WORKING HOURS, LOADS, AND ASSIGNMENTS. A. The normal work day schedule for all employees shall be established by the Employer based on the Employer's determination of the needs and resources of the District and may be changed from time to time as deemed necessary and appropriate by the Employer. Full-time employees shall be defined as working thirty (30) hours or more per week. Half-time employees shall be defined as working at least twenty (20) but less than thirty (30) hours per week. Part-time employees shall be defined as working less than twenty (20) hours per week. Any part-time employee who temporarily works extra hours will not be eligible for half-time or full-time benefits unless the temporary assignment goes over thirty (30) days. Any half-time employee who temporarily works extra hours will not be eligible for full-time benefits unless the temporary assignment goes over thirty (30) days. B. The normal work year for school year employees shall follow the school calendar. The normal work year for all other employees shall be as follows: Secretaries and Clerks shall be ten (10) months. Maintenance and Couriers shall be eleven (11) months. Bus Mechanics shall be twelve (12) months. *Additional hours and/or days may be assigned beyond the normal work year. C. A minimum of two (2) professional development days will be scheduled each year for the GESPA. Members will be paid their regular rate of pay when attending said professional development. D. Bargaining unit members will be provided a fifteen (15) minute relief period for each four (4) hours of work assigned by the supervisor. The relief periods shall be taken at a time and in a manner that does not interfere with the efficiency of the work unit as defined by the supervisor. Deviations from the assigned break schedule will not be allowed without the prior approval of the supervisor. E. When the Employer determines that overtime is necessary, overtime shall be divided among bargaining unit member within each classification as follows: 1. Overtime will be covered by the use of an "Overtime Chart" and will be offered to each bargaining unit member in rotation based on seniority. Overtime that is refused by a bargaining unit member will be charged on the Overtime Chart for the purpose of balancing overtime. 2. The overtime chart shall be kept updated to the current pay period on a continual chart from year to year. 3. Changes in the regular work schedule will not be made without a prior one (1) week notice except in cases of extreme emergency or extenuating circumstances. Hours may be mutually rearranged by the employer and the employee on an as needed basis. In the event that the hours of a particular position are reduced during the school year, the individual in that position will be considered to have been laid off and may exercise bumping rights in accordance with Article 11, Paragraph 11.2. 8.2 The normal work week for employees shall be Monday through Friday. The work hours for employees shall be posted. Employees shall be entitled to a duty free unpaid lunch period mutually agreed to by the parties. 8.3 The Employer will endeavor to provide full-time employees a fifteen (15) minute break period during the first half of their work day and a fifteen (15) minute break period during the second half of their work day. Employees working less than a full time schedule will be provided with a fifteen (15) minute break period during any scheduled shift that is four (4) hours or more in length. These break periods shall be scheduled so as not to interfere with the Employer's operations. Breaks may not be taken at the beginning or end of the workday or in conjunction with lunch periods. 8.4 All extra driving trips which are not part of the drivers' regularly scheduled runs shall be offered to the drivers (including up to 3 sub drivers) in rotation based on seniority. Selection of trips shall occur not more than 48 hours after requests have been distributed. The rotation shall continue rotating throughout the year, i.e. when a driver takes a trip or declines, his/her name shall be moved to the bottom of the rotation. The Employer may assign bus runs that are scheduled to start after the beginning of and scheduled to conclude prior to the end of the student day without regard to the rotational system. Any such run shall be assigned to bargaining unit members and shall not include any run that is a part of an employee's regular duties. 8.5 When non-driving overtime is scheduled, overtime shall be divided among qualified employees as follows: Overtime will be covered by the use of an Overtime Chart and will be offered to employees on a rotational basis.   • TEACHING LOADS AND ASSIGNMENTS A. Should teacher absences necessitate using teachers on preparation periods as substitutes because no eligible substitutes are available, said teacher giving up his/her preparation period shall be paid at the rate listed is Schedule B for each prep period given up to substitute. Every effort will be made to share the assignments equally. When absences of fifty percent (50%) or more of the day occur, the Administration will call for an eligible substitute. B. Teachers shall be informed of the final assignments and classrooms no later than August 1 unless an unforeseen or emergency situation arises. Should a situation arise, Administration shall notify the Association of the reasons. D. The staff will be surveyed prior to the end of each school year to determine teaching preference for the next school term. E Because the Board of Education has the statutory duty to educate all children within the boundaries of the school district and those participating in schools of choice, and because the student/teacher ratio is an important aspect of the educational program, and because the number of students the teacher is required to instruct has a direct bearing upon the amount of work required of the individual teacher, the parties agree the size of the individual classes shall be given careful consideration to balance them by the administration. Upon the request of the teacher or association, if educationally appropriate, or economically feasible all options not limited to: balancing class loads, hiring a paraprofessional, or not being able to do anything will be considered. Discussion on whether to do so will be done by the 4th Wednesday count day.

