FACILITY RESPONSIBILITIES. (1) The Facility will retain responsibility for the care of its clients and will maintain administrative and professional supervision of students insofar as their presence and program assignments affect the operation of the Facility and its care, direct and indirect, of its clients. No provision of this MOU shall prevent any Facility client from requesting not to be a teaching client or prevent any member of the Facility’s staff from designating any client as a non-teaching client.
(2) The Facility will provide adequate clinical facilities for participating students in accordance with the objectives developed through cooperative planning by the University's departmental faculty and the Facility's staff.
(3) The Facility will use its best efforts to make conference space and classrooms available as may be necessary for teaching and planning activities in connection with an ALE.
(4) Facility staff shall, upon request, assist the University in the evaluation of the learning and performance of participating students, provided the student has signed a consent to exchange of educational information in accordance with the Family Educational Rights and Privacy Act of 1974, as amended. However, the Facility hereby agrees to keep confidential any student records or information it may obtain, unless it has otherwise obtained prior written consent of the student. Although the University shall obtain all required consents, the Facility shall have the right to rely on such consents and to obtain copies of such consents upon request. The Facility will assign a staff representative as liaison between the Facility and the University. Unless otherwise specified herein, any evaluation of students by the Facility shall relate only to general student participation in the ALE, and shall no way be construed as a certification by the Facility as to the competence of any student or a representation by the Facility of any student’s ability or competence in connection with the practical implementation of any knowledge gained through the ALE.
(5) The Facility shall provide for the orientation of both University faculty and participating students as to the facilities, philosophies, rules, regulations and policies of the Facility.
(6) Subject to the Facility's overall supervisory responsibility for client care, it may permit appropriately licensed faculty members to provide such member services at the Facility as may be necessary for teaching purposes. The nature and scope of activitie...
FACILITY RESPONSIBILITIES a. The Facility will make available to Interns its facilities and staff as the Facility determines reasonable and appropriate to provide opportunities for educational experience related to the Fieldwork.
b. The Facility will provide a variety of learning experiences appropriate to the setting. The experiences and skills taught to the Interns shall build upon their academic experience, apply generally to the field of nutrition , and shall not be specifically limited to the Facility’s practice or operation.
c. The Facility, in coordination with the Academic Fieldwork Coordinator, will plan and implement a/an clinical nutrition education program for the Interns that meets the specific objectives of the clinical experience.
d. The Interns shall not perform routine work such as filing or other clerical work, or otherwise assist in the operations of the Facility.
e. The Interns will not replace, substitute for, or augment the work of paid employees of the Facility. The hours and workload of the Facility’s employees will not be reduced as a result of any Intern’s clinical experience Fieldwork.
f. Each Intern’s clinical experience Fieldwork shall be for a fixed period which shall be established in advance and shall not be extended.
g. The Facility shall not use any Intern’s clinical experience Fieldwork as a trial period to determine whether s/he is suitable for employment. Each Intern will be specifically advised that s/he should have no expectation of being hired by the Facility as an employee.
h. The Facility shall maintain full responsibility for any patient care throughout the term of the Fieldwork.
i. The Facility will allow Interns, at their own expense, to use any available cafeteria and/or snack bar facilities of the Facility.
j. The Facility shall maintain applicable general and professional liability insurance coverage in such amount and under such terms as may be required by applicable law and shall, upon request, provide copies of certificates of such insurance coverage to the College.
k. The Facility will provide or arrange for emergency health care to Interns in case of accident or sudden illness occurring at the Facility, at the expense of the Intern.
l. The Facility shall arrange for and provide close supervision of Interns by persons designated by the Facility who have the requisite knowledge and experience to supervise students in the Dietetic Internship program.

B. The Facility is responsible for the safety and quality of care provided to its patients by the students who are participating in the clinical experience program at the Facility. In order to effectively fulfill that duty, it is agreed that Facility has ultimate control over all persons involved in the program and may immediately terminate the participation in the program of any of the students enrolled in the program where an emergency exists involving health and safety; and in all other (non-emergency) instances, Facility shall consult with the College/University before taking any action to terminate the participation of a student.
C. The Facility will provide the College/University with a copy of its policies and regulations which relate to the clinical experience program.
D. The Facility will permit the College/University faculty and students to use its patient care and patient service facilities for clinical instruction according to a mutually-approved plan.
E. The Facility will allow a reasonable amount of Facility staff time for orientation and joint conferences with College/University faculty, for planning with College/University faculty, and for such other assistance as shall be mutually agreeable.
F. When available, physical space such as offices, conference rooms, and classrooms of the Facility may be used by the College/University faculty and students who are participating in the clinical experience program.
G. The College/University faculty and students participating in the clinical experience program will be permitted to use the Facility’s library in accordance with the Facility’s policies.
H. The Facility will make locker or cloak room facilities available for the College/University faculty and students during assigned clinical experience program hours. These facilities may be shared by other faculty and students.

