WORK WEEK - HOURS OF WORK. 13.1 The Town’s work week begins on Monday morning at 12:00 a.m. (midnight) and ends on Sunday evening at 11:59 p.m. If an assigned police shift begins on Sunday and carries past midnight, the assigned hours after midnight will be included with the previous day for payroll purposes. The Town requires the presence and diligent efforts of employees in order to provide the requisite level of service to our community. 13.2 The Town reserves the right to alter or amend any employee’s work schedule at its own discretion and in accordance with the needs of the Town. An honor code of conduct exists whereby employees are entrusted to work their scheduled hours. Employees are encouraged to embrace this show of responsibility and commitment to the Town, the community and to each other. Employees who are asked by the Town to keep time records must also adhere to this honor code when completing their time records. Time records must be completed fully and accurately, and employees may not provide any false information on time records or any other Town records.
WORK WEEK - HOURS OF WORK. ‌ 1. WORK WEEK - The normal work week of Employees covered by this Agreement shall consist of forty (40) hours. The regular work week may be temporarily increased or decreased to facilitate changes in scheduled shift assignments. Such temporary decreases will not affect basic pay schedules nor will temporary increases entitle Employees to overtime pay rates, except as mandated by the Fair Labor Standards Act. The scheduling of work shifts and work weeks shall be directed by the Department Head, as provided by NRS 288. Unworked holidays listed in Section 4, Article A, annual leave, administrative leave with pay and compensatory time off pursuant to Section 4, Article J (1) would be counted as hours actually worked for purposes of computing FLSA and contractual overtime. Sick leave and other unpaid leave such as leave without pay will continue to be excluded from the computation of hours actually worked for the purposes of computing FLSA and contractually scheduled overtime. 2. Duty hours shall be devoted fully to the performance of assigned duties; periods of absence for personal reasons are not creditable toward duty hours and must be charged to annual leave, leave of absence without pay or, if resulting from a legitimate illness or physical injury, to sick leave as defined in Section 4, Article C. 3. BREAKS (defined) - Except during emergency situations, Employees covered by this Agreement shall be permitted one (1) fifteen (15) minute break or rest period for each four (4) hour term of assigned duty., not to exceed two (2) such break periods in any eight (8) hour shift. Breaks may not be combined, nor taken during the first or last hour of the shift without the approval of the Department Head. Employees shall be permitted an additional fifteen (15) minute break for each additional four (4) hour period in addition to any regular shift. 4. This Article is intended only as basis for computing overtime and is not intended as a guarantee of hours of work per day or per week. 5. LUNCH BREAK - Meal Periods - Employees will have one of three meal period assignments, as determined by the Supervisor: All Employees shall be provided no less than one-half (1/2) hour nor more than one (1) hour lunch period at the discretion of the Department Head. This lunch period is the Employee's own time. The normal workweek shall be a forty (40) hour week, eight (8) hours a day, five (5) consecutive days per week. Refer to attached Memorandum of Agreement for additional information. 3. However, the scheduling of the hours to be worked, the starting and quitting time, lunch periods, compensation time and other details of the work week shall be the prerogative of the governing body of Delaware County or the Sheriff so long as they do not violate any existing Federal or State Law. 4. The established work schedule shall not be changed without reasonable advance notice to the employee except in an emergency when it is necessary to do so to provide for continuation of County services. 5. There shall be no rescheduling of days off or tours of duty for the sole purpose of avoiding the payment of overtime.
