HOURS OF WORK, ETC. (a) The calendar week shall be from 12:01 A.M. Sunday to midnight the following Saturday.

HOURS OF WORK, ETC. The following is a schedule of the regularly assigned hours of work, conditions of overtime, payments, notices of lay-offs, leaves of absence, and rates of production. The standard work week is five days and eight hours per day for a total of forty hours per week, Monday through Friday. The work week shall begin at a.m. Monday and end at midnight the following Sunday, for purposes of payroll. Normally the hours of the first shift shall be a.m. to p.m.; the hours of the second shift p.m. to midnight and the third shift midnight to a.m. It is that it may be desirable for the Company to arrange staggered shifts to obtain better of parking and lunchroom facilities. Thirty minutes will be allowed the first and second shifts as a non-paid lunch period, with a shift premium to the second shift. The third shift will be allowed a twenty minute lunch period and will be paid eight hours of pay for six hours and forty minutes of work. The first and second shifts rotate every two weeks, except where an imbalance of skills, or in the number of employees requires adjusting the number of first shift employees going to the second shift. The terms of Article may be amended during the term of this Agreement through mutual consent of the parties. The Company does not guarantee to provide work for any employees for regularly assigned hours or for any other hours. An employee shall be paid for not less than four hours work when called in. A minimum of four hours work or four hours pay at his regular straight time hourly rate shall be provided to an employee who reports for work at his regular starting time unless instructed not to report. This provision shall not apply in the case of lost time resulting from disciplinary measures or when a condition arises beyond the control of the Company such as fire, major mechanical or electrical failure, Government regulations or orders, Acts of God, etc. or an employee is absent from work on the last shift and the Company is unable to contact him. In case of layoff, notice shall be given to the affected employees personally, if not absent from work, and by notice posted on the clock or bulletin board no later than during the second working day prior to the layoff. HOURS OF WORK, ETC. Section 1. The Unions and the Contractor acknowledge that the unique needs of this Project will require flexibility in scheduling work The Contractor shall establish the work schedule or schedules consistent with job needs. The Contractor has the sole authority to make shift and overtime assignments to employees as deemed necessary to efficiently perform work activities. Refusal by an employee to work an assigned shift or hours of work may be grounds for termination.
Section 2. Recognized holidays shall be as follows: New Year's Day, Memorial Day, Fourth of July, Labor Day, Thanksgiving Day and Christmas Day. There shall be no paid holidays, except as provided for operation of special equipment which has been historically guaranteed 40 hours per week. If employees are required to work on a holiday, they shall receive double the straight- time rate of pay. (Except as noted in Attachment C.)
Section 3. Overtime shall be paid at the rate of time and one half (1-1/2) for all hours worked outside the established shift(s) or in excess of forty (40) hours per week. Provided, however, all work performed on Saturdays shall be paid at the rate of time and one-half (1-1/2) and all work on Sundays and holidays shall be paid at double (2) time. (Except as noted in Attachment C.)
Section 4. The CM, in coordination with the Owner, shall designate the starting and quitting times for all employees. Any starting time put in place on Monday shall remain in effect for that work week unless a change is mutually agreed upon by the Union and the Contractor.
Section 5. The Unions agree to adhere to the time checking procedures established for the Project. All employees will check in and be at their assigned work places defined by their Contractor by starting time each day and will be at the work place at the conclusion of the lunch break or end of the shift. Repeated violations of the work starting and stopping times will be grounds for termination.
Section 6. It will not be a violation of this Agreement for the CM to shut down all or part of the Project to avoid the possible loss of life because of an emergency situation that could endanger the life and safety of an employee or the public. In such cases, employees will be compensated only for the actual time worked. However, if the Contractor requests employees to stand by, the employees will be compensated for the actual "stand by time." (Except as noted in Attachment C.) Section 7. HOURS OF WORK, ETC. Hours of each Educational Support Professional will be based upon the need of the specific job assignment. Each Educational Support Professional will be notified in writing of the number of hours of their assignment. This assignment shall be made by July 31st of each school year. The work year for Educational Support Professionals will be all student days and one (1) orientation day. Any work performed by Educational Support Professionals at the request of the building Principal or at the request of the employee with the prior approval of the building Principal in consultation with the Special Education Director will be paid at their hourly rate. Educational Support Professionals required to attend after-school functions during the school year including meetings, parent workshops, night school, conferences, early release day programs or student activities will be paid at their hourly rate. Also, should Educational Support Professionals work only half days on early release days they shall be paid only for the hours worked, which would be equal to at least the student hours.

The hours of work for part time employees shall be not less than four (4) hours per day.
(c) Overtime: Any hours worked in excess of eight (8) and up to eleven (11) hours in any one (1) regular work day shall be paid for at the rate of time and one-half (1 ½). Any hours worked in excess of eleven (11) hours in any one (1) regular work day shall be paid at the rate of double time (2X). In order to qualify for the double time provisions after the eleven (11) hours as set out herein, where any overtime is worked as a result of a relief not showing up, the Guard then on duty must notify the dispatch of the failure of the relief to show up, no later than thirty (30) minutes past his normal shift end. Failure to notify the dispatch in the thirty (30) minutes immediately following the shift end, the overtime provisions shall only be time and one-half (1 ½) for the first four (4) hours and double time thereafter. Continued failure in not reporting the non showing of relief in the first thirty (30) minutes after a Guard's regular shift end may result in disciplinary action.
(d) Where it is necessary for a shift or hours of work to be split or adjusted in order to meet the requirements of a job, the Employer shall provide the details of the job and the proposed shift schedule to the Union. Providing the Union and the employee(s) concerned are in agreement, adjustments can be made upon approval of all parties. Shifts will not exceed twelve (12) hours per day.
(e) All time worked in excess of forty (40) hours in a work week or eight (8) hours in a work day shall be at time and one-half ( 1 ½) regular rates of pay.
(f) Any employee called out after his working day has been completed shall be paid a minimum of four (4) hours' pay at the applicable overtime rates of pay.