FACILITY RESPONSIBILITIES. FACILITY will:
A. allow StudentsFellows, at their own expense, to utilize FACILITY’s dining facilities.
B. provide input to UTHealth regarding a Students’s performance for purposes of evaluation in a mutually agreed upon format.
C. provide an orientation for UTHealth’s Students to inform them of FACILITY’s facilities, policies, procedures, rules, and regulations.
D. arrange for emergency health care for a Student if needed while the Student is on-site at FACILITY, provided however, that FACILITY is not responsible for costs, follow-up care, or hospitalization associated with such emergency care.
E. have the right to immediately remove and/or require UTHealth to remove any Student from participation in the Program if either UTHealth or FACILITY, in each party’s sole discretion, determines that (i) the presence of the Student has a detrimental effect upon FACILITY’s facilities, patients, or personnel; and/or (ii) Student is compromising FACILITY’s standards of care or performance, policies, or procedures.
FACILITY RESPONSIBILITIES. In collecting and submitting Facility Data to IHA, Facility shall comply with external requirements for Survey participation. Facility Data collection will be done either with a paper tool or online; if paper is used the Facility will be responsible for transcribing answers into the web-based system.
FACILITY RESPONSIBILITIES. Facility will:
1. serve as a laboratory in which Students may be assigned for educational experiences;
2. provide staff time for planning with faculty for suitable Student experiences;
3. provide faculty orientation to the Facility' s setting and its policies;
4. retain final authority over all activities that influence Facility’s operation and care of Facility’s patients. Facility shall permit Students to work, perform assignments, and participate in the delivery of clinical and non-clinical services, patient evaluations, patient assessment rounds, staff meetings, and in-service programs at the discretion of Facility’s designated staff. Students participating in the educational experiences are trainees and shall not replace or substitute for Facility staff;
5. provide personal protective equipment (e.g., gloves, masks, etc.) to Students to enable them to practice Standard Precautions and other safety procedures;
FACILITY RESPONSIBILITIES a) FACILITY shall provide Trainee access to first aid and emergency care for illnesses and accidents occurring while at FACILITY. FACILITY shall be entitled to charge Trainee for such first aid and emergency care services.
b) Upon UVA’s request, FACILITY shall provide UVA an evaluation of Trainee’s performance and progress.
c) FACILITY shall make available to UVA Trainee written orientation materials and relevant policies and procedures.
d) FACILITY shall maintain responsibility for patient care.
e) Facility shall provide the Trainees with a variety of clinical educational experiences as mutually agreed upon by UVA Program Director and the FACILITY Program Director, consistent with the requirements of the ACGME.
FACILITY RESPONSIBILITIES. FACILITY shall retain responsibility for Trainees education and for arranging appropriate clinical learning experiences for Trainees. Prior to Trainees’ placement at UVA, FACILITY shall provide UVA information on Trainees’ education and experience, dates of assignment to UVA, number of Trainees to be placed, names, pertinent identification information about Trainees, objectives for the clinical education experience and suggested curriculum outlines. FACILITY shall ensure that all Trainees assigned to UVA have attained the required education level for the educational program or for the position assigned as well as the experience and competency level appropriate for the educational training program or position. FACILITY shall pay Trainees’ salary and employment benefits while at UVA. FACILITY shall maintain during the life of this agreement general liability coverage on behalf of its trainees and professional malpractice coverage in the minimum amounts in accordance with Virginia State Code § 8.01-581.15. FACILITY shall provide to UVA, certificates of insurance evidencing the coverage required herein upon request. FACILITY Trainees assigned are required to complete health screenings prior to placement at UVA, and shall provide UVA their immunization history. FACILITY shall verify that Trainees assigned to UVA are United States' citizens or otherwise legally authorized Residents of the United States. FACILITY shall cause all Trainees who are placed at UVA and have the potential for exposure to blood and potentially infectious body fluids to receive specific information and training about occupational exposure and appropriate protective measures prior to assignment at UVA. FACILITY shall document such training and make such documentation available to UVA upon request. FACILITY shall make the hepatitis B vaccination available to any Trainees who have the potential for exposure. FACILITY agrees to comply with current Centers for Disease Control ("CDC") recommendations/guidelines in testing of Trainee for tuberculosis. FACILITY shall retain and make available upon request, to UVA a copy of the results of such tuberculosis screenings. FACILITY shall not knowingly assign to UVA, nor permit to continue in assignment, any Trainees whose medical or psychiatric condition would be inconsistent with safe clinical practice. FACILITY RESPONSIBILITIES. The FACILITY shall:
A. Provide clinical practicum and/or internship/externship experiences as stated in the objectives of the COLLEGE and FACILITY, and supervision appropriate to the academic competencies of the clinical practicum and/or internship/externship experiences.
B. When the hospital provides appropriate preceptors for the STUDENTS’ clinical experiences the Facility agrees to assume legal and financial responsibility for the preceptors.
C. Provide appropriate orientation and information regarding the policies, rules and regulations of the FACILITY to incoming STUDENTS.
D. Make available the physical facilities and other equipment necessary to support the clinical practicum and/or internship/externship experiences unless otherwise directed by the COLLEGE.

F. Retain primary responsibility for its clients.
G. Complete forms requested by the COLLEGE that pertain to STUDENTS’ evaluations.
H. FACILITY may be requested to provide information such as proof of insurance, licensure, accreditation or other information.
I. Inform the COLLEGE immediately of any improper or unsatisfactory STUDENT performance or behaviors. This would include behavior that is disruptive or detrimental to the FACILITY and/or violates the Code of Ethics of the discipline, or FACILITY regulations, policies or procedures. If performance or behavior does not improve, FACILITY shall request that the COLLEGE immediately withdraw a STUDENT from assigned clinical practicum and/or internship/externship experience.
J. Provide and/or facilitate reasonable and appropriate emergency medical care for STUDENT; STUDENT shall be responsible for any and all costs and expenses arising from and/or associated with said emergency medical care. STUDENT shall have the right to refuse emergency care.
K.