  • SUBCONTRACT AND ASSIGNMENT This Agreement binds the heirs, successors, assigns and representatives of the Contractor. The Contractor shall not enter into subcontracts for any work contemplated under this Agreement and shall not assign this Agreement or monies due or to become due, without the prior written consent of the General Manager of the Agency or his designee, subject to any required state or federal approval.   • SUBCONTRACTS and ASSIGNMENTS Except as may be set forth in the Special Provisions, the Contractor agrees not to subcontract, assign, transfer, convey, sublet or otherwise dispose of this Agreement or any right, title, obligation or interest it may have therein to any third party without prior written approval of H-GAC.   • Subcontracting and Assignment The School Bus Operator shall not sub-contract, transfer or assign this Contract or any part of this Parent Agreement without the prior written consent of the School. The School Bus Operator shall be responsible for the acts, defaults, neglects or omissions of any assignee or subcontractor, their agents, servants or workmen as fully as if they were the acts, defaults, neglects or omissions of the School Bus Operator.

  • ASSIGNMENT AND SUB-CONTRACTING The benefit and burden of this Contract may not be assigned or sub-contracted in whole or in part by the Contractor without the prior written consent of the Department. Such consent may be given subject to any conditions which the Department considers necessary.   • Permitted Assignments A Lender may assign to an Eligible Assignee any of its rights and obligations under the Loan Documents, as long as (a) each assignment is of a constant, and not a varying, percentage of the transferor Lender’s rights and obligations under the Loan Documents and, in the case of a partial assignment, is in a minimum principal amount of $5,000,000 (unless otherwise agreed by Agent in its discretion) and integral multiples of $1,000,000 in excess of that amount; (b) except in the case of an assignment in whole of a Lender’s rights and obligations, the aggregate amount of the Commitments retained by the transferor Lender is at least $5,000,000 (unless otherwise agreed by Agent in its discretion); and (c) the parties to each such assignment shall execute and deliver to Agent, for its acceptance and recording, an Assignment and Acceptance. Nothing herein shall limit the right of a Lender to pledge or assign any rights under the Loan Documents to (i) any Federal Reserve Bank or the United States Treasury as collateral security pursuant to Regulation A of the Board of Governors and any Operating Circular issued by such Federal Reserve Bank, or (ii) counterparties to swap agreements relating to any Loans; provided, however, that any payment by Borrowers to the assigning Lender in respect of any Obligations assigned as described in this sentence shall satisfy Borrowers’ obligations hereunder to the extent of such payment, and no such assignment shall release the assigning Lender from its obligations hereunder.

  • Subcontracts and Assignment Contractor shall not subcontract, assign, delegate, or transfer any of its duties, rights, or interests under this Contract without the prior written consent of District. District may withhold such consent for any or no reason. If District consents to an assignment or subcontract, then in addition to any other provisions of this Contract, Contractor shall require any permitted subcontractor to be bound by all the terms and conditions of this Contract that would otherwise bind Contractor. The parties agree that any such subcontracts shall be construed as matters solely between the Contractor and its subcontractor and shall have no binding effect on District.

  • ASSIGNMENT AND SUB-LETTING Tenant shall not assign this Agreement, or sub-let or grant any license to use the Premises or any part thereof without the prior written consent of Landlord. A consent by Landlord to one such assignment, sub-letting or license shall not be deemed to be a consent to any subsequent assignment, sub-letting or license. An assignment, sub-letting or license without the prior written consent of Landlord or an assignment or sub-letting by operation of law shall be absolutely null and void and shall, at Landlord's option, terminate this Agreement.
