JOB POSTING AND TRANSFER. (a) Where a vacancy for a position occurs in the Bargaining Unit, the Employer shall post the vacancy at every work location where employees in the Bargaining Unit are employed.
(b) Each posting will indicate the position, location, any requirements beyond basic qualifications, commencement date and deadline date for applications. A copy shall also be sent to the Union. Each posting will clearly indicate that applications shall be considered from permanent members of the Teacher Bargaining Unit prior to considering external applicants.
(c) The vacancy shall be posted for at least seven (7) work days before the deadline for applications for the position.
(d) When a Teacher:
(i) has the qualifications and ability required for the position; and
(ii) has not had unsatisfactory evaluations placed on his/her file during the previous twelve (12) months; and
(iii) has applied for the position; the Employer will authorize the transfer.
(e) Where, in the opinion of the Employer, two (2) or more Teachers possess the appropriate qualifications the following criteria shall be used, in order, to determine which Teacher shall be transferred:
(i) the Teachers' seniority;
(ii) the Teachers' experience in teaching the particular program;
(iii) the Teachers' additional qualifications.
(f) Unsuccessful applicants shall be notified within five (5) working days after the vacancy has been filled. An unsuccessful applicant shall, upon request, be granted an interview with an appropriate Employer Representative to discuss the matter, including the reasons why he/she was not successful. The Union will be provided the name of the successful candidate.
JOB POSTING AND TRANSFER. 9.01 The Employer will post notice of all new and vacant full-time, PTO and PTU positions for a period of seven (7) consecutive calendar days. The Employer will send a copy of the posting(s) to the normal work location of any employee who has a fixed place of work and who does not regularly work or attend at the Employer’s head office but the failure of any such employee to see or receive the notice shall not affect the validity of the Employer’s selection or decision. Employees in the bargaining unit, if any, may make written application for such vacancy within the seven (7) day period. The posting shall set out the job title, wage rate, the qualifications and a brief summary of the job.
9.02 Where no qualified full-time, PTO or PTU applicants apply or if full-time and PTO and PTU applicants apply and are not selected for the posted position, casual and temporary employees may apply. The Employer will send a copy of notice for all new and vacant full-time, PTO and PTU positions to the normal work location of any employee who has a fixed place of work and who does not regularly work in or attend at the Employer’s office, but the failure of any such employee to see or receive the notice shall not affect the validity of the Employer’s selection or decision. The posting (as identified above from either Part I or II of the collective agreement) shall set out the job title, wage rate, the qualifications and a brief summary of the job. In the event the Employer increases or decreases the number of hours of work per day or per week or days of work per week for a full-time, PTO or PTU position, the position will not be deemed to be a new or vacant position as defined by Article
9.01 in this Part and there is no requirement to post for the position provided the change in hours does not result in an employee who was full-time or PTO becoming a PTU employee or result in the PTU employee becoming a full-time or PTO employee.
9.03 During the posting period provided for in Article 9.01 in Parts I or II, the Union will be provided with copies of job postings in relation to all new or vacant positions within the bargaining unit. It is understood that the copies of the job posting provided to full-time, PTO and PTU employees under Parts I or II fulfils the Employer’s requirements under this provision.

JOB POSTING AND TRANSFER. 13.01 When a vacancy occurs in the bargaining unit, or a new position is created, and the Museum decides to fill such vacancy or position, then the Museum will post the openings on the Museum’s bulletin board for a minimum period of five (5) working days. Copies of the posting will be posted on the job posting bulletin boards located at each Museum building, and on the ROM Intranet and Internet website. The Museum agrees to receive during the five (5) working day posting period, written applications from Employees desirous of being considered for the vacancy. 13.02 A candidate shall be selected on the basis of his/her qualifications and abilities, including, without limitation, educational qualifications, type of experience, training, individual abilities, reliability, efficiency and attendance. If, in the opinion of the Museum, two or more candidates are capable of performing the work satisfactorily and are relatively equal in respect of their qualifications and abilities, then seniority will be the controlling factor in selecting the candidate. If, in the opinion of the Museum, the candidate selected proves him/herself suitable, able and competent to perform the duties and satisfactorily completes a trial period as specified in Article 13.05, the Employee shall then be confirmed in that position.
13.03 Where an internal applicant is unsuccessful in a job competition, the Museum will so notify the Employee in writing, and if requested, discuss reasons.
13.04 During a trial period as provided for in Article 13.06 and at any time prior to confirmation pursuant to the foregoing clause, an Employee may return to his/her former job and salary if that Employee so desires or may be returned thereto if the Employee is not performing the duties satisfactorily. The Museum will return Employees who have been promoted or transferred as a direct result of such a trial period to their former jobs and salaries with seniority, or may relocate them to equivalent positions for which they are qualified. (a) a permanent vacancy arises in circumstances in which an employee has failed to give two (2) weeks notice, or upon the agreement of the Union.