WORK WEEK - HOURS OF WORK. All employees of the PBA shall be governed by the following work week and hours of work schedule: a. All employees employed in the continuous operation of the Patrol Units shall have a workweek, inclusive of two weekends, consisting of four (4) consecutive days on and two (2) consecutive days off. i. The basic hours of work for four and two employees (hereafter “4 & 2”) shall be from 7:00 AM to 3:00 PM, 3:00 PM to 11:00 PM and 11:00 PM to 7:00 AM. All 4 & 2 employees shall be allowed one (1) thirty (30) minute lunch period at a time and in an area designated by the Supervisor. ii. The basic hours of work for five and two employees (hereafter “5 & 2”) shall be from 8:00 AM to 4:00PM. All 5 & 2 employees shall be allowed one (1) thirty (30) minute lunch period. b. For those employees assigned to the Passaic County Court House and Administration Complex, the basic workweek shall consist of Monday through Friday from 8:15 AM to 4:15 PM, inclusive of a one (1) hour lunch period. The Sheriff shall have the right to limit lunch periods of Court House and Administration Complex personnel to thirty (30) minutes. c. As a condition of employment, employees must be available to work any and all shifts as needed to maintain the efficient operation of the Passaic County Sheriff’s Department. When necessary, employees may be placed on a staggering starts and finishes. d. If an employee is more than thirty (30) minutes late in reporting without good cause, the Sheriff or his designee may send the employee home for the balance of the working day, in which event he/she shall not receive any pay for that day. e. The Parties agree to meet for the purposes of considering alternative schedules. Such alternative schedules shall be implemented upon mutual agreement. f. Except in emergent situations, one week advanced notice shall be given to an Officer prior to any non-emergent shift change.

However, the scheduling of the seven (7) hour work day may vary where the nature of the work requires different coverage such as the Highway Department and the Countryside Care Center. Howev- er, there shall be a minimum of one-half (½) hour lunch period. 4. Those employees employed on a forty (40) hour per week basis will work eight (8) hours a day exclusive of meal periods, five (5) days per week with a minimum of one-half (½) hour lunch period. 5. Except for the Countryside Care Center, the eight (8) hour work day shall normally be scheduled between the hours of 7: 00 a. m. and 5:00 p. m. 6. However, the scheduling of the hours to be worked, the starting and quitting time, lunch periods, compensation time and other details of the work week shall be the prerogative of the governing body of Delaware County or the Department Head in each particular department so long as they do not violate any existing Federal or State Law. 7. The established work schedule shall not be changed without reasonable advance notice to the employee except in an emergency when it is necessary to do so to provide for continuation of County services. 8. There shall be no rescheduling of days off or tours of duty for the sole purpose of avoiding the payment of overtime. 9. The County agrees to develop and institute a master work schedule for the nursing staff at the Countryside Care Center. Alternative plans will be developed by the County. This provision shall in no way restrict the County's right to modify any schedule that is instituted if such schedule proves to be inefficient or unworkable.

The eight (8) hour work day shall normally be scheduled between the hours of 7:00 AM. and 5:00 PM, unless department requires 24/7 coverage. 7. However, the scheduling of the hours to be worked, the starting and quitting time, lunch periods, compensation time and other details of the work week shall be the prerogative of the governing body of Delaware County or the Department Head in each particular department so long as they do not violate any existing Federal or State Law. 8. WORK WEEK - HOURS OF WORK. Shifts 11.1 Work Week: A. Recognizing that flexibility is required in the scheduling of assignments for command personnel, the normal work week shall be the equivalent of forty (40) hours per week with normal assigned work schedules as follows: A five (5) day work schedule Monday through Friday beginning between 7:00 a.m. and 9:00 a.m., or A mutually agreed upon 9/80 schedule, working 80 hours over two work weeks, with eight (8) nine (9) hour days, one (1) eight (8) hour day, and one (1) day off. WORK WEEK - HOURS OF WORK a) Regular Work Week The regular work week shall consist of five (5) consecutive work days in a pre-established work schedule, and shall begin Monday and end Friday. b) Transit Work Week A transit employee shall be entitled to two (2) days off per calendar week. The Employer shall determine which days the transit employees shall have off and shall determine the number of employees that can be off in any one (1) day. This paragraph is intended to provide a basis for establishing normal work schedules for transit workers and shall not be construed as a guarantee of hours of work per day or per week.
