) duties of the position;
(b) qualifications required;
(c) hours of work;
(d) status of position, and expected term if a temporary position; and
(e) salary.
(a) Where a vacancy for a temporary position has been filled by the appointment of a regular full-time or part-time employee, and where, at the completion of the expected term of the temporary position, the Employer decides that the employee is no longer required in that position, he shall be reinstated in his former position. If such reinstatement is not possible, the employee shall be placed in another suitable position. Such reinstatement or placement shall be without loss of seniority and at not less than the same rate of pay to which the employee would be entitled had he remained in his former position. The reinstatement or placement of an employee in accordance with this article or with Article 18.08 shall not be construed as a violation of the posting provisions of Article 18.01.

PROMOTIONS, VACANCIES AND TRANSFERS. When there is an opening for promotion and/or opportunity for transfer to another department, the Board shall notify the Union of such vacancy, in writing, and shall post notices in each building, as in the past, for a period of ten (10) days. The selection of an employee for promotion shall be made on the basis of seniority, qualifications and performance. The selection of an employee for shift and building transfer shall be made on the basis of seniority and prior written request. During the probation period, the Board may return the employee to his/her position held prior to the promotion or transfer if the employee cannot perform the work required.
A. The probationary period for an employee promoted to a new position shall be twenty (20) days. It may be extended by mutual agreement between the Union and the Board.
B. An employee shall be permitted to return to his/her former position during the probationary period.
C. Any employee who requests and is granted a transfer from one shift to another shall not be allowed any further change of shift for a period of four (4) months without approval of the Board.
PROMOTIONS, VACANCIES AND TRANSFERS. 6.01 Promotions and vacancies will be offered in the following order, provided the applicants have the required qualifications:
(a) Current employees of the department, by department seniority,
(b) Employees with previous department seniority, by department seniority,
(c) Employees with general seniority, by general seniority. The Employer reserves the right to access the qualifications on the basis of the submission of a resume and interview where necessary. Preference shall be given to part time employees for full time entry positions provided the applicants have the required qualifications.
6.02 Within five (5) working days, unless mutually agreed otherwise, all vacancies for permanent positions (excluding entry level positions in high school/training facilities and Absence Relief positions) shall be posted electronically for eight (8) working days, excluding the months of July and August. All vacancies posted during the months of July and August shall be posted for eleven (11) working days.
6.02.1 Should a position not be filled after posting it in accordance with clause 6.02, it will be reposted electronically and will remain open until the first qualified applicant fills the position or the Calgary Board of Education closes the competition.
6.03 The employer will provide to the union a list of training facilities.
6.04 Upon satisfactory completion of the Part Time or Full Time Entry Level Training Program employees shall become eligible for posted positions pursuant to clause 6.01.
6.05 Employees will not normally be eligible to make application for vacancies within twelve (12) months of their transfer or promotion to their present position. Exceptions are vacancies arising from the creation of a new position or when the vacancy within the same school or facility is a promotion. Employees who obtain new qualifications during the twelve (12) month period referenced above may be eligible to apply on vacancies as a result of obtaining such qualifications provided the vacancy is a promotion.
6.06 All postings shall include information as to whether the facility currently follows a traditional school calendar, a modified school calendar, operates year round, is a training school, or is twinned with other facilities.
6.07 A copy of each posting for all vacancies referred to in Article 6 shall be forwarded to the CUPE Local 40 office to the attention of the Secretary of the Union at the same time as they are posted.

PROMOTIONS, VACANCIES AND TRANSFERS.
11.01 Promotions Opportunities for promotion to full-time permanent vacancies in administrative or supervisory positions will be posted via email to each building prior to the formal screening of any applications. The notice for such administrative or supervisory positions will include minimum qualifications, building location, and job description. Nothing herein shall be construed to require the Board to fill any such positions. Teachers may apply in writing for promotional positions and will be informed in writing of the receipt and disposition of their applications. Unsuccessful applicants shall, upon request, be granted a conference covering the disposition of their applications.

PROMOTIONS, VACANCIES AND TRANSFERS. Section 4.1 Postings in the bargaining unit will be emailed to all employees covered under this agreement and remains open for five (5) calendar days.
Section 4.2 In the event new positions in the bargaining unit are created, or when bargaining unit vacancies occur which are to be filled, existing bargaining unit members who apply shall be given reasonable consideration before the hiring of an outside applicant. Job openings shall be filled based upon the qualifications of the applicants and the needs of the District, as determined by the Superintendent in his/her sole discretion.
Section 4.3 If an employee is asked during the school year to transfer to another school or another assignment that changes the employee’s daily schedule, the district will give the employee a seventy-two (72) hour notice before transferring them unless it is an emergency.
PROMOTIONS, VACANCIES AND TRANSFERS. 5.1 All vacancies either occupied by members of this Association or for which they would be eligible shall be publicized by posting in every school a notice describing the vacancy. A copy of each notice shall be sent to the president of the Association.
5.2 No member shall be involuntarily transferred without prior consultation with the Superintendent. After proper consultation the right to make transfers remains with the Board.
5.3 Any permanent and significant change in duties and/or job description of any member of the Association will be discussed with the member and the President of the Association or his designee.
5.4 Transfer of teachers either voluntarily or involuntarily shall be discussed with the building principals before knowledge of such transfer is communicated to the transferee, if practicable, so that a smooth transition may take place.
